SUBMITTED BY: SMITH, STEVE 0292 (AR14-9256) DID SELL, MANUFACTURE, DELIVER, OR POSSESS WITH INTENT TO SELL, MANUFACTURE, OR DELIVER, A CONTROLLED SUBSTANCE IN A STRUCTURE OR CONVEYANCE WHERE ANY CHILD UNDER 16 YEARS OF AGE IS PRESENT, TO WIT: TWO CHILDREN UNDER THE AGE OF 11, IN VIOLATION OF FLORIDA'S STATE STATUTE 893.13(1)(G)(1). DID UNLAWFULLY HAVE IN HER POSSESSION LISTED PRECURSOR CHEMICALS OR ESSENTIAL CHEMICALS USED IN THE MANUFACTURING OF A CONTROLLED SUBSTANCE IN VIOLATION OF FLORIDA STATE STATUTE 893.149(1)(A) THESE CHEMICALS ARE CRITICAL TO THE CREATION OF THE CONTROLLED SUBSTANCE, TO WIT: EPHEDRINE METHAMPHETAMINE. DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(1)(A)(1). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: STRAWS AND METHAMPHETAMINE PIPES, IN VIOLATION OF FLORIDA STATE STATUTE AND 893.147(1). ON 022614, A LAWFUL SEARCH WARRANT WAS EXECUTED AT 3970 SOUTH FERNPARK TERRACE IN INVERNESS. UPON ARRIVAL, WE MADE CONTACT WITH DEFENDANT, MS STEPHANIE SMITH. THE WARRANT WAS READ TO THE DEFENDANT AND THE RESIDENCE WAS SEARCHED. AT THAT TIME, THIS DEPUTY READ THE DEFENDANT HER MIRANDA RIGHTS FROM A PREPRINTED CARD. WHEN ASKED IF SHE UNDERSTOOD HER RIGHTS, SHE SAID YES. WHEN ASKED IF SHE WOULD SPEAK WITH THIS DEPUTY SHE SAID YES. I ASKED HER IF THERE WERE ANY ILLEGAL CHEMICALS INSIDE OF THE RESIDENCE. AT THIS TIME, SHE BEGAN TO CRY AND STATED SHE WOULD COOPERATE AND SAID THE CHEMICALS WERE ALL IN A PLASTIC TUB IN THE GARAGE. DURING THIS INTERVIEW, SHE ADVISED THAT BOTH HER AND HER LIVE IN BOYFRIEND, DEFENDANT JEFFREY KEHR, HAD BEEN MANUFACTURING METHAMPHETAMINE IN THE GARAGE OF THE RESIDENCE. SHE ADVISED THAT ALTHOUGH DEFENDANT KEHR DID MOST OF THE MANUFACTURING, SHE WAS THE ONE WHO RESPONDED TO THE LOCAL STORES PURCHASING ALL OF THE CHEMICALS THAT WERE NEEDED FOR THE METHAMPHETAMINE MANUFACTURERS. SHE FURTHER ADVISED SHE DID PURCHASE EPHEDRINE FOR THESE COOKS. WHEN ASKED HOW LONG SHE HAS BEEN USING METHAMPHETAMINE, SHE ADVISED APPROXIMATELY FIVE MONTHS. WHEN ASKED HOW SHE USES METHAMPHETAMINE, SHE ADVISED SHE SMOKES IT IN A GLASS PIPE WHICH WOULD ALSO BE LOCATED IN THE GARAGE. WHILE WE WERE MAKING CONTACT AT THE RESIDENCE, LAW ENFORCEMENT PERSONNEL HAD PRIOR KNOWLEDGE THAT DEFENDANT KEHR AND DEFENDANT HEATHER CARSON WERE WORKING. BOTH MEMBERS, WHO WORK FOR NATURE COAST EMERGENCY MEDICAL SERVICES (EMS), WERE PRESENTLY ON A MEDICAL TRANSPORT TO GAINESVILLE. ARRANGEMENTS WERE MADE TO MAKE CONTACT WITH BOTH DEFENDANTS WHEN THEY ARRIVED BACK AT THE NATURE COAST OFFICE. UPON THEIR ARRIVAL BACK AT THE NATURE COAST OFFICE, DEFENDANT KEHR WAS ARRESTED ON PROBABLE CAUSE THAT WAS DEVELOPED FROM THE RESIDENCE. DURING THE TIME OF HIS ARREST, HE DID HAVE IN HIS POCKET 0.3 GRAMS OF METHAMPHETAMINE AND A METHAMPHETAMINE PIPE. ALSO AT THAT TIME, DEFENDANT CARSON WAS DETAINED AND AN INTERVIEW WAS CONDUCTED WITH HER BY DETECTIVE BERGEN. DETECTIVE BERGEN READ DEFENDANT CARSON HER MIRANDA RIGHTS FROM A PREPRINTED CARD. WHEN ASKED IF SHE UNDERSTOOD HER RIGHTS, SHE ADVISED SHE DID. WHEN ASKED IF SHE STILL WANTED TO SPEAK TO DETECTIVE BERGEN, SHE ADVISED SHE DID. SHE DID ADMIT TO DETECTIVE BERGEN TO HELPING DEFENDANT KEHR AND DEFENDANT SMITH MANUFACTURE METHAMPHETAMINE ON AT LEAST TWO OCCASIONS. SHE FURTHER ADMITTED TO PURCHASING EPHEDRINE TO THESE COOKS AND HELPING PREPARE