Probable cause affidavit: SUBMITTED BY: VIGGIANO, PAUL 0682 (AR10115027) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A WHITE BOTTLE CAP CONTAINING RESIDUE, A PACKAGE OF SYRINGES, A SMALL PLASTIC MEASURING CUP, A PIECE OF STEAL WOOL, AND A PARTIAL PIECE OF A DRIVER'S LICENSE WITH PINHOLES IN IT, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B). ON 052610 AT APPROXIMATELY 0915 HOURS, I WAS DISPATCHED TO 3360 SOUTH LECANTO HIGHWAY IN REFERENCE TO THE DEFENDANT POSSIBLY HAVING A WARRANT OUT OF PALM BEACH COUNTY. UPON ARRIVAL AT THE ABOVE LOCATION, THE COMPLAINANT WHO WISHED TO REMAIN ANONYMOUS, ADVISED THAT THE DEFENDANT, MR GORDON RIPMA, HAD JUST LEFT THE AREA IN A BLACK CHEVY IMPALA. MYSELF AND DEPUTY DALTON BOLOED THE AREA FOR THE VEHICLE. WE THEN BOTH OBSERVED A BLACK CHEVY IMPALA AT THE INTERSECTION OF 491 AND HIGHWAY 44, AT WHICH TIME, I PULLED BEHIND THE DEFENDANT ACTIVATED MY EMERGENCY EQUIPMENT AND INITIATED A TRAFFIC STOP ON THE VEHICLE. UPON MAKING CONTACT WITH THE DRIVER, THE DEFENDANT'S IDENTITY WAS VERIFIED BY HIS FLORIDA DRIVER'S LICENSE, AT WHICH TIME I ASKED THE DEFENDANT TO STEP OUT OF THE VEHICLE AND I ASKED HIM IF HE HAD ANYTHING ILLEGAL ON HIM OR IN THE VEHICLE, TO WHICH HE SAID NO AND THAT WE COULD SEARCH. I THEN CONDUCTED A PAT DOWN OF THE DEFENDANT FOR WEAPONS, WHICH YIELDED NEGATIVE RESULTS. DEPUTY DALTON CONFIRMED THE DEFENDANT'S WARRANT THROUGH THE CITRUS COUNTY TELETYPE OPERATOR. AT THAT TIME, THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE. DEPUTY DALTON THEN ADVISED ME THAT WHILE CONDUCTING A SEARCH OF THE DEFENDANT'S VEHICLE WITH THE PERMISSION OF THE DEFENDANT, HE OPENED THE GLOVE BOX ON THE PASSENGER SIDE OF THE VEHICLE AND DISCOVERED A BAGGIE CONTAINING SYRINGES. HE ALSO ADVISED HE FOUND A CONDOM CONTAINING AN UNIDENTIFIED FLUID. CONTACT WAS MADE WITH THE DEFENDANT AT WHICH TIME, WE ADVISED HIM OF HIS RIGHTS VIA AGENCY PREPRINTED CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS AND IF HE WOULD SPEAK WITH US, TO WHICH HE AGREED. I ASKED THE DEFENDANT WHAT THE SYRINGES WERE FOR. HE INITIALLY STATED THAT THEY WERE HIS COUSIN'S AND THAT SHE WAS A DIABETIC. WHILE CONDUCTING THE ORIGINAL PAT DOWN OF THE DEFENDANT, A SEARCH OF A CIGARETTE PACK REVEALED THAT PART OF A CIGARETTE FILTER WAS REMOVED FROM A CIGARETTE. THIS IS COMMONLY USED TO FILTER DRUGS PRIOR TO INJECTING THEM. I THEN QUESTIONED THE DEFENDANT ABOUT THE MISSING FILTER, TO WHICH HE ADMITTED THAT HE HAD USED COCAINE AND THAT HE HAD SHOT IT UP WITH THE SYRINGES. HE ALSO ADMITTED THAT HE USED THE FILTER OF THE CIGARETTE TO GET A "CLEAN SHOOT." THE DEFENDANT ALSO ADVISED THAT THE FLUID IN THE CONDOM WAS CLEAN URINE IN CASE HE NEEDED TO TAKE A DRUG TEST. AT THAT TIME, A THOROUGH SEARCH OF THE VEHICLE WAS COMPLETED AND SEVERAL OTHER ITEMS TO INCLUDE A WHITE BOTTLE CAP CONTAINING RESIDUE, A SMALL PLASTIC MEASURING CUP, A PIECE OF STEAL WOOL, AND A PARTIAL LICENSE WITH PINHOLES. THE RESIDUE IN THE WHITE BOTTLE CAP WAS TESTED FOR COCAINE AND TESTED POSITIVE. ALL ITEMS WERE COLLECTED AND WILL BE TURNED IN TO EVIDENCE ALONG WITH A PROPERTY RECEIPT. PRIOR TO LEAVING THE SCENE ENTERPRISE RENTAL CAR WAS CONTACTED WHO WAS THE OWNER OF THE VEHICLE. THEY SENT A REPRESENTATIVE TO PICK UP THE VEHICLE. THE DEFENDANT WAS THEN ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF DRUG PARAPHERNALIA. HE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
