Probable cause affidavit: SUBMITTED BY: DAVENPORT, JJ 1541 (AR15-14051) (FHPC15OFF019432) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193(1). DID, KNOWING her DRIVER’S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(10)(A). On 2-28-15 at approximately 0249 hours in Citrus County, Florida, the Defendant did knowingly and willfully violate FL State Statue 316.193(1) by unlawfully operating a motor vehicle, a silver in color Suzuki Grand Vatara bearing Florida tag # 599mmw while under the influence of alcohol to the extent that her normal faculties were impaired. On the above date and time I was dispatched to a traffic crash at 10489 S Suncoast Blvd. Upon my arrival I made Contact with Deputy Settles #113 of the Citrus County Sheriffs Office and she advised me upon her arrival at approximately 0245 hours she witnessed the Defendant in actual physical control of the motor vehicle attempting to accelerate out of the mud she was stuck in due to her driving in to a drainage ditch. Before the Defendant could get her vehicle unstuck Deputy Settles turned the Defendant's vehicle off and removed the keys and placed them on top of the vehicle until my arrival. Upon my arrival I could see damage to the Defendants vehicle but could not determine a victim or a location of where the Defendant may have collided with something. Upon making contact with the Defendant I observed but not limited to that she had the strong odor of an alcoholic beverage emitting from her person, had bloodshot/watery eyes, and poor balance to the extent that her normal faculties were impaired. The Defendant was given the opportunity to perform some field sobriety evaluations. The Defendant did perform these evaluations. At the conclusion of these evaluations the Defendant was lawfully placed under arrest for DUI at 0417 hours hand cuffed behind the back, fit tested, and double locked. The defendant was also informed verbally that she was being placed under arrest for DUI. The Defendant was read implied consent at 0540 hours and advised of her Miranda rights at 0345 hours. The SFSE’s which were administered were as follows, the first SFSE was horizontal gaze nystagmus. The Defendant had lack of smooth pursuit in both the left and right eye. The Defendant also had distinct jerking at maximum deviation in both the left and right eye. The defendant also had nystagmus prior to 45 degree angle in both the left and right eye. The Defendant was visibly swaying back and forth during this evaluation. The second SFSE performed by the Defendant was the walk and turn evaluation. The Defendant performed poorly on this evaluation. The Defendant could not stay in the starting position during instructions, started the evaluation prior to being told to do so, took an improper amount of steps on both forward and back, stepped off the line numerous times, and did not count aloud as instructed. The third SFSE performed was the one leg stand. The Defendant performed poorly on this evaluation. The Defendant started the evaluation prior to be instructed. The Defendant could not balance on one leg, had to put her foot down multiple times to maintain balance, and was unable to properly count as demonstrated. The Defendant was transported to the Citrus County Jail by Deputy Settles. The Defendant was given the chance to take a breath test, at which time the Defendant agreed to give a breatH sample to determine her B.A.C. The test was Administered at the Citrus County Jail by C/O J.Schoettner. The results of that test were .278 and .272 /210 L of breath. The Defendant was booked into the Citrus County Jail under the listed charges. The Defendant was ID by her FL DL. A video of the breath test is on file at the Citrus County Jail.
