Probable cause affidavit: |
The defendant did unlawfully take the money from the person of another, with the intent to deprive the other person of the money, and in the course of the taking did use force, violence, assault or putting in fear; to wit: On 05/16/14, I responded to 3924 S. Florida Ave, in reference to a robbery just occurred. Upon arrival, I was briefed on the incident. I then conducted taped interviews with the three victims. They gave consistent statements that a male wearing a black hoodie, with the word ARMY in yellow on the chest. He had a black mask, was wearing dark gloves and was carrying a black and silver handgun and what appeared to be a rubber mallet. One victim stated he believed that the suspect sold him some silverware on Thursday. This was based on the victim stating he recognized how the victim spoke and his mannerisms. The male fled east across the highway, onto the Rails to Trails, then north towards Inverness. A K9 search located the black hoodie approximately 100 yards north of where the male crossed the highway. A search of the area revealed the suspectâs parentâs truck parked at the Speedway (approximately 300 yards north). An independent witness stated she observed a red Ford Ranger make a u-turn near Trikes by Tony (which is north of the Speedway) and a white male, who was shirtless but wearing jeans, run to the truck. The truck appeared to not stop while the male was jumping into the truck. The defendantâs brother owns a red Ford Ranger. The defendant, his brother and his brotherâs truck were located at a residence in Floral City. Upon my arrival, the defendant was being detained in Dep. Schafferâs patrol vehicle. The defendant was read Miranda from an agency issued card. While he admitted to being picked up in the area of Trikes by Tony, he denied any involvement. I spoke to the defendantâs brother who stated that he had last seen his brother, at approximately 11:00-11:30, at their residence. Their parentsâ truck was there, as well. When he returned home, the defendant and the truck were gone. A short while later, he received a phone call from the defendant. The defendant asked him to pick him and take him home, which he did. He stated that he drove north on 41, made a u-turn at Trikes by Tony, drove south and then made another u-turn and then picked up the defendant near Trikes by Tony. He stated the defendant told him this morning, that everything would be alright. This made him believe the defendant was going to do something bad, perhaps rob a drug dealer. Dep. Schaeffer transported the defendant to the jail, where a taped statement was obtained. The defendant admitted to committing the robbery and provided details consistent with the victims. His bond was set at $20,000, per the schedule. |
