Probable cause affidavit: | SUBMITTED BY: WEST, ROY 0421 (AR07100009) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. ON 102407, I WAS DISPATCHED TO THE AREA OF THE CRYSTAL RIVER POWER PLANT IN REFERENCE TO A REPORTED DRUNK DRIVER. UPON MY ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT THE SECURITY GUARD AT THE ENTRANCE GATE TO THE POWER PLANT. HE ADVISED THAT THE FEMALE DRIVER OF THE TRUCK DROVE UP AND ATTEMPTED TO PAY A TOLL WITH A TWENTY DOLLAR BILL. THE COMPLAINANT ADVISED THE DRIVER THAT THIS WAS A POWER PLANT AND NOT A TOLL ROAD AND ASKED HER TO PARK THE VEHICLE UNTIL THE SHERIFF'S OFFICE ARRIVED. I MADE CONTACT WITH THE DRIVER/DEFENDANT. THE DRIVER/DEFENDANT'S VEHICLE WAS A WHITE UTILITY PICKUP TRUCK, PARKED IN A PARKING SPACE ADJACENT TO THE POWER PLANT. THE DRIVER/DEFENDANT WAS SEATED BEHIND THE STEERING WHEEL. UPON MAKING CONTACT, I ASKED FOR HER DRIVER'S LICENSE AND THE VEHICLE REGISTRATION. SHE ADVISED THAT SHE COULD NOT PRODUCE EITHER. I ASKED FOR HER PERSONAL INFORMATION AND ADVISED HER I WAS INVESTIGATING THE FACT THAT I THOUGHT SHE WAS DRIVING UNDER THE INFLUENCE. IT SHOULD BE NOTED THE DRIVER/DEFENDANT HAD RED BLOODSHOT EYES WHICH WERE EXTREMELY WATERY. HER SPEECH WAS SLURRED AND I COULD SMELL A STRONG ODOR OF AN ALCOHOLIC BEVERAGE EMANATING FROM HER BREATH. IN LOOKING IN THE VEHICLE I COULD SEE WET DROPLETS ON THE BENCH SEAT. LOOKING IN THE BACK SEAT I COULD SEE AN OPEN TWELVE PACK OF COORS BEER IN BOTTLES WITH ONE UNOPENED BOTTLE WHICH WAS LATER FOUND TO BE COOL TO THE TOUCH. I RETURNED TO MY PATROL VEHICLE AND MADE CONTACT WITH DISPATCH/TELETYPE AND HAD THEM CHECK THE STATUS OF THE DRIVER'S DEFENDANT'S DRIVER'S LICENSE. THEY NOTIFIED ME THAT HER DRIVER'S LICENSE WAS SUSPENDED OUT OF NORTH CAROLINA FOR FAILURE TO APPEAR. I MADE CONTACT WITH THE DRIVER/DEFENDANT AGAIN AND ASKED HER TO STEP OUT OF THE VEHICLE. SHE ADVISED ME I SHOULD GO AHEAD AND ARREST HER BECAUSE SHE WAS IN NO CONDITION TO DRIVE. I ASKED HER IF SHE WOULD SUBMIT TO FIELD SOBRIETY TASKS, TO WHICH SHE STATED SHE COULD NOT BECAUSE SHE WAS TOO INTOXICATED. IN SPEAKING TO THE DEFENDANT OUTSIDE OF THE VEHICLE, I AGAIN COULD SMELL A VERY STRONG ODOR OF ALCOHOLIC BEVERAGE EMANATING FROM HER BREATH. I ASKED HER AGAIN IF SHE WOULD PARTICIPATE IN ANY FIELD SOBRIETY TASKS AND SHE AGAIN STATED SHE COULD NOT AND I SHOULD JUST GO AHEAD AND ARREST HER. I ADVISED THE DEFENDANT SHE WAS UNDER ARREST FOR DRIVING UNDER THE INFLUENCE. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND SECURED HER IN THE REAR SEAT OF MY PATROL VEHICLE. PRIOR TO SECURING THE DEFENDANT IN HANDCUFFS, I DID A CURSORY PAT-DOWN SEARCH INCIDENT TO ARREST. AFTER PLACING THE DEFENDANT UNDER ARREST, I CONFIRMED THAT THE BEER BOTTLES WERE STILL COOL TO THE TOUCH. I ALSO LOCATED AN OPEN BOTTLE OF COORS BEER WITH APPROXIMATELY ONE INCH OF BEER STILL IN THE BOTTLE. THIS BOTTLE WAS WARM TO THE TOUCH. I CALLED FOR A ROTATION WRECKER TO PICK UP THE VEHICLE AND DEPUTY LABELLE STAYED AT THE SCENE UNTIL THE VEHICLE WAS TOWED BY HOLMAN'S TOWING WHILE I TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. UPON ARRIVAL, THE DEFENDANT REFUSED TO SUBMIT TO THE APPROVED TEST OF HER BREATH FOR THE PURPOSE OF DETERMINING THE ALCOHOL CONTENT OF HER BLOOD. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
