SUBMITTED BY: SKINNER, RODNEY 0563 (AR12-544)âââââ DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: PUNCHED THE VICTIM IN THE FACE WITH CLOSED FISTS AND ALSO PUSHED THE VICTIM IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 033112 AT APPROXIMATELY 1535 HOURS, I WAS DISPATCHED TO THE SLEEPY HOLLOW BAR LOCATED AT 10333 EAST GOBBLER DRIVE IN FLORAL CITY IN REFERENCE TO A PHYSICAL DISTURBANCE IN-PROGRESS. WHILE EN ROUTE DISPATCH ADVISED THAT THE SUSPECT, MR HAROLD BUCK, HAD LEFT THE BAR VIA WATERCRAFT ON THE CANAL BEHIND THE BUSINESS. UPON ARRIVAL, I MADE CONTACT WITH THE VICTIM, MR NATHAN WEATHERLY, WHO IS THE COOK AT THE SLEEPY HOLLOW BAR. DUE TO THE LARGE CROWD AND LOUD MUSIC I WAS UNABLE TO TALK WITH MR WEATHERLY, THOUGH I HAD HIM WALK TO MY PATROL VEHICLE AND GIVE ME A STATEMENT ON WHAT HAD OCCURRED. THE VICTIM STATED THAT WHILE HE WAS IN THE KITCHEN, HE OBSERVED A FEMALE FRIEND OF HIS, SO HE WHISTLED AT HER AND ADVISED THAT HE WAS JUST KIDDING WITH HER. THE SUSPECT MR HAROLD BUCK, WHO THE VICTIM IS ACQUAINTED WITH, HAD GONE INTO THE KITCHEN AND BEGAN YELLING AT THE VICTIM FOR NO APPARENT REASON. THE VICTIM STATED TO HIS KNOWLEDGE HIS FEMALE FRIEND WAS NOT WITH THE SUSPECT; HOWEVER, THERE WAS ANOTHER FEMALE SUBJECT WITH THE SUSPECT THAT HE DOES NOT KNOW. THE VICTIM STATED HE THOUGHT THAT THE SUSPECT MISTAKENLY THOUGHT THE VICTIM WHISTLED AT HIS GIRLFRIEND. THE VICTIM STATED THAT THE SUSPECT STARTED SWINGING PUNCHES USING BOTH FISTS AND STRUCK HIM ON BOTH SIDES OF HIS FACE. THE VICTIM BELIEVED MR BUCK WAS INTOXICATED AND APPEARED THAT HE WAS POSSIBLY ON DRUGS AND ALCOHOL. WHEN THE SUSPECT LEARNED THAT LAW ENFORCEMENT HAD BEEN NOTIFIED, HE LEFT WITH A FEMALE SUBJECT WHO WAS POSSIBLY, MS JENNIFER WINNER, ON A GANOE USING THE CANAL. THE VICTIM STATED THAT THE SUSPECT HEADED TOWARDS HIS RESIDENCE, WHICH IS A SHORT DISTANCE FROM THE BAR. THE VICTIM STATED THAT HE WANTED TO PRESS CHARGES AND PROVIDED A BRIEF SWORN WRITTEN STATEMENT. I DID NOT OBSERVE ANY MARKS, REDNESS OR BRUISING ON THE VICTIMâS FACE AT THIS TIME. THE VICTIM ADVISED THAT HE DID NOT NEED EMERGENCY MEDICAL SERVICES (EMS). CONTACT WAS MADE WITH WITNESS, MS MARCI MARO, WHO IS A FOOD SERVER AT THE BAR. MS MAROâS STATEMENT CORROBORATED THE VICTIMâS STATEMENT. MS MARO ADDED THAT DURING THE ALTERCATION, SHE ASKED THE SUSPECTâS FEMALE FRIEND JENNIFER TO PLEASE TAKE THE SUSPECT HOME AND THAT THERE WERE CHILDREN PRESENT IN THE BUSINESS. MS MARO ADVISED THAT JENNIFER THEN APPROACHED HER WILDLY AND STARTED SCREAMING AT HER AND THEN SHOVED HER. MS MARO ASKED HER NOT TO TOUCH HER AGAIN. MS MARO STATED THAT JENNIFER THEN SHOVED HER A SECOND TIME AND SHE SWUNG AT JENNIFER IN SELF DEFENSE; BECAUSE SHE FELT THREATENED. MS MARO PROVIDED A SWORN WRITTEN STATEMENT. SHE ALSO ADVISED THAT SHE DID NOT NEED EMERGENCY MEDICAL SERVICES (EMS). I COULD NOT LOCATE ANY FURTHER WITNESSES WHO were willing to COME FORWARD; ALTHOUGH, THE BAR WAS VERY CROWDED AND THERE WERE MOST LIKELY SEVERAL OTHER PERSONS WHO HAD WITNESSED THE ALTERCATION. WHILE