SUBMITTED BY: RUBY, SAMUEL 0562 (AR09110235) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: DARVOCET (ONE PILL), IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 072909, AT 2220 HOURS, I RESPONDED TO 3770 NORTH HOLIDAY DRIVE IN CRYSTAL RIVER IN REFERENCE TO A MEDICATION THEFT. UPON ARRIVAL I MADE CONTACT WITH THE COMPLAINANT, WHO ADVISED THAT SHE HAD A WHITE MALE SUBJECT, ONLY KNOWN AS JERRY AT HER RESIDENCE AND SHE ADVISED that WHEN HE LEFT, AT APPROXIMATELY 2100 HOURS, HER BOTTLE OF PRESCRIPTION DARVOCET, 650 MG TABLETS, WAS MISSING FROM HER KITCHEN TABLE. SHE STATED SHE DID NOT SEE THIS INDIVIDUAL TAKE HER PRESCRIPTIONS BUT HE WAS THE ONLY ONE AROUND AT THE TIME IT WAS MISSING. SHE ADVISED IT WAS A WHITE MALE SUBJECT APPROXIMATELY FIVE FOOT TEN INCHES TALL, WITH BROWNISH GRAY HAIR, WEARING A WHITE T-SHIRT, BLUE SHORTS, AND WHITE TENNIS SHOES. SHE ALSO ADVISED THE SUBJECT WAS UNSHAVEN. SHE STATED THIS SUBJECT WAS HOMELESS AND CARRYING A WHITE GROCERY BAG CONTAINING PERSONAL ITEMS. ON 072809 AT 2345 HOURS, I HAD MADE CONTACT WITH THE PERSON MATCHING THIS DESCRIPTION AND A FIELD INTERVIEW REPORT WAS COMPLETED. I ADVISED THE COMPLAINANT THAT THE REPORT WOULD BE COMPLETED IN REFERENCE TO THIS CASE NUMBER. A MEDICATION THEFT AFFIDAVIT WAS ALSO COMPLETED. AT THE TIME I WAS EXITING HER RESIDENCE I OBSERVED THIS SUBJECT WALKING NORTHBOUND ON HOLIDAY STREET. THE SUBJECT DID MATCH THE DESCRIPTION FROM THE COMPLAINANT AND WAS, IN FACT, THE PERSON I HAD COMPLETED THE FIELD INTERVIEW REPORT ON. I THEN ASKED THE DEFENDANT IF I COULD SPEAK WITH HIM IN REFERENCE TO THE STOLEN MEDICATION. THE DEFENDANT ADVISED THAT HE DID NOT STEAL THE COMPLAINANT'S MEDICATION. HE ADVISED HE WAS GIVEN FIVE DARVOCET BY THE COMPLAINANT. I ASKED HIM WHY HE WAS GIVEN THE DARVOCET AND HE ADVISED HE HAD ASKED FOR IT. THE DEFENDANT THEN ADVISED THAT HE ONLY TOOK WHAT SHE HAD GIVEN HIM. THE DEFENDANT STATED I COULD LOOK THROUGH HIS BAGS IF I WISHED, WHEREUPON DOING SO, I FOUND ONE OBLONG TABLET, RED IN COLOR, WITH NUMBERS 5112 INSCRIBED ON IT WITH THE LETTER V UNDER THE NUMBERS. POISON CONTROL WAS CONTACTED WHERE I SPOKE WITH LYNN AND SHE VERIFIED THAT THE PILL WAS DARVOCET N100 650 MG, AND ADVISED IT WAS A SCHEDULE FOUR NARCOTIC. I ASKED THE DEFENDANT WHY HE HAD IT, AND HE ADVISED HE WAS GOING TO EAT IT. I ASKED HIM WHY HE WAS TAKING PRESCRIPTION MEDICATIONS THAT WERE NOT HIS, AND HE ADVISED HE WAS HAVING FAMILY PROBLEMS AND HE WAS ON PROBATION AND HAD NO PLACE TO STAY. THE DEFENDANT WAS THEN HANDCUFFED, DOUBLE LOCKED BEHIND THE BACK, AND ADVISED HE WAS BEING ARRESTED FOR POSSESSION OF A CONTROLLED SUBSTANCE, HE WAS SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT'S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. AFTER LEAVING THE DETENTION FACILITY ON 073009, AT 0130 HOURS, I RECEIVED CALL FROM THE WARRANTS DIVISION ADVISING THAT A CORRECTIONS OFFICER FOUND 11 MORE DARVOCET TABLETS LOCATED INSIDE THE DEFENDANT'S WALLET, WHICH WAS IN HIS PERSONAL ITEMS. THE PILLS WERE WRAPPED IN A LETTER. UPON RETURNING TO THE DETENTION FACILITY, I TOOK POSSESSION OF THE PILLS AND THEY WILL BE TURNED IN TO EVIDENCE. *NOT-EXEMPT* |