CHEMICALS FOR THE MANUFACTURING PROCESS. SHE ALSO STATED SHE PURCHASED DEFENDANT KEHR LABORATORY GLASSWARE FOR THE PURPOSE OF MANUFACTURING METHAMPHETAMINE. SHE WAS SUBSEQUENTLY ARRESTED AND CHARGED WITH MANUFACTURING METHAMPHETAMINE IN THE PRESENCE OF A CHILD AND POSSESSION OF LISTED CHEMICALS. UPON DEFENDANT KEHR ARRIVING BACK AT THE RESIDENCE, I CONDUCTED AN INTERVIEW WITH HIM. HE WAS ASKED IF HE HAD BEEN READ MIRANDA TO WHICH HE ADVISED HE HAD FROM DETECTIVE BERGEN FROM A PRE PRINTED CARD. WHEN ASKED IF HE STILL WANTED TO EXERCISE THESE RIGHTS AND SPEAK TO ME HE SAID YES. HE WENT INTO DETAIL IN REFERENCE TO WHERE ALL OF THE CHEMICALS USED IN THE MANUFACTURING PROCESS WERE LOCATED. HE FURTHER ADVISED THAT HE WAS AN ADDICT AND CAN NOT STOP USING METHAMPHETAMINE. HE WAS ABLE TO TELL ME IN DETAIL WHAT ALL OF THE CHEMICALS WERE AND WHAT THEY WERE USED FOR. HE DID ADVISED THAT THE RECIPE THAT WAS LOCATED IN THE GARAGE HE RETRIEVED IT ONLINE. HE ALSO DID ADMIT TO SMOKING METHAMPHETAMINE AT WORK. HE ADVISED THAT HE PURCHASES ICE FROM DEALERS LOCATED IN PASCO COUNTY AND LAKELAND AREA. HE ADMITTED TO BORROWING THE FIREARM THAT WAS LOCATED IN HIS VEHICLE FROM A FRIEND FOR PROTECTION WHEN HE MAKES THE TRIPS TO PURCHASE METHAMPHETAMINE. T SHOULD BE NOTED THAT ALL THREE DEFENDANTS DID OPENLY ADMIT THAT THE TWO CHILDREN WERE PRESENT IN THE RESIDENCE DURING THE MANUFACTURING OF THE METHAMPHETAMINE. A SEARCH OF THE RESIDENCE DID LEAD TO THE DISCOVERY OF THE FOLLOWING ITEMS: IN THE KITCHEN FREEZER WAS A GLASS JAR CONTAINING CHEMICALS WHICH WERE BEING PREPARED FOR THE METHAMPHETAMINE MANUFACTURING PROCESS. ALSO IN THE KITCHEN OVEN WAS A PYREX PLATE CONTAINING BONG WATER WHICH WAS BEING EVAPORATED SO THE METHAMPHETAMINE RESIDUE COULD BE REUSED. IN THE GARAGE WAS A BLUE PLASTIC TOTE WHICH CONTAINED NUMEROUS CHEMICALS USED IN THE MANUFACTURING PROCESS. THE BLUE PLASTIC TOTE CONTAINED ALUMINUM FOIL, AMMONIA NITRATE, COLEMAN FUEL, LIQUID DRAIN-O, SALT, SUDAFEDRINE, HEATING ELEMENT, LABORATORY GLASSWARE, SODIUM HYDROXIDE, A LITHIUM BATTERY, LIQUID FIRE, LARGE ALUMINUM DRIP PAN AND TUBING. ALSO LOCATED IN THE GARAGE WAS A CAN OF STARTING FLUID. UNDERNEATH THAT CAN WERE NINE PAGES OF DIRECTIONS AND DIAGRAMS ON HOW TO MANUFACTURE METHAMPHETAMINE. ON THE SHELF NEXT TO THE AIR CONDITIONING UNIT WAS A BOTTLE OF SULFURIC ACID. ON THE AIR HANDLER WAS A WHITE JEWELRY BOX WHICH CONTAINED SEVERAL NEW BAGGIES AND SEVERAL BAGGIES CONTAINING APPROXIMATELY 5.5 GRAMS OF A WHITE CRYSTAL LIKE SUBSTANCE. ALSO LOCATED ON THE AIR HANDLER WERE A METHAMPHETAMINE PIPE, A METHAMPHETAMINE BONG AND A USED MOUNTAIN DEW BOTTLE. ON THE SHELF BETWEEN THE AIR HANDLER AND THE WASHING MACHINE WAS A BOTTLE OF ALCOHOL AND A PYREX DISH CONTAINING A RAZOR BLADE AND WHITE CRYSTAL LIKE POWDER. THE WHITE CRYSTAL LIKE POWDER THAT WAS LOCATED IN THE BAGGIES IN THE WHITE JEWELRY BOX FIELD TESTED POSITIVE FOR METHAMPHETAMINE. DEFENDANT KEHR AND DEFENDANT SMITH WERE ARRESTED AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT WHERE THEIR BONDS WERE SET AT $255,500, PER THE BOND SCHEDULE. DEFENDANT CARSON WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HER BOND WAS SET AT $250,000, PER THE BOND SCHEDULE. IT SHOULD BE NOTED THE DEPARTMENT OF CHILDREN AND FAMILIES RESPONDED TO THE RESIDENCE AND DID REMOVE THE TWO SMALL CHILDREN. |
