| Probable cause affidavit: | SUBMITTED BY: BLAIR, EDWARD 0469 (AR07004170) did unlawfully endanger the safety of another or their property while intoxicated or did while intoxicated or drinking alcoholic beverages in a public place cause a public disturbance, in violation of Florida Statute 856.011. ON 072907 AT 0001 hours, I WAS DISPATCHED TO APPLEBEE'S RESTAURANT LOCATED AT 1901 WEST MAIN STREET, INVERNESS IN REFERENCE TO A VERBAL ALTERCATION IN PROGRESS. UPON ARRIVAL, I OBSERVED SEVERAL INDIVIDUALS IN THE PARKING LOT OF THE restaurant. I OBSERVED SEVERAL INDIVIDUALS POINTING toward the DEFENDANT, later identified as mr hans anthony duncan, and STATING, "THAT'S HIM." AS I EXITED MY PATROL VEHICLE, I OBSERVED THE DEFENDANT YELLING AT SEVERAL SUBJECTS IN THE PARKING LOT. CONTACT WAS MADE WITH THE COMPLAINANT WHO ADVISED THAT THE DEFENDANT HAD BEEN A PATRON AT THE RESTAURANT this evening. SHE ADVISED THAT SHE OBSERVED THE DEFENDANT BECOME BELLIGERENT, at which time, he began throwing glasses and dishes while seated at his table. she stated that the DEFENDANT was asked to leave the restaurant; however, he continued to be belligerent and made threats toward her. the complainant advised that other patrons were able to persuade the defendant to leave the restaurant. THE COMPLAINANT REQUESTED TO HAVE THE DEFENDANT TRESPASSED FROM the RESTAURANT. this deputy then made contact with the defendant in the parking lot. as i APPROACHED the defendant, he appeared to be intoxicated with blood shot and watery eyes and slurred speech. this deputy also detected a strong odor of an ALCOHOLIC BEVERAGE EMITTING from his PERSON. while attempting to gather the defendant's personal INFORMATION to complete a trespass warning, he stated that he had no IDENTIFICATION and became belligerent with this deputy. at that time, the defendant APPROACHED this deputy in an aggressive manner. the defendant then turned around, placed his hands behind his back, stated "take me to jail" and fell backwards against this deputy. the DEFENDANT continued to be belligerent; therefore, he was secured in handcuffs (double-locked) behind his back and advised that he was being PLACED under arrest for disorderly intoxication. the defendant was escorted to my patrol vehicle and secured in the rear seat, at which time, he was transported to the citrus county DETENTION FACILITY for booking and processing. the DEFENDANT'S bond was set at $150.00 per the bond schedule. CONTACT WAS MADE WITH OPERATOR 0394 WHO ENTERED THE TRESPASS WARNING AGAINST THE DEFENDANT IN THE TRESPASS LOG AT THE EMERGENCY OPERATIONS CENTER. *NOT-EXEMPT* |
