Probable cause affidavit: | SUBMITTED BY: SMOLENSKY, STEVE 0142 (AR08104953) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2). ON 083008 AT APPROXIMATELY 0955 HOURS, WHILE OBSERVING TRAFFIC ENTER THE CITRUS COUNTY LAND FILL CHECKING FOR UNSECURED LOADS, I OBSERVED A 1994 FORD TAURUS DRIVE IN FROM STATE ROAD 44. THE VEHICLE HAD LARGE BRANCHES STICKING OUT OF THE TRUNK AREA, WITH THE TRUNK OPEN AND NO APPARENT MEANS OF SECURING THE LOAD. I INITIATED A TRAFFIC STOP INSIDE THE LANDFILL AND MADE CONTACT with THE DEFENDANT, MR GUIDO RUDGE. I ASKED THE DEFENDANT FOR HIS DRIVER'S LICENSE and REGISTRATION, WHICH THE DEFENDANT PROVIDED. THE DRIVER'S LICENSE CHECK SHOWED the DEFENDANT'S DRIVING PRIVILEGES HAD BEEN SUSPENDED INDEFINITELY ON 021908, REFERENCE SUPPORT DELINQUENCY (NOTICE REQUIRED) and AGAIN ON 032608, FOR FAILURE TO PAY TRAFFIC FINES (NOTICE REQUIRED). THE DRIVER'S LICENSE HISTORY ALSO SHOWED THE DEFENDANT HAD BEEN ISSUED A FLORIDA IDENTIFICATION CARD ON 082808. I ASKED THE DEFENDANT IF HE KNEW HIS DRIVER'S LICENSE WAS SUSPENDED AND HE ADVISED NO, THAT HE KNEW HE HAD NOT PAID A SEATBELT TICKET, BUT STATED HE HAD CALLED CAPITAL ONE IN ILLINOIS AND GOTTEN IT STRAIGHTENED OUT TO PAY THE FINE IN PAYMENTS. I ADVISED THE DEFENDANT CAPITAL ONE IN ILLINOIS HAD nothing TO DO WITH THE FLORIDA DEPARTMENT OF HIGHWAY, SAFETY AND MOTOR VEHICLES (DHSMV) AND THAT THE TICKET HAD NOT BEEN PAID. WHEN I ASKED HIM ABOUT OBTAINING AN IDENTIFICATION CARD JUST A FEW DAYS PRIOR, THE DEFENDANT ADVISED IT WAS because HE LOST HIS DRIVER'S LICENSE. WHEN I ASKED WHEN HE LOST HIS DRIVER'S LICENSE, WHY HE DID NOT GET ANOTHER ONE INSTEAD OF AN IDENTIFICATION CARD, HE HAD NO ANSWER. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DWLS/R KNOWINGLY IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2) WITH HIS BOND SET AT $500.00 PER THE BOND SCHEDULE, THE DEFENDANT'S VEHICLE WAS LEFT INSIDE the LANDFILL PER THE OWNER'S REQUEST WITH THE VEHICLE UNSECURED AND THE WINDOWS OPEN. ALSO AT THE DEFENDANT REQUEST, the DEFENDANT'S WIFE WAS CONTACTED VIA DISPATCH WHO ADVISED SHE would GET ANOTHER DRIVER AND RESPOND TO THE LANDFILL TO PICK UP THE VEHICLE. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 8368-FEW REFERENCE DWLS/R WITH A MANDATORY COURT DATE OF 091808 AT 1300 HOURS. THE DEFENDANT WAS ALSO ISSUED WRITTEN WARNING REFERENCE WARNING NUMBER 223280B, FOR UNSECURED LOAD. WHILE EN ROUTE TO THE CITRUS COUNTY DETENTION FACILITY, THE DEFENDANT BECAME AGGRAVATED ASKING WHY I could NOT HAVE GIVEN HIM A BREAK. I ADVISED the DEFENDANT IT WAS BECAUSE HE HAD LIED TO THIS DEPUTY AND TRIED TO CONVINCE ME HIS DRIVER'S LICENSE WAS NOT SUSPENDED. THE DEFENDANT ADVISED, "FINE I KNEW MY LICENSE WAS SUSPENDED, BUT YOU STILL SHOULD HAVE GIVEN ME A BREAK.” NO FURTHER ACTION TAKEN. *NOT-EXEMPT* |
