SUBMITTED BY: HOLTZHOUSE, JONATHAN 0616 (AR1820) THE DEFENDANT, MS HEATHER MARIE LOBDELL, DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: THE DEFENDANT DID POSSESS FOUR SOMA PILLS, SEVEN Clozapine, ONE ALPRAZOLAM, FIVE METHADONE, AND THIRTEEN LORAZEPAM, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). THE DEFENDANT, MS HEATHER MARIE LOBDELL, DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION, DRUG PARAPHERNALIA, DEFINED AS PROPERTY USED TO PLANT, PROPAGATE, CULTIVATE, GROW, HARVEST, MANUFACTURE, COMPOUND, CONVERT, PRODUCE, PROCESS, PREPARE, TEST, ANALYZE, PACK, STORE CONTAIN OR CONCEAL A CONTROLLED SUBSTANCE, TO WIT: THE DEFENDANT HAD A CONTAINER CONTAINING A STRAW AND FOIL WITH RESIDUE FROM THE PILLS, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). THE DEFENDANT, MS HEATHER MARIE LOBDELL, DID INTRODUCE CONTRABAND INTO A DETENTION FACILITY, AS DEFINED IN FLORIDA STATE STATUTES 983.02(4), TO WIT: THE DEFENDANT CONCEALED A THERMOMETER CASE CONTAINING THE AFOREMENTIONED CONTROLLED SUBSTANCES INSIDE OF HER VAGINA, IN VIOLATION OF FLORIDA STATE STATUTE 951.22(1). ON 070312 AT APPROXIMATELY 2030 HOURS, I WAS CONTACTED BY DEPUTY MCEWEN, WHO ADVISED THAT THE DEFENDANT I HAD ARRESTED EARLIER ON OTHER CHARGES, MS HEATHER LOBDELL, HAD BEEN TRANSPORTED TO CITRUS MEMORIAL HOSPITAL, WHERE MEDICAL STAFF HAD FOUND A PLASTIC CONTAINER, CONTAINING NUMEROUS PILLS, A STRAW, AND TIN FOIL INSIDE OF HER VAGINA. I THEN RESPONDED TO CITRUS MEMORIAL HOSPITAL, AND MADE CONTACT WITH CORRECTIONS OFFICER REBECCA WHITNEY, WHO ADVISED THAT WHILE THE DEFENDANT WAS BEING CHECKED INTO THE EMERGENCY ROOM, A SEARCH OF HER BODY BY NURSE KATIE MILLER, REVEALED A CLEAR THERMOMETER CASE PROTRUDING FROM THE DEFENDANTâS VAGINA, AT WHICH TIME THE CASE WAS REMOVED, AND GIVEN TO OFFICER WHITNEY. I THEN TOOK POSSESSION OF THE CASE FROM OFFICER WHITNEY. I COULD NOT QUESTION THE DEFENDANT AT THIS TIME, BECAUSE OF HER MEDICAL STATUS. I THEN RESPONDED BACK TO THE CITRUS COUNTY DETENTION FACILITY, AND CONTACTED POISON CONTROL, TO FIND THE NATURE OF THE PILLS CONFISCATED. POISON CONTROL ADVISED THE FOLLOWING: THERE WERE THREE WHITE PILLS, WITH â446â PRINTED ON THE FRONT, WHICH WERE IDENTIFIED AS SOMA, A SCHEDULE IV NARCOTIC. THERE WERE SEVEN WHITE PILLS WITH â35 Râ PRINTED ON THE FRONT, IDENTIFIED AS CLOZAPINE, A SCHEDULE IV NARCOTIC. THERE WAS ONE BLUE PILL, WITH LETTERING PRINTED ON THE FRONT, IDENTIFIED AS ALPRAZOLAM, A SCHEDULE IV NARCOTIC. THERE WAS ONE WHITE PILL WITH â3â PRINTED ON THE FRONT, WHICH WAS ALSO A SOMA, A SCHEDULE IV NARCOTIC THERE WERE FIVE WHITE PILLS, WITH â54â AND â142â PRINTED ON THE FRONT, WHICH WAS A SCHEDULE II NARCOTIC. THERE WERE THIRTEEN SMALL WHITE PILLS, WITH THE NUMBER â57â PRINTED ON THE FRONT, LISTED AS LORAZEPAM, A SCHEDULE IV NARCOTIC. ALSO INCLUDE IN THE CLEAR CASE WAS A WHITE STRAW, WITH RESIDUE IN AND AROUND IT, AND TINFOIL, WHICH WAS CRUSHED, AND WEDGED INTO THE FRONT OF THE THERMOMETER CASE. THERE WAS ALSO TOILET PAPER IN THE TOP OF THE THERMOMETER CASE, WHICH THE OFFICERS FROM THE DETENTION FACILITY ADVISED THAT THEY BELIEVE IS TOILET PAPER FROM THEIR FACILITYâS RESTROOM. THERE WERE ALSO CRUSHED UP PILLS IN THE CLEAR THERMOMETER CASE, WHICH WERE UNIDENTIFIABLE. FROM PREVIOUS CONVERSATIONS WITH THE DEFENDANT IN A PREVIOUS CASE, SHE AVDISED THAT SHE DID NOT HAVE A PRESCRIPTION FOR THE NARCOTICS WHICH SHE ADMITTED TO TAKING EARLIER. THE PILLS AND PARAPHERNALIA WERE PLACED INTO EVIDENCE BOND WAS SET AT $32,500.00, PER THE BOND SCHEDULE. |
