DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). on 111412 the citrus county sheriff's office tactical impact and vice narcotic unit, with assistance of the citrus county sheriff's office swat team, performed a search warrant investigation which was conducted in citrus county located at 1582 north wintergreen terrace, crystal river, citrus county florida. Your affiant previously conducted an investigation and developed a search warrant affidavit, which was reviewed and signed by the honorable judge sandy kautz for the aforementioned residence. On 111412, members of the citrus county sheriff's office swat team and tactical impact unit responded to the residence located at 1582 north wintergreen terrace, crystal river, citrus county, at approximately 0657 hours. Upon our arrival, the swat team approached the residence, announced their presence and received no RESPONSE at the front door. Shortly THEREAFTER the front door was breeched. Once entry was made into the home, the defendant, MR GUY ANTHONY JOBE, was located in the master bedroom of the residence in addition to a white female. also, located within the home were three juvenile children. the defendant was taken into custody and was seated in LIVING ROOM area (in ADDITION to the OTHER occupants WHO WERE LOCATED IN THE HOME) of the residence. Your affiant read the search warrant in its entirety to the defendant to which he advised that he understood and in addition was read miranda rights via preprinted agency issued card. After reading the defendant miranda, the defendant advised that he understood his rights and understood why we were at his residence, and would agree to speak with us should we have any questions. The defendant was explained that as part of the parameters of the search warrant, members of the tactical impact/vice narcotics unit would be conducting a search of his residence, to which he advised that he understood. prior to conducting a search of the home, the juveniles were released to the care of a FAMILY member, and both the defendant and female were brought to the back porch of the residence. a search of the residence commenced, at which time, the defendant indicated to deputy holloway that there were items of contraband located with in the cabinet above the washing machine. at this time, i responded over to the aforementioned described area and located a plastic cup with a small amount of cocaine, a spoon with cocaine residue, a silver scale and a box of plastic baggies. the small amount of cocaine in the plastic cup in addition to the residue located on the metal spoon was field tested by deputy reeves, resulting with a positive test for the presence of cocaine. a further search of the defendant’s residence revealed TWO TAURUS 410 shotguns located IN one of the bedrooms of the residence. prior to the execution of this search warrant, the defendant’s criminal history was checked revealing a previous felony conviction. ADDITIONALLY, contact was made with the executive clemency board and spoke with operator sarah, who indicated to me that the defendants civil rights were restored in 2008; however the defendant’s right to bear arms has not been restored. upon asking the defendant about the two firearms, he stated to me that the firearms belong to his children for hunting. the defendant further stated that the firearms are normally located at their grandfather’s residence and that the children just recently interacted with the FIREARMS and brought them to their home. All items of evidentiary value were collected, packaged in accordance with agency policy, and turned into the to citrus county sheriff’s office evidence locker by deputy reeves. The defendant was HANDCUFFED (DOUBLE LOCKED) AND transported TO THE CITRUS COUNTY DETENTION FACILITY BY deputy reeves and your affiant. THE DEFENDANT’S BOND WAS SET AT $15,000.00, PER THE bond schedule. \t\t
