Probable cause affidavit: | SUBMITTED BY: HUNTER, JEFFERY 0441 (12-1083AR) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2) THE DRIVER OF ANY VEHICLE INVOLVED IN A CRASH RESULTING ONLY IN DAMAGE TO A VEHICLE OR OTHER PROPERTY DRIVEN OR ATTENDED BY ANY PERSON, SHALL IMMEDIATELY STOP SUCH VEHICLE AT THE SCENE OF SUCH CRASH OR AS CLOSE THERETO AS POSSIBLE, AND SHALL, FORTHWITH RETURN TO AND IN EVERY EVENT SHALL REMAIN AT THE SCENE OF THE CRASH UNTIL HE HAD FULFILLED THE REQUIREMENTS OF 316.061(1) ON 050912 AT 1000 HOURS I WAS DISPATCHED TO THE INCIDENT ADDRESS IN REFERENCE TO A HIT AND RUN ACCIDENT. UPON ARRIVAL I MADE CONTACT WITH THE VICTIM, MS NORMA CARR, WHO ADVISED SHE HAD BEEN DRIVING NORTHBOUND ON US HIGHWAY 41 APPROXIMATELY 300 FEET NORTH OF THE INTERSECTION OF SOUTH CASTLELAKE AVENUE . SHE ADVISED SHE OBSERVED A BLACK DODGE DURANGO DRIVING SOUTHBOUND WHERE IT THEN CROSSED THE YELLOW LINE AND ENTERED HER LANE. SHE STATED THAT A PORTION OF THE ONCOMING VEHICLE STRUCK HER DRIVERâS SIDE MIRROR AT WHICH TIME HER DRIVERâS SIDE MIRROR STRUCK THE GLASS ON HER DRIVERâS DOOR AND SHATTERED IT. SHE STATED SHE IMMEDIATELY PULLED HER VEHICLE OVER BUT THE OTHER VEHICLE HAD LEFT THE AREA HEADING SOUTHBOUND. THE WITNESS, MS JEANNE DITZLER, ADVISED THAT SHE HAD BEEN DRIVING BEHIND THE SUSPECT VEHICLE WHICH SHE DESCRIBED AS A BLACK DODGE DURANGO AND OBSERVED THE ACCIDENT. SHE ADVISED THAT SHE STOPPED TO ENSURE THERE WERE NO INJURIES AND THEN FOLLOWED THE DODGE DURANGO TO THE CIRCLE K STORE LOCATED AT GOBBLER AND US 41. MS DITZLER ADVISED SHE THEN OBSERVED A WHITE MALE SUBJECT WITH BROWN HAIR, APPROXIMATELY 6 FOOT TALL WITH A SLENDER BUILD, EXIT THE SUSPECT VEHICLE AND BEGIN CLEANING BROKEN GLASS OUT OF IT. MS DITIZLER ADVISED THAT SHE THEN CONFRONTED THE SUSPECT, LATER IDENTIFIED AS THE DEFENDANT, MR GREGORY GALLAGHER, AND ASKED HIM IF HE KNEW HE HAD STRUCK ANOTHER VEHICLE. SHE STATED THE MALE SUBJECT THEN ADVISED THAT HE NEEDED TO GO GET SOMETHING AND LEFT ON FOOT HEADING EAST BEHIND THE STORE. AT THAT TIME BEGAN A TRAFFIC ACCIDENT INVESTIGATION AND WAS ABLE TO PROVIDE THE VICTIM WITH AN EXEMPTION OF INFORMATION FORM. DURING THAT TIME TROOPER CORCORAN (ID 1626) ARRIVED ON SCENE. I ADVISED TROOPER CORCORAN THAT I WAS HANDLING THE INVESTIGATION AND PROVIDED HIM WITH THE SUSPECT INFORMATION. THE TROOPER THEN BEGAN BOLOING THE AREA FOR THE SUSPECT. A SHORT TIME LATER I LEFT THE CIRCLE K STORE AND BEGAN TRAVELING NORTH WHERE I OBSERVED TROOPER CORCORAN STOPPED ON THE EAST SIDE OF US 41 APPROXIMATELY 100 FEET SOUTH OF THE ORIGINAL ACCIDENT LOCATION. WITH TROOPER CORCORAN WAS A WHITE MALE MATCHING THE DESCRIPTION OF THE HIT AND RUN DRIVER. TROOPER CORCORAN INTERVIEWED THE SUSPECT WHO WAS PROFUSELY SWEATING AND EXTREMELY NERVOUS . THE TROOPER ASKED THE SUSPECT WHAT HE WAS DOING IN THE AREA WHERE THE SUSPECT STATED THAT HE HAD BEEN DRIVING SOUTHBOUND ON US 41 AND REACHED FOR HIS CELLULAR TELEPHONE. HE ADVISED AT THAT TIME HIS DRIVERâ S SIDE MIRROR WAS STRUCK BY SOMETHING. HE ADVISED THAT HE CONTINUED TO THE GAS STATION LOCATED APPROXIMATELY ONE MILE AWAY AT GOBBLER AND US 41 WHERE HE THEN PARKED HIS VEHICLE. HE STATED AT THAT TIME HIS âFRIENDâ WHO HAD BEEN DRIVING EXITED THE VEHICLE AND LEFT THE AREA. TROOPER CORCORAN THEN POINTED OUT THE INCONSISTENCIES IN HIS STORY AND ASKED THE SUSPECT WHAT ANY POTENTIAL SURVEILLANCE VIDEO FROM THE CIRCLE K STORE MAY REVEAL. THE SUSPECT THEN HUNG HIS HEAD, SIGHED AND ADMITTED THAT HE HAD BEEN DRIVING THE SUSPECT VEHICLE. AT THIS TIME THE WITNESS, MS DITZLER, WAS DRIVING BY, STOPPED AND POSITIVELY IDENTIFIED THE SUSPECT AS THE MALE SUBJECT SHE HAD FOLLOWED TO THE CIRCLE K STORE EARLIER. SHE PROVIDED A SWORN WRITTEN STATEMENT WHICH WAS LATER TURNED IN TO RECORDS. AT THAT TIME THE DEFENDANT, MR GREGORY GALLAGHER, WAS PLACED UNDER ARREST, HANDCUFFED BEHIND HIS BACK (DOUBLE LOCKED) AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS READ HIS MIRANDA RIGHTS AND ADVISED HE UNDERSTOOD THEM AND AGREED TO SPEAK WITH ME. HE AGAIN ADMITTED TO DRIVING THE SUSPECT VEHICLE AND DRIVING WITH A SUSPENDED DRIVERâS LICENSE. THE DEFENDANT STATED HE PANICKED AND HAD FLED THE AREA ON FOOT. HE WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION 7079 WLQ (9) FOR OPERATING A MOTOR VEHICLE WITH NO VALID DRIVERâS LICENSE AND 7080 WLQ (2) FOR LEAVING THE SCENE OF AN ACCIDENT WITH MORE THAN $50.00 IN PROPERTY DAMAGE WITH BOTH CITATIONS HAVING A MANDATORY COURT DATE OF 052412 AT 1300 HOURS. THE DEFENDANTâS BOND WAS SET AT $750.00 PER THE BOND SCHEDULE. |
