Probable cause affidavit: SUBMITTED BY: BONURA, MATTHEW 0334 (AR10117469) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, MR JAMES SWEENBURG, TO WIT: A METAL PIPE , SAID PROPERTY BEING OF A VALUE OF $10.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(3)(a). ON 101910 AT APPROXIMATELY 0930 HOURS I WAS DISPATCHED TO THE AREA OF 5586 WEST MEADOW STREET, IN HOMOSASSA, IN REFERENCE TO A REPORT OF A PETIT THEFT THAT HAD JUST OCCURRED. WHILE EN ROUTE TO THE SCENE DISPATCHED ADVISED ME THAT THE SUSPECT, MR HAROLD BOWMAN, HAD JUST STOLEN A METAL PIPE FROM THE VICTIM, MR JAMES SWEENBURG'S, PROPERTY AND HAD FLED THE SCENE IN A WHITE DODGE VAN WITH A HANDICAP STICKER HANGING FROM THE WINDSHIELD AND A HANDICAPPED WHEELCHAIR LIFT ON REAR OF THIS VEHICLE. WHILE TRAVELLING SOUTHBOUND ON HIGHWAY 19 I OBSERVED THE WHITE DODGE PASS ME TRAVELING NORTH ON HIGHWAY 19. I THEN TURNED ON SAID VEHICLE AND CONDUCTED A TRAFFIC STOP AT HIGHWAY 19 AND YULEE DRIVE. I MADE CONTACT WITH THE DRIVER/DEFENDANT WHO IMMEDIATELY ASKED ME WHY I WAS STOPPING HIM. I INFORMED THE DRIVER/DEFENDANT THAT HE KNEW WHY I WAS STOPPING HIM AND THAT THE METAL PIPE THAT WAS STOLEN WAS LYING IN PLANE VIEW THAT I COULD CLEARLY SEE THROUGH THE VAN WINDOW. I THEN ASKED THE DRIVER/DEFENDANT, IDENTIFIED AS MR HAROLD BOWMAN, TO STEP OUT OF THE VEHICLE AND WALK BACK TO THE FRONT OF MY PATROL VEHICLE. IT SHOULD BE NOTED THAT ON 101810 I TOOK AN AGGRAVATED ASSAULT REPORT INVOLVING THE SAME SITUATION WHERE A SUSPECT IN THIS CASE HAD STOLEN THE SAME EXACT POLE PULLING IT OUT OF THE GROUND AND PLACED IT UP AGAINST THE VICTIM'S FENCE WHICH WAS IN HIS VAN ON 101910. SEE CASE NUMBER 10100726. I THEN PLACED THE SUSPECT IN HANDCUFFS BEHIND HIS BACK AND SECURED HIM IN MY PATROL VEHICLE. THE SUSPECT THEN STATED HE WAS REALLY STUPID AND WOULD LIKE TO APOLOGIZE TO THE VICTIM FOR STEALING HIS PIPE AGAIN. THE DEFENDANT STATED THAT HE ONLY STOLE THE PIPE BECAUSE HE FEELS THAT the PIPE WAS NOT PLACED ON THE VICTIM'S PROPERTY. THE VICTIM IS USING THE PIPES PLACED ALONG HIS PROPERTY LINE SO THAT THE NEIGHBORS THAT TRAVEL THE ROAD DIRECTLY ALONG HIS RESIDENCE DO NOT DRIVE IN HIS YARD. AT THAT TIME DEPUTY PERUCHE RETRIEVED THE METAL PIPE AND RETURNED IT TO THE VICTIM. I THEN TELEPHONED THE VICTIM WHO ADVISED THAT AFTER YESTERDAY HE REPLACED THE PIPE BY PLACING IT BACK INTO THE GROUND AND OBSERVED THE DEFENDANT STEALING IT AGAIN TODAY AND THAT IS WHY HE TELEPHONED 911. I ASKED THE VICTIM IF HE WANTED TO PRESS CHARGES AGAINST THE DEFENDANT TO WHICH HE STATED HE DID. THE VICTIM ESTIMATED THE VALUE OF THE POLE TO BE APPROXIMATELY $10.00. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. WHILE EN ROUTE THE DEFENDANT WAS VERY APOLOGETIC AND STATED TO ME THAT "THIS IS NOT HIS NORMAL" M O" AND THAT HE SHOULD HAVE BROKEN THE PIPE OVER THE VICTIM'S FUCKING HEAD". UPON ARRIVAL TO THE CITRUS COUNTY DETENTION FACILITY THE DEFENDANT WAS CHARGED WITH ONE COUNT OF PETIT THEFT. ALSO I CONTACTED MR JEFF SMITH WITH THE STATE ATTORNEY'S OFFICE IN REFERENCE TO THIS CASE AND CASE NUMBER 10100726. MR SMITH ADVISED AT THIS TIME JUST CHARGE THE DEFENDANT WITH PETIT THEFT DUE TO THE FACT THAT THE DEFENDANT WAS CAUGHT IN THE ACT AND HAD THE PIPE IN HIS POSSESSION AND THEY WOULD REVIEW THE AGGRAVATED ASSAULT CASE. THE DEFENDANT WAS GIVEN A BOND OF $500.00 ACCORDING TO THE BOND SCHEDULE.
