Probable cause affidavit: SUBMITTED BY: HOLLOWAY, WILLIAM 0463 (AR12-2855) Any person who knowingly gives false verification of ownership or who gives a false or altered identification and who receives money or other consideration from a secondary metals recycler, in return for regulated metals, AND THE value of the money or other consideration received is less than $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 538.23(3)(A). ON 7-13-2012(2012-00125008) THE CITRUS COUNTY SHERIFF'S OFFICE CONDUCTED COMPLIANCE CHECKS ON LOCAL SCRAP YARDS BY SENDING IN UNDERCOVER DEPUTIES TO VARIOUS SCRAP YARDS THROUGHOUT THE COUNTY. DURING THE OPERATION AN UNDERCOVER DEPUTY WOULD ENTER THE BUSINESS WITH REGULATED AIR CONDITION PARTS THAT REQUIRES PROOF OF OWNERSHIP AS WELL AS IDENTIFICATION FROM THE SUBJECT SELLING THE ITEMS. THE FIRST ATTEMPT THAT WAS MADE WAS AT CRYSTAL RIVER METAL RECYCLING LOCATED AT 750 NORTH ENTERPRISE AVENUE IN LECANTO FLORIDA. UPON ARRIVAL, THE UNDERCOVER DEPUTY ADVISED THE DEFENDANT, MR HARRY DALBOW, THAT HE DIDN'T HAVE AN IDENTIFICATION AND NO PROOF OF OWNERSHIP OF THE AIR CONDITIONING PARTS HE WANTED TO SELL. AT THAT TIME, THE DEFENDANT PAID THE DEPUTY $40.00 CASH FROM HIS WALLET. IT IS BELIEVED THAT AFTER THIS THE DEFENDANT THEN SOLD THE ITEMS TO THE BUSINESS EITHER THROUGH IS NAME OR THE NAME OF AN AUTHORIZED SELLER OF AIR CONDITIONING PARTS. THE SECOND ATTEMPT WAS MADE ON 7-19-2012 (2012-164012) AT THAT TIME, AGAIN THE DEFENDANT REMOVED $60.00 FROM HIS WALLET AND PAID THE UNDERCOVER DEPUTY. BUT HE ALSO PURCHASED SEVERAL PIECES OF COPPER WIRE THROUGH THE BUSINESS. DURING THIS TRANSACTION HE MADE THE PURCHASE USING ANOTHER CUSTOMER’S NAME WHO WAS ON FILE. THE DEFENDANT ADVISED THE DEPUTY TO JUST SIGN THE OTHER PERSONS NAME. THIS RESULTED IN ONE COUNT OF FALSE INFORMATION TO A SECOND HAND METAL RECYCLER. ON 09-13-2012 AN UNDERCOVER DEPUTY AGAIN WAS SENT TO THE ABOVE BUSINESS WITH AN AIR CONDITIONING COIL THAT THE DEPUTY COULD NOT LEGALLY SELL. THE DEFENDANT MET THE UNDERCOVER DEPUTY OUT IN THE PARKING LOT. THE DEFENDANT ADVISED THAT HIS BOSS WAS AT THE BUSINESS AND HE COULD NOT BUY THE COIL THROUGH THE BUSINESS TODAY. HE THEN PROCEEDED TO GIVE THE DEPUTY $10.00 OUT OF HIS WALLET AND HAD THE DEPUTY PLACE THE COIL IN THE BACK OF THE DEFENDANT’S TRUCK. THE DEFENDANT THEN TOOK SEVERAL PIECES OF COPPER FROM THE UNDERCOVER DEPUTY AND PLACED THEM ON THE SCALE. WHEN HE DID THIS HE ENTERED HIS NAME(THE DEFENDANTS NAME). ONCE IT WAS WEIGHED HE WENT TO THE CASHIERS WINDOW AND WAS PAID $21.00, WHICH IN TURN IN GAVE TO THE UNDERCOVER DEPUTY. (THIS IS THE SECOND CONFIRMED FALSE INFORMATION TO SECOND HAND METAL RECYCLER, SINCE THE DEFENDANT KNEW IT WAS NOT HIS COPPER TO SELL.) ON TODAY’S DATE CONTACT WAS MADE WITH THE DEFENDANT AT HIS WORK. I ADVISED THE DEFENDANT WAS UNDER ARREST AND HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS HELD ON A $2,000.00 BOND.
