SUBMITTED BY: BERGEN, JOHN 0519 (AR09107231) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF TWENTY GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B) AND DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, OBJECTS INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, SAID OBJECTS BEING MARIJUANA PIPES, A GRINDER, A ROLLING MACHINE, TWO PACKS OF SCREEN AND THREE ROLLING TRAYS, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1). ON 011709 WHILE WORKING TRAFFIC ON US HIGHWAY 41 IN THE AREA OF CITRUS SPRINGS, I OBSERVED A WHITE DODGE PICKUP TRUCK HEADING SOUTHBOUND ON US HIGHWAY 41, AT WHICH TIME I OBSERVED THAT THE TAG LIGHT ON THE VEHICLE WAS INOPERABLE. I INITIATED A TRAFFIC STOP ON THE VEHICLE IN THE AREA OF US HIGHWAY 41 AND THE WITHLACOOCHEE TRAIL. I MADE CONTACT WITHY THE DRIVER/DEFENDANT, MR GREGORY REVELS, AND EXPLAINED THE REASON FOR THE TRAFFIC STOP. I REQUESTED HIS DRIVER'S LICENSE, THE VEHICLE REGISTRATION AND PROOF OF INSURANCE, WHICH HE DID PROVIDE. I HAD THE DRIVER/DEFENDANT EXIT HIS VEHICLE AND OBSERVE HIS TAG LIGHT, AT WHICH TIME THE DRIVER/DEFENDANT DID ACKNOWLEDGE THAT BOTH TAG LIGHTS WERE IN DEED INOPERABLE. I RETURNED HIS DOCUMENTS AND ADVISED THE DRIVER/DEFENDANT THAT I WAS ONLY GIVING HIM A VERBAL WARNING FOR THE INOPERABLE TAG LIGHT AND ADVISED HIM TO GET IT FIXED. I ASKED THE DEFENDANT IF THERE WAS ANY CONTRABAND IN HIS VEHICLE, AT WHICH TIME HE WALKED BACK TOWARD HIS DRIVER SIDE DOOR, OPENED THE DRIVER SIDE DOOR AND STOOD THERE. I THEN OBSERVED IN THE HANDLE CUT-OUT ON THE INSIDE OF THE DRIVER SIDE DOOR A METAL PIPE, KNOWN AS A BOWL, USED FOR SMOKING MARIJUANA. I ADVISED THE DEFENDANT TO STEP BACK TO THE REAR OF HIS TRUCK WITH ME AND I PLACED HIM UNDER ARREST. I SEARCHED HIS PERSON AND LOCATED IN HIS INSIDE JACKET POCKET A CLEAR PLASTIC BAGGIE CONTAINING A GREEN LEAFY SUBSTANCE KNOWN TO ME THROUGH MY TRAINING AND EXPERIENCE AS MARIJUANA. I SEARCHED THE REST OF THE VEHICLE AND LOCATED IN THE CENTER CONSOLE ANOTHER METAL PIPE, ONE GRINDER, ONE ROLLING MACHINE, TWO PACKS OF SCREENS AND THREE ROLLING TRAYS, ALL OF WHICH ARE ITEMS OF DRUG PARAPHERNALIA. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF A PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. PRIOR TO LEAVING THE SCENE, THE TRUCK THE DEFENDANT HAD BEEN DRIVING WAS TURNED OVER TO HIS WIFE WHO WAS THE FRONT SEAT PASSENGER. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT'S BOND WAS SET AT A TOTAL OF $1,000.00, PER THE BOND SCHEDULE. WHILE AT THE DETENTION FACILITY, THE MARIJUANA WAS WEIGHED AND WEIGHED APPROXIMATELY TEN GRAMS. THE MARIJUANA AND ALL PARAPHERNALIA WAS PACKAGED AND LATER TURNED IN TO CCSO EVIDENCE. *NOT-EXEMPT* |
