SUBMITTED BY: CRUZ, ABNER 0517 (AR10116892) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: OXYCODONE 30 MILLIGRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 091710 I ASSISTED DEPUTY LAUGHLIN IN A TRAFFIC STOP AT HIGHWAY 44 EAST AND ELMWOOD STREET. WHILE ASSISTING DEPUTY LAUGHLIN I LOCATED AN OXYCODONE PILL ON THE PASSENGER SEAT OF THE VEHICLE, WHICH LED TO AN ARREST OF THE PASSENGER, MS ANGELA CALLIHAN. THE DRIVER OF THE VEHICLE, MR FRANCIS GRIFFIN, WAS RELEASED ON SCENE. APPROXIMATELY 30 MINUTES LATER, DEPUTY LAUGHLIN CONTACTED ME AND INFORMED ME THAT HIS DEFENDANT HAD ADVISED HIM THAT THE DRIVER, MR FRANCIS GRIFFIN, HAD HIDDEN APPROXIMATELY FOUR OXYCODONE PILLS IN A CLEAR PLASTIC BAGGIE BEHIND A PILLAR, WHILE MYSELF AND DEPUTY LAUGHLIN WERE SPEAKING WITH HER. I RETURNED TO THE SCENE OF THE ORIGINAL TRAFFIC STOP AND I IMMEDIATELY OBSERVED THE PILLAR THAT DEPUTY LAUGHLIN ADVISED ME OF. I THEN DISCOVERED BEHIND the PILLAR A CLEAR PLASTIC BAGGIE CONTAINING FOUR OXYCODONE PILLS, 30 MILLIGRAMS, AS MENTIONED BY DEPUTY LAUGHLIN'S DEFENDANT. I THEN RESPONDED TO 5020 WEST OPALINE LANE IN DUNNELLON. THERE I MADE CONTACT WITH FRANCIS GRIFFIN, THE DEFENDANT. I ADVISED HIM OF THE REASON I WAS THERE. I THEN READ MR GRIFFIN HIS MIRANDA WARNINGS, WHICH HE UNDERSTOOD AND AGREED TO SPEAK TO ME ONCE WE GOT TO THE DETENTION FACILITY. HE WAS PLACED UNDER ARREST HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY OMELIAN. WHILE AT THE DETENTION FACILITY, I ONCE AGAIN MADE CONTACT WITH MR GRIFFIN, SINCE HE HAD EXPRESSED INTEREST IN SPEAKING WITH ME. AT WHICH TIME HE ADMITTED TAKING THE PILLS FROM HIS CENTER CONSOLE OF HIS VEHICLE AND HIDING THEM BEHIND THE PILLAR. MR GRIFFIN PROVIDED A WRITTEN STATEMENT ADMITTING HIS INVOLVEMENT, STILL HAVING HIS MIRANDA WARNINGS IN MIND. THE DEFENDANT WAS CHARGED WITH POSSESSION OF A CONTROLLED SUBSTANCE AND WAS RELEASED ON HIS OWN RECOGNIZANCE, DUE TO HIS COOPERATION. THE OXYCODONE PILLS WERE TURNED INTO EVIDENCE.
