Probable cause affidavit: | SUBMITTED BY: SUDLOW, JEFFREY FHP1657 (AR14-8856) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193(1), AND THE DRIVER OF ANY VEHICLE INVOLVED IN A CRASH RESULTING ONLY IN DAMAGE TO A VEHICLE OR OTHER PROPERTY DRIVEN OR ATTENDED BY ANY PERSON, SHALL IMMEDIATELY STOP SUCH VEHICLE AT THE SCENE OF SUCH CRASH OR AS CLOSE THERETO AS POSSIBLE, AND SHALL, FORTHWITH RETURN TO AND IN EVERY EVENT SHALL REMAIN AT THE SCENE OF THE CRASH UNTIL HE HAD FULFILLED THE REQUIREMENTS OF 316.061(1). ON 012614, AT 0316 HOURS, in Citrus County, Florida, the defendant did unlawfully operate a motor vehicle, a (2011,(Dodge), orange in color bearing Florida tag 1901IB in violation of Florida state statute 316.193. The defendant was involved in a crash and stopped by the Citrus County Sheriffâs office for leaving the scene and for driving the wrong way on US HIGHWAY 19. the defendant had the strong odor of an alcoholic beverage present upon his breath and had blood-shot/watery eyes, poor balance to the extent that his normal faculties were impaired. the defendant was given the opportunity to perform some field sobriety evaluations. the defendant did perform these evaluations. at the conclusion of these evaluations, HE was lawfully placed under arrest for dui. the defendant was also informed verbally that he was being placed under arrest for dui. The SFSE which were administered were as follows. The first SFSE was horizontal gaze nystagmus. The defendant had lack of smooth pursuit in both the left and right eye. The defendant also had distinct nystsagmus at maximum deviation in both the left and right eye. The defendant also had nystagmus prior to 45 degree angle in both the left and right eye. The defendant also had a difficult time following the light. The second SFSE performed by the defendant was the walk and turn evaluation. The defendant failed to walk heel to toe on all steps on both attempts. The defendant also used arms for balance. The defendant also stepped off the line on steps 7. The defendant preformed an improper turn. The defendant stumbled and stepped off the line on steps 3, 4, and 5 and stopped and regained balance. The third SFSE performed was the one leg stand. The defendant began standing on his left leg. The defendant failed to reach 3 seconds before losing balance and almost falling. The defendant asked me if he could try the other leg I said go ahead sir. The defendant attempted to stand on his right leg. The defendant failed to reach 2 seconds before losing balance and almost falling down. The defendant was given the chance to take a breath test, at which time the defendant refused.
