Probable cause affidavit: | \tSUBMITTED BY: SUDLOW, JAMES 0759 (AR13-6009) \tdid then and there unlawfully carry a concealed weapon or electric weapon or device on or about HIS person, to-wit: BRASS KNUCKLES, In violation of Florida Statute 790.01(1); \t \tON 061013, I WAS DISPATCHED TO 6915 WEST ARLINGTON PLACE IN HOMOSASSA, IN REFERENCE TO A WELL BEING CHECK REGARDING A POSSIBLE SERIOUS INJURY. \t \tUPON ARRIVAL, I MADE CONTACT WITH THE DEFENDANTâS GIRLFRIEND, MS SARA JOHNSON AND QUESTIONED HER ABOUT HER BOYFRIEND/DEFENDANT MR GRAHAM ALEXANDER PEACE, IN REFERENCE TO HIS SERIOUS INJURY. SHE STATED THAT SHE SAW THE DEFENDANT APPROXIMATELY THREE HOURS AGO AND THAT HE APPEARED TO BE OK. \t \tAT THAT TIME, THE NEIGHBORS APPROACHED AND STATED THAT THE DEFENDANT HAD BEEN INJURED AND THEY WERE WORRIED ABOUT HIS WELL BEING, BUT THEY HAD NOT SEEN HIM IN APPROXIMATELY ONE HOUR. NO ONE KNEW WHERE THE DEFENDANT WAS OR COULD BE GOING. AT WHICH TIME WORRYING ABOUT HIS WELL BEING, I CALLED FOR ADDITIONAL DEPUTIES. \t \tA SHORT TIME LATER, K-9 DEPUTY RITLI AND DEPUTY HESSE ARRIVED ON SCENE AND STARTED TO SEARCH THE AREA ON FOOT, UTILIZING K-9 AJAX. THE DEFENDANT WAS LOCATED IN THE NEIGHBORâS BACK YARD LYING DOWN IN A TALL PATCH OF GRASS. THE DEFENDANT INJURIES WERE NOT LIFE THREATENING AND HE COULD NOT ADVISE HOW HE GOT THE INJURY. WE ASKED THE DEFENDANT WHY HE WAS HIDING IN THE GRASS AND HE STATED THAT HE THOUGHT HIS GIRLFRIEND TOLD HIM TO RUN AND HIDE WHEN SHE SAW US KNOCKING AT THEIR FRONT DOOR. HE THEN STATED THAT HE AND HIS GIRLFRIEND BOTH KNEW THAT HE HAS A WARRANT OUT OF MICHIGAN FOR HOME INVASION AND THAT IS WHY THEY THOUGHT WE WERE THERE. I ADVISED THAT THE WARRANT WAS NOT EXTRADITABLE AND WE WERE ONLY THERE BECAUSE THE COMPLAINANT CALLED IN WORRIED ABOUT HIS INJURY. \t \tDEPUTY B HESSE THEN ASKED THE DEFENDANT IF HE HAD ANYTHING ILLEGAL, SUCH AS DRUGS OR WEAPONS ON HIM, AND IF HE WOULD MIND IF HE PATTED HIM DOWN. WHILE DEPUTY B HESSE WAS PATTING HIM DOWN, HE FELT WHAT WAS IMMEDIATELY IDENTIFIABLE AS BRASS KNUCKLES IN THE DEFENDANTâS RIGHT FRONT SHORTS POCKET. WHEN HE WAS ASKED ABOUT THE BRASS KNUCKLES, HE STATED that THEY ARE BRASS KNUCKLES AND HE CARRIES THEM AROUND ALL THE TIME BECAUSE HE LIKES THEM. \t \tTHE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HIS BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING, WHERE HE WAS CHARGED WITH ONE COUNT OF CARRYING A CONCEALED WEAPON.
