Probable cause affidavit: SUBMITTED BY: HUNTER, JEFFERY 0441 (AR11119824) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 3 ½ OXYCODONE PILLS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA SMOKING PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) TO WIT: 3.5 PILLS OF OXYCODONE 30 MILLIGRAMS ON 031811 AT APPROXIMATELY 0300 HOURS, I WAS TRAVELING EASTBOUND ON MAIN STREET IN the VICINITY OF DR MARTIN LUTHER KING JR BOULEVARD. I OBSERVED A SILVER TWO DOOR HONDA TRAVELING WESTBOUND. I OBSERVED THE VEHICLE TRAVELING AT APPROXIMATELY 45 MILES PER HOUR (MPH) IN A 35 MPH ZONE. I ACTIVATED MY RADAR and RECEIVED A CLEAR DOPPLER TONE WITH A SPEED READING OF 43 MPH. AS THE VEHICLE PASSED, I OBSERVED that the WINDOW TINTING APPEARED TO BE DARKER THAN THE LEGAL LIMIT. I TURNED AROUND and FOLLOWED THE VEHICLE AND INITIATED A TRAFFIC STOP. the VEHICLE CAME TO A STOP IN THE AREA OF MAIN STREET AND HIGHWAY 41 NORTH. I MADE CONTACT WITH THE DRIVER/DEFENDANT WHO WAS IDENTIFIED BY HER FLORIDA DRIVER'S LICENSE AS, MS MS HEATHER RHEKA. I ADVISED THE DEFENDANT WHY I HAD PULLED HER OVER AND RETURNED TO MY PATROL VEHICLE AND RETRIEVED MY WINDOW TINT METER and PLACED IT ON the FRONT WINDSHIELD, which PROVIDED ME A LIGHT TRANSMISSION READING OF 3%. THE DEFENDANT THEN ASKED IF HER FRONT TINT WAS TOO LOW ON the WINDSHIELD. I WAS UNABLE TO OBSERVE THE AS1 LINE FROM OUTSIDE THE VEHICLE. I THEN STUCK MY HEAD INTO THE VEHICLE TO OBSERVE the TINT LINE, and IMMEDIATELY DETECTED A VERY STRONG ODOR OF MARIJUANA EMITTING FROM the VEHICLE. I ASKED THE DEFENDANT IF THERE WAS ANY ILLEGAL DRUGS IN THE VEHICLE, AND SHE STATED NOT TO HER KNOWLEDGE. DEPUTY TEWELL ARRIVED ON SCENE AND I had THE DEFENDANT AND her PASSENGER STEP FROM the VEHICLE AS I PERFORMED A SEARCH. I LOCATED A BLUE and YELLOW GLASS PIPE THAT SMELLED STRONGLY OF BURNT MARIJUANA WITH RESIDUE IN IT, LOCATED IN THE REAR SEAT OF THE VEHICLE. THE DEFENDANT ADVISED that SHE BELIEVED THE PIPE MAY HAVE BELONGED TO HER COUSIN, and THE DEFENDANT ADVISED THAT SHE WAS RESPONSIBLE FOR IT. DEPUTY TEWELL BEGAN A PAT DOWN OF THE DEFENDANT, AND the DEFENDANT BECAME RESISTANT IN ALLOWING DEPUTY TEWELL TO SEARCH HER BRA. DEPUTY TEWELL ADVISED THAT SHE COULD FEEL AN OBJECT WITHIN HER BRA. I PLACED THE DEFENDANT IN HANDCUFFS (DOUBLE LOCKED) AND ADVISED HER THAT SHE WAS UNDER ARREST FOR DRUG PARAPHERNALIA AND PLACED HER IN the REAR OF MY PATROL VEHICLE. I THEN ADVISED THE DEFENDANT THAT IF SHE INTRODUCED ANY CONTROLLED SUBSTANCE INTO THE DETENTION FACILITY THAT SHE WILL BE GUILTY OF A FELONY CHARGE. AT THAT TIME the DEFENDANT ADMITTED THAT SHE HAD A PILL CONTAINER IN HER BRA CONTAINING XANAX FOR which SHE HAD A PRESCRIPTION, AND OXYCODONE FOR WHICH SHE DID NOT HAvE A PRESCRIPTION. DEPUTY TEWELL RETRIEVED THE PILL CONTINUER WHICH CONTAINED 4 ¼ ALPRAZOLAM BARS AND 3 1/2 OXYCODONE 30 MILLIGRAM TABLETS. THE DEFENDANT WAS ADVISED that SHE WAS BEING CHARGED with POSSESSION OF A CONTROLLED SUBSTANCE. the DEFENDANT'S VEHICLE WAS RELEASED TO HER PASSENGER PER HER INSTRUCTION, BUT AS HE DID NOT POSSESS A VALID DRIVER'S LICENSE, THE VEHICLE WAS PARKED IN the NEARBY PARKING LOT AND THE KEYS WERE LEFT WITH HIM. THE MARIJUANA PIPE AND PILLS WERE LATER TURNED IN TO EVIDENCE. THE DEFENDANT'S BOND WAS SET AT $5,500.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ALSO ISSUED WRITTEN WARNINGS FOR BOTH THE SPEED and WINDOW TINT.
