Probable cause affidavit: | SUBMITTED BY: SETTLES, KATHERINE 0113 (AR10115566) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: VICTIM'S RESIDENCE, LOCATED AT 753 NE 9TH STREET, APARTMENT NUMBER SEVEN, IN CRYSTAL RIVER, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: THE DEFENDANT WENT IN TO USE THE BATHROOM, IN VIOLATION OF FLORIDA STATUTE 810.02(3)(A). UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. THE DEFENDANT DID DRINK ON THE PREMISES OF NE 9TH STREET APARTMENT COMPLEX, WHERE THE DEFENDANT DID ENTER THE VICTIM'S RESIDENCE, USE THE BATHROOM AND UPON EXITING ENGAGED IN A VERBAL ARGUMENT WITH THE VICTIM/HOMEOWNER. THE DEFENDANT THEN LEFT THE RESIDENCE AND RAN TOWARDS THE EAST SIDE OF THE APARTMENT COMPLEX IN AN ATTEMPT TO HIDE. UPON LAW ENFORCEMENT ARRIVAL, WHILE SPEAKING WITH THE VICTIMS, THE DEFENDANT CAME FROM AROUND THE SIDE OF THE BUILDING IN AN ATTEMPT TO GET TO HIS VEHICLE PARKED IN THE PARKING LOT. THE DEFENDANT WAS INTOXICATED WEARING NO SHOES AND HAD AN ODOR EMITTING FROM HIS PERSON, WHICH IS ASSOCIATED WITH AN ALCOHOLIC BEVERAGE. THE VICTIMS ADVISED THAT THEY HAD NEVER SEEN OR KNOW THE DEFENDANT; HOWEVER, WHILE HE ENGAGED IN A VERBAL ALTERCATION THE DEFENDANT STATED THAT HE LIVED NEXT DOOR. BOTH VICTIMS ADVISED THAT THEY DO NOT KNOW HIM OR EVER ALLOWED HIM IN THEIR RESIDENCE BEFORE. THE DEFENDANT WAS PLACED UNDER ARREST HANDCUFFED (DOUBLE LOCKED) AND PLACED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCJ), WITHOUT INCIDENT FOR BOOKING AND PROCESSING. JUST PRIOR TO TRANSPORT THE DEFENDANT UTTERED "I KNOW I WENT IN THEIR HOUSE BUT I DIDN'T MAKE ANY AGGRESSIVE MOVES TOWARDS THEM". BOTH VICTIMS PROVIDED WRITTEN STATEMENTS AND WERE PROVIDED WITH AN AGENCY CASE CARD BEARING THIS CASE NUMBER. THE DEFENDANT 'S VEHICLE WAS FOUND IN THE PARKING LOT WITH THE EMERGENCY FLASHERS ON. NO KEYS WERE ABLE TO BE LOCATED FOR THE VEHICLE; HOWEVER, THE DEFENDANT'S WHITE TENNIS SHOES WERE ON THE FLOORBOARD OF THE DRIVER'S SEAT. THE VEHICLE WAS LEFT ON SCENE. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF BURGLARY TO OCCUPIED RESIDENCE WITH BOND SET AT $25,000.00 AND ONE COUNT OF DISORDERLY INTOXICATION WITH BOND SET AT $150.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
