SUBMITTED BY: CLARK, CORRY 0711 (AR11120279) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED FOR FINANCIAL RESPONSIBILITY, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(10)(A). ON 041511, AT APPROXIMATELY 0909 HOURS, I WAS CONDUCTING TRAFFIC ENFORCEMENT IN THE HERNANDO AREA WHERE I GOT BEHIND THE DEFENDANT'S BLACK FORD PICKUP TRUCK AT THE INTERSECTION OF PARSON'S POINT AND STATE ROAD 41. WHILE BEHIND THE DEFENDANT'S VEHICLE I RAN THE DEFENDANT'S LICENSE PLATE NUMBER H622MI, IN FCIC/NCIC WHICH SHOWED THE TAG EXPIRED ON 013011. HOWEVER, I OBSERVED THE YELLOW STICKER ON THE LICENSE PLATE DISPLAYING 08/2011. AT THAT TIME I FOLLOWED THE VEHICLE AND INITIATED A TRAFFIC STOP AT STATE ROAD 41 AND STATE ROAD 200 IN THE CUMBERLAND FARMS STORE PARKING LOT. I APPROACHED THE VEHICLE AND MADE CONTACT WITH THE DRIVER/DEFENDANT. I OBSERVED THE DEFENDANT MAKING A TELEPHONE CALL. I ASKED WHO HE WAS ATTEMPTING TO CALL, TO WHICH HE STATED, HIS NEIGHBOR. I THEN ASKED HIM FOR what REASON HE WAS CALLING THE NEIGHBOR, TO WHICH HE STATED, "TO COME AND PICK UP HIS VEHICLE". THE DEFENDANT THEN ASKED MY REASON FOR THE TRAFFIC STOP, TO WHICH I INFORMED HIM IT WAS FOR THE TAG BEING EXPIRED. I THEN ASKED WHY HIS STICKER DISPLAYED 08/11, TO WHICH HE GAVE NO ANSWER. UPON FURTHER DISCUSSION, THE DEFENDANT ADVISED HE KNEW THE STICKER HAD BEEN ALTERED BUT HE WOULD NOT ADVISE ME WHO HAD ALTERED THE STICKER, BUT STATED IT WAS NOT HIM. AT THAT TIME THE DEFENDANT PROVIDED ME WITH HIS DRIVER'S LICENSE AND REGISTRATION. UPON RUNNING THE DEFENDANT'S DRIVER'S LICENSE IN FCIC/NCIC IT INDICATED HIS DRIVER'S LICENSE WAS SUSPENDED DUE TO A FINANCIAL RESPONSIBILITY SUSPENSION ON 052010. AT THAT TIME I ALSO RAN THE DEFENDANT'S INFORMATION THROUGH D.A.V.I.D., WHICH ALSO CONFIRMED HIS LICENSE WAS SUSPENDED. I THEN MADE CONTACT AGAIN WITH THE DEFENDANT AND ASKED ABOUT HIS DRIVER' S LICENSE BEING SUSPENDED, TO WHICH HE STATED HE DID NOT KNOW IT WAS SUSPENDED. UPON FURTHER DISCUSSION WITH THE DEFENDANT HE REVEALED THAT HIS LICENSE WAS SUSPENDED DUE TO HIM BEING INVOLVED IN AN AUTOMOBILE ACCIDENT WITH INJURES, AND ADVISED HE KNEW IT WAS SUSPENDED, AND HE WAS JUST DRIVING TO THE POST OFFICE TO CHECK HIS MAIL. HE STATED HE DOES NOT SEE THE BIG DEAL OF HIM DRIVING ON A SUSPENDED DRIVER'S LICENSE, AND THAT IT WAS NOT LIKE HE HAD KILLED OR HURT ANYONE. I THEN WROTE THE DEFENDANT A CITATION FOR EXPIRED TAG LESS THAN SIX MONTHS, CITATION NUMBER 5275-GJX-4, AND ALSO WROTE A CRIMINAL CITATION FOR DRIVING WHILE LICENSE SUSPENDED, CITATION NUMBER 9276-GJX-X WITH COURT DATE OF 050511 AT 1300 HOURS. AT THAT TIME I ADVISED THE DEFENDANT OF THE COURT DATE AND EXPLAINED HOW TO COMPLY WITH THE CITATION. THE DEFENDANT THEN HAD HIS NEIGHBOR COME AND RETRIEVE THE VEHICLE FROM THE PARKING LOT AND HAD IT REMOVED TO HIS RESIDENCE. I PLACED THE DEFENDANT UNDER ARREST AND TRANSPORTED HIM TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT. WHILE EN ROUTE TO THE DETENTION FACILITY, THE DEFENDANT STATED THAT HE DID NOT BELIEVE THIS WAS A BIG DEAL AND THAT HE WOULD DRIVE AGAIN. UPON ARRIVAL AT THE DETENTION FACILITY I TURNED THE DEFENDANT and HIS BELONGINGS OVER TO THE JAIL STAFF FOR BOOKING AND PROCESSING. THE CITATIONS WERE LATER TURNED OVER TO RECORDS. I PROVIDED THE DEFENDANT WITH COPIES OF THE CITATIONS. THE DEFENDANT'S BOND SET AT $500.00 PER THE BOND SCHEDULE.