STILL AT THE SCENE, I OBSERVED THE SUSPECT, MR HAROLD BUCK, WHO THIS DEPUTY HAS HAD SEVERAL PREVIOUS CONTACTS WITH TRAVELING ON THE CANAL IN THE GANOE AND HEADED BACK TOWARDS THE SLEEPY HOLLOW BAR. I ALSO OBSERVED A FEMALE SUBJECT IN THE GANOE WITH HIM. MR BUCK MADE A LEFT TURN INTO ANOTHER CANAL THAT HEADS TOWARDS THE BRIDGE ON SOUTH WITHLAPOPKA DRIVE. I QUICKLY DROVE TOWARDS THE BRIDGE IN AN ATTEMPT TO MAKE CONTACT WITH THE SUSPECT. I WAITED SEVERAL MINUTES FOR THE SUSPECT TO ARRIVE AT THE BRIDGE, BUT HE APPARENTLY DID NOT COME THAT FAR. OTHER DEPUTIES AND I ATTEMPTED TO MAKE CONTACT WITH THE SUSPECT AT HIS RESIDENCE ON GOBBLER DRIVE, WHICH MET WITH NEGATIVE RESULTS. SEVERAL OTHER PERSONS AT THE BAR WHO KNOW THE SUSPECT, WHO DID NOT WANT TO BE IDENTIFIED, ADVISED THAT MR BUCK WAS HIGH ON METHAMPHETAMINE AND IS A KNOWN METHAMPHETAMINE USER, WHICH THIS DEPUTY IS ALREADY FAMILIAR WITH. THE SWORN STATEMENTS WERE LATER TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) RECORDS DIVISION. THE VICTIM AND WITNESS WERE PROVIDED AGENCY CASE CARDS BEARING THIS CASE NUMBER AND MY INFORMATION AND ADVISED IF THEY OBTAINED ANY FURTHER INFORMATION TO CONTACT THIS AGENCY. THE VICTIM WAS ADVISED TO CONTACT THIS DEPUTY IF HIS FACE STARTED REVEAL BRUISING SO THAT PHOTOGRAPHS COULD BE TAKEN. ON 040112 AT APPROXIMATELY 1005 HOURS, CONTACT WAS MADE WITH THE SUSPECT/DEFENDANT, MR HAROLD BUCK, AT HIS RESIDENCE LOCATED AT 10484 EAST GOBBLER DRIVE IN FLORAL CITY. THE DEFENDANT WAS PLACED UNDER ARREST FOR ONE COUNT OF SIMPLE BATTERY, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK. THE DEFENDANT WAS THEN READ HIS MIRANDA WARNINGS VIA A PRE-PRINTED AGENCY CARD. THE DEFENDANT ADVISED THAT HE UNDERSTOOD HIS RIGHTS AND AGREED TO SPEAK WITH ME IN REFERENCE TO THE INCIDENT THAT HAD OCCURRED AT THE SLEEPY HOLLOW BAR. THE DEFENDANT STATED THAT HE AND MS JENNIFER WINNER HAD GONE INTO THE BAR TO ORDER FOOD. THE DEFENDANT ALLEGED THAT THE VICTIM/COOK, MR NATHAN WEATHERLY, WHISTLED AT HIS GIRLFRIEND TWICE AND HE CONFRONTED THE VICTIM ABOUT THE WHISTLING. THE DEFENDANT STATED THAT A PHYSICAL FIGHT OCCURRED. THE DEFENDANT MAINTAINS THAT THE VICTIM HAD PUNCHED HIM AND HE THEN PUSHED THE VICTIM. THE DEFENDANT DENIED EVER PUNCHING THE VICTIM. THE DEFENDANT ADVISED THAT HE SUSTAINED A BLACK EYE FROM THE VICTIM. THIS DEPUTY DID OBSERVE SOME BRUISING NEAR HIS RIGHT EYE. THE DEFENDANT WAS THEN SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING. UPON ARRIVAL HE WAS TURNED OVER TO THE DETENTION STAFF. THE DEFENDANTâS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. WHILE AT THE DETENTION FACILITY, THE DEFENDANT PROVIDED A SWORN WRITTEN STATEMENT WHICH WAS FORWARDED TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) RECORDS DIVISION. the DEFENDANT admitted that he had been involved in a altercation prior to this incident and another altercation after this incident. the SUBJECTs that were involved advised that those altercations had been physical, which dispute was the DEFENDANT was advising. |
