SUBMITTED BY: MCINTYRE, JIM 0128 (AR11120166) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN CONVEYANCE, TO-WIT: THE DEFENDANT DID ENTER THE VICTIM'S VESSEL WITHOUT THE VICTIM'S PERMISSION, AND REMOVED THE PROPERTY OF THE VICTIM WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, IN VIOLATION OF FLORIDA STATUTE 810.02(4)(B). DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: THE DEFENDANT DID REMOVE MISCELLANEOUS MARINE/FISHING ACCESSORIES FROM THE VICTIM'S VESSEL OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTE, 812.014(2)C)(1). ON 040311 A BURGLARY REPORT OF FIVE VESSELS AND THE THEFT OF FISHING /MARINE ACCESSORIES TO INCLUDE MARINE BATTERIES, FISHING RODS AND REELS, BOAT FUEL AND TANKS, OUTBOARD MOTORS AND OTHER RELATED ITEMS WERE TAKEN FROM 2925 NORTH BROWN POINT IN HERNANDO, FLORIDA. THE LISTED SUSPECTS IN THE REPORT WERE WHITE MALES, WILLIAM STUELKE AND GABRIEL IGLESIAS. ON 040311, GABRIEL IGLESIAS AND WILLIAM STUELKE WERE TAKEN IN TO CUSTODY ON UNRELATED TRAFFIC OFFENSES BY DEPUTY JASON STRICKLAND OF THE CITRUS COUNTY SHERIFF'S OFFICE. THIS DETECTIVE WAS NOTIFIED AND RESPONDED TO THE SCENE WHEN TOLD THAT WILLIAM STUELKE REQUESTED TO SPEAK WITH SOMEONE IN REFERENCE TO RECENT BURGLARIES AND THEFTS REPORTED EARLIER THIS DATE. DURING A POST MIRANDA DIGITALLY RECORDED INTERVIEW, WILLIAM STULKE ADVISED THAT HE BELIEVED HIS ROOMMATE, GABRIEL IGLESIAS, WAS INVOLVED IN THE REPORTED THEFTS OF MARINE AND FISHING ACCESSORIES. WILLIAMS STUELKE ADVISED THAT GABRIEL IGLESIAS LEFT THEIR RESIDENCE LOCATED AT WATSON'S FISH CAMP AT 4195 EAST PARSON'S POINT ROAD LOT, 37, HERNANDO FLORIDA, AROUND 2230 HOURS ON 040211 AND DID NOT RETURN UNTIL 0400 HOURS ON 040311. WILLIAMS STUELKE ADVISED THAT WHEN HE AWOKE ON THE MORNING OF 040311, HE NOTICED SEVERAL BOAT FUEL TANKS, FISHING POLES AND MARINE BATTERIES INSIDE THEIR RESIDENCE THAT WERE NOT THERE WHEN HE WENT TO BED ON THE EVENING OF 040211. WILLIAM STUELKE FURTHER ADVISED THAT GABRIEL IGLESIAS SHOWED HIM BOAT FUEL TANKS THAT WERE LOCATED IN THE TRUNK OF GABRIEL'S 1986 FORD MUSTANG THAT WAS NOT THERE PRIOR TO HIS LEAVING THE RESIDENCE ON 040211. DURING THE DIGITALLY RECORDED INTERVIEW, WILLIAM STULKE CONSENTED TO A SEARCH OF HIS RESIDENCE. UPON OPENING THE FRONT DOOR OF THE 30 FOOT PULL BEHIND CAMPER TRAILER LOCATED AT LOT 37 OF WATSON'S FISH CAMP, THIS DETECTIVE OBSERVED IN PLAIN VIEW SEVERAL FISHING POLES AND MARINE BATTERIES ON THE FLOOR. WHEN ASKED WHAT WAS IN THE CLOSED CLOSET, WILLIAM STUELKE ADVISED THAT HE DID NOT KNOW THAT GABRIEL IGLESIAS KEPT STUFF IN THERE. THIS DETECTIVE THEN ASKED WILLIAM STUELKE WHERE THE STRONG ODOR OF GASOLINE WAS COMING FROM INSIDE THE CAMPER, WHERE HE ADVISED HE DID NOT KNOW. THIS DETECTIVE WAS ABLE TO ESTABLISH THE STRONG ODOR OF GASOLINE WAS COMING FROM THE CLOSED CLOSETS BY SMELLING THE GAP IN THE CLOSET DOORS. WE EXITED THE CAMPER AND THE SCENE WAS SECURED IN ORDER TO OBTAIN A SEARCH WARRANT. DEPUTY JEREMY LAUGHLIN OF THE CITRUS COUNTY SHERIFF'S OFFICE REMAINED ON SCENE WHILE I OBTAINED A SEARCH WARRANT FOR THE PREMISE. THE SEARCH WARRANT WAS SUBSEQUENTLY SIGNED BY HONORABLE JUDGE WILLIAM HALLMAN, AND EXECUTED ON THE RESIDENCE ON THIS SAME DATE. NO ONE WAS PRESENT AT THE RESIDENCE AT THE TIME OF THE EXECUTION OF THE SEARCH WARRANT. DURING THE SEARCH WARRANT SEVERAL STOLEN ITEMS WERE RECOVERED INSIDE THE DEFENDANT'S RESIDENCE TO INCLUDE TWO OUTBOARD MOTORS, FISHING POLES, FISH FINDER, TACKLE AND TACKLE BOX, TWO MARINE BATTERIES, AND OTHER MARINE/FISHING ACCESSORIES. PROPERTY BELONGING TO VICTIM ONE (UPDYKE) AND VICTIM FIVE (LEGUE) AND VICTIM SIX (CHATTIN) WAS RECOVERED INSIDE THE DEFENDANT'S RESIDENCE LOCATED AT LOT 37 AT WATSON'S FISH CAMP IN HERNANDO. THE PROPERTY BELONGING TO EACH OF THE VICTIMS WERE REPORTEDLY OVER THREE HUNDRED DOLLARS IN VALUE. ON 040611, I WAS CONTACTED BY THE CITRUS COUNTY DISPATCH CENTER, AND ADVISED OF AN ADDITIONAL VICTIM (CHATTIN) WHO WAS REPORTING ON THIS DATE THAT HIS VESSEL BEHIND HIS RESIDENCE LOCATED AT 4051 EAST PARSON'S POINT ROAD IN HERNANDO, HAD BEEN ENTERED AND THAT PROPERTY WAS REMOVED. VICTIM CHATTIN REPORTED THAT TWO MARINE BATTERIES, ONE BLUE AND ONE YELLOW IN COLOR, ALONG WITH TWO, SIX GALLON FUEL TANKS FILLED WITH FUEL, WERE REMOVED FROM THE INTERIOR OF HIS VESSEL. ALSO BEING REPORTED AS STOLEN BY VICTIM CHATTIN WAS A BLUE AND WHITE TWO SEATER PADDLE BOAT, WITH THE TOTAL VALUE OF THE PROPERTY TAKEN FROM THIS LISTED VICTIM BEING OVER $300.00 AND LESS THAN $5,000.00. THE DEFENDANT WAS CHARGED WITH AN ADDITIONAL COUNT OF BURGLARY TO A CONVEYANCE (VESSEL ) AND ONE ADDITIONAL COUNT OF GRAND THEFT WITH A TOTAL BOND SET AT $7,000.00 PER THE BOND SCHEDULE.
