SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR13-4224) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 012313, I WAS RUNNING STATIONARY RADAR IN THE AREA OF WEST GROVER CLEVELAND BOULEVARD AND SPRING SONG TERRACE. MY VEHICLE WAS PLACING IN A EASTERLY DIRECTION, WHEN I NOTICED A SINGLE SET OF HEADLIGHTS APPROACHING ME AT A HIGH RATE OF SPEED, WHICH I ESTIMATED TO BE TRAVELING AT 85 MILES PER HOUR (MPH). I THEN ACTIVATED MY DECATUR FRONT STATIONARY RADAR ANTENNA, AND RECEIVED A CLEAR AUDIO DOPPLER TONE AND DISPLAYED VISUAL RADAR READING OF 83 MPH. AS THE VEHICLE WENT BY MY LOCATION, I TURNED ON MY OVERHEAD EMERGENCY LIGHTS AND ACTIVATED MY SIREN, MAKING A U-TURN DUE TO THE FACT THAT THE VEHICLE WAS DRIVING IN A WESTERLY BOUND DIRECTION, OPPOSITE THE DIRECTION I HAD BEEN FACING. AT THAT POINT, I DID NOT SEE ANY BRAKE LIGHTS ON THE VEHICLE, AND ACCELERATED TO CATCH UP. AS I CAUGHT UP TO THE VEHICLE, IT MADE AN ABRUPT RIGHT HAND TURN ON SOUTH SANDPIPER TERRACE, AND THEN MADE AN IMMEDIATE RIGHT HAND TURN ON WEST PELICAN LANE. THE VEHICLE FINALLY CAME TO A STOP IN FRONT OF 6643 WEST PELICAN LANE. THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR GREGORY KIPP MOWAT, II, THEN BEGAN TO STEP OUT OF THE VEHICLE. I THEN DREW MY AGENCY ISSUED WEAPON, AND PLACED IT AT A LOW READY POSITION, AND ORDERED THE DRIVER OF THE VEHICLE BACK TO ME. THE DEFENDANT WAS THEN ORDERED TO HIS KNEES, AND I THEN HANDCUFFED AND DOUBLE LOCKED THE DEFENDANT IN FRONT OF MY VEHICLE. DEPUTY TAYLOR (0700) THEN ARRIVED ON SCENE, AND STOOD BY WITH THE DEFENDANT. THE DEFENDANT WAS THEN RUN THROUGH TELETYPE, WHICH REVEALED THAT THE DEFENDANTâS DRIVER'S LICENSE HAD BEEN SUSPENDED ON 101210, FOR FAILURE TO PAY TRAFFIC FINES, WHICH WAS A D6 SUSPENSION. THE DEFENDANTâS DRIVER'S LICENSE HAD ALSO BEEN SUSPENDED ON 062111, FOR FAILURE TO PAY COURT FINANCIAL OBLIGATION. THE DEFENDANT SPONTANEOUSLY STATED, âI RAN BECAUSE YOU KNOW I DONâT HAVE A DRIVER'S LICENSE.â THE DEFENDANT ALSO SPONTANEOUSLY STATED THAT HE WAS GOING TO âBAILâ OUT OF THE VEHICLE, UNTIL HE HAD HEARD MY CANINE IN MY PATROL VEHICLE BARKING. DEPUTY TAYLOR THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, HE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ON EAST COUNT OF DRIVING WHILE LICENSE SUSPENDED REVOKED, OR CANCELLED, KNOWINGLY, WITH A $500.00 BOND SET, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED TWO FLORIDA UNIFORM TRAFFIC CITATIONS. THE FIRST BEARING CITATION NUMBER 8589GQF6, FOR UNLAWFUL SPEED OF 83 MPH IN A 55 MPH ZONE, AND A $281.00 FINE, PAYABLE IN THIRTY DAYS AT THE CITRUS COUNTY COURTHOUSE. THE SECOND CITATION, BEARING, NUMBER 8590GQFX, FOR DRIVING WHILE LICENSE SUSPENDED, REVOKED OR CANCELLED (KNOWINGLY), WITH A MANDATORY COURT DATE OF 021413 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. |
