The victim was awakened by the sexual assault and Phair then used force to restrain the victim and continued the sexual assault. RISK LEVEL 3 According to official documents Phair pled guilty in Whatcom County Superior Court on 05/23/1996 to five counts of Rape of a Child in the Third Degree. He was sentenced to a total of 120 months in prison. This conviction was the result of Phair sexually assaulting the known 12 year old female victim who was a runaway. Phair offered her shelter and security in exchange for her participation in the sexual assaults. Phair pled guilty in Whatcom County Superior Court on 09/11/1991 of one count of Rape of a Child in the Third Degree. He was sentenced to 54 months in prison. He was sentenced to 11 months with the Juvenile Rehabilitation Administration. This conviction was the result of Phair sexually assaulting the known two year old female victim. Phair was convicted in Whatcom County Superior Court, Juvenile Division on 12/15/1985 of one count of Indecent Liberties. He was sentenced to probation. This conviction was the result of Phair sexually assaulting the known four year old female victim. Phair?s lengthy history of sexual deviancy and his lack of sex offender treatment place him at the highest risk to re-offend. Phair?s latest conviction is for a non-sex offense, he has additional criminal history including Failure to Register as a Sex Offender. Phair is on active supervision with the Washington State Department of Corrections " Probation Conditions Do not use, possess, purchase or consume alcohol Submit to urinalysis, breathalyzer, and polygraph testing as directed Do not use, possess or consume any controlled substance without a lawfully issued prescription Do not associate with drug users or sellers except in the context of chemical dependency treatment Do not enter drug areas as defined by the court or the community corrections officer Enter into and successfully complete certified chemical dependency treatment Shall reside at a location and under living arrangements as approved by the CCO. Obtain permission from CCO before changing residence. Have no contact with minors Do not possess or peruse pornographic materials unless authorized Remain within or outside of geographical boundaries as specified Do not reside with anyone who is a parent/legal guardian of minor children Do not enter parks, pools, playgrounds, school yards, or other locations frequented by minors Abide by curfew rules as directed. Curfew is 9:30 PM to 6:00 AM Must consent to DOC home visits to monitor compliance with supervision. Home visits include access for the purpose of visual inspection of all areas of residence in which the offender lives or has exclusive/joint control or access Obey all laws Report to and be available for contact with assigned CCO as directed Do not purchase, own or possess any firearm, deadly weapon, ammunition or explosive Do not possess paraphernalia that can be used for the ingestion or prossessing of controlled substances Do not enter bars, taverns, lounges or other places where alcohol is the primary source of business Maintain lawful employment and provide proof of employment to DOC staff as directed.
