Probable cause affidavit: | SUBMITTED BY: ALEXANDER, DAWN 0561 (AR09111893) DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(1). DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST FOR DRIVING UNDER THE INFLUENCE. PRIOR TO LEAVING THE SCENE, THE DEFENDANT'S VEHICLE WAS TOWED BY KNIGHTLY AUTO. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS READ HIS IMPLIED CONSENT AND MIRANDA WARNINGS BY DEPUTY DOYLE. THE DEFENDANT WAS NOT GIVEN A FIELD SOBRIETY EXERCISES AT THE SCENE DUE TO his AGITATED STATE. THE DEFENDANT WAS CHARGED WITH DRIVING UNDER THE INFLUENCE WITH A $500.00 BOND PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A FLORIDA DUI UNIFORM TRAFFIC CITATION, NUMBER 3152-XDQ WITH A MANDATORY COURT APPEARANCE OF 120309 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT WAS ALSO ISSUED UNIFORM TRAFFIC CITATION, NUMBERS 0141-ESH THROUGH 0150-ESH, PAYABLE IN THIRTY DAYS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT DID OPERATE A MOTOR VEHICLE ON THE ROADWAYS OR HIGHWAYS OF THE STATE OF FLORIDA WITH WILLFUL AND WANTON DISREGARD FOR THE SAFETY OF THOSE AROUND HIM BY PASSING IN A NO PASSING ZONE, RUNNING STOP SIGNS AND NOT HAVING ANY REGARD FOR PERSONS OR PROPERTY AROUND HIM IN VIOLATION OF FLORIDA STATE STATUE 316.192(1)(A) ON 111309 I WAS SPEAKING WITH DEPUTY DOYLE WHO HAD JUST COMPLETED A FIELD SOBRIETY ON A FEMALE INVOLVED IN AN ACCIDENT AT THE INTERSECTION OF CUTLER SPUR BOULEVARD AND SOUTHEAST PARADISE POINT ROAD. AS I WAS SPEAKING WITH DEPUTY DOYLE AND DEPUTY DERA I HEARD A MOTOR VEHICLE ACCELERATE AT A HIGH RATE OF SPEED. I TURNED AND SAW A GREY JEEP ACCELERATING TO AT LEAST 50 MILES PER HOUR ON SOUTHEAST CUTLER SPUR BOULEVARD AS HE WAS PASSING ANOTHER VEHICLE THIS IS CLEARLY MARKED A NO PASSING ZONE WITH A DOUBLE YELLOW LINE, PLUS HE WAS ALSO AT THE INTERSECTION WHERE THE ACCIDENT HAD occurred. I WENT TO MY VEHICLE AND ATTEMPTED TO CATCH UP WITH THE GREY JEEP. AS I WAS ATTEMPTING TO CATCH UP WITH HIM I OBSERVED THE GREY JEEP PASS IN NO PASSING ZONE IN THE AREA OF SOUTHEAST CUTLER SPUR AND KINGS BAY DRIVE. HE THEN AGAIN PASSED IN THE AREA OF SOUTHEAST CUTLER SPUR AND NORTHEAST 1ST TERRACE. I HAD MY EMERGENCY LIGHTS AND EMERGENCY SIREN ON TRYING TO GET THE VEHICLE TO STOP AND PULL OVER. THE VEHICLE THEN MADE A SHARP LEFT ONTO NORTHEAST 2ND COURT FAILING TO STOP AT THE STOP SIGN AT NORTHEAST 2ND COURT AND NORTHEAST 1ST STREET. AS I WAS STILL BEHIND HIM I NOTIFIED DISPATCH THAT I WAS TRYING TO STOP THIS VEHICLE DUE TO THE FACT HE WAS PASSING IN NO PASSING ZONE AND RUNNING PEOPLE OFF THE ROAD AND HE WAS GOING THROUGH THE STOP SIGNS WITHOUT EVEN BRAKING. THE VEHICLE WENT THROUGH THREE MORE STOP SIGNS WHEN HE FINALLY PULLED OVER AT NORTHEAST 3RD STREET AND NORTH CITRUS AVENUE. I ADVISED DISPATCH THE VEHICLE HAD STOPPED. I APPROACHED THE VEHICLE AND ASKED THE DRIVER FOR HIS DRIVER'S LICENSE AND REGISTRATION THE DRIVER KEPT TRYING TO OPEN THE DRIVER DOOR WHICH I KEPT SHUTTING. THE DRIVER HANDED ME A DRIVER'S LICENSE WITH THE NAME HECTOR J VASQUEZ . I ASKED HIM WHAT HIS PROBLEM WAS TO WHICH HE STATED THAT HE WAS A FIRE FIGHTER. DURING THE INTERACTION WITH THE DEFENDANT HIS ACTIONS WERE EXTREMELY SLOW, HE HAD GLASSY EYES AND JUST SEEMED TO HAVE A HARD TIME COMPREHENDING WHAT HE HAD DONE. MY BACK UP ARRIVED I HAD K9 DEPUTY DAVIS DO A DOG WALK ON THE DEFENDANT'S VEHICLE AND THE DOG DID ALERT. I ADVISED DEPUTY PINNER THAT I WOULD BE PLACING THE DRIVER UNDER ARREST FOR RECKLESS DRIVING ANYWAY. I APPROACHED the DRIVER SIDE DOOR AND ADVISED THE DRIVER TO STEP OUT OF VEHICLE AND PLACE HIS HANDS ON THE ROOF. HE BECAME ARGUMENTATIVE. I PLACED THE HANDCUFF ON HIS LEFT WRIST AND HE IMMEDIATE PLACED HIS RIGHT HAND IN THE AIR OVER HIS HEAD TO KEEP ME FROM PLACING THE OTHER HANDCUFF ON HIM. DEPUTY PINNER DID DO A PAT DOWN SEARCH OF THE DEFENDANT AND PLACED HIM IN THE REAR OF MY PATROL CAR. I THEN MADE CONTACT WITH THE PASSENGER WHO WAS IN THE VEHICLE AND ASKED HIM WHAT WAS THE MATTER. HE STATED THAT THEY SAW ME BEHIND THEM AND THAT HE TOLD THE DRIVER TO STOP BUT THE DRIVER WAS ANGRY BECAUSE HE DID NOT GET PAID AND THAT HE COULD DRIVE THAT WAY BECAUSE HE WAS A FIRE FIGHTER. THE PASSENGER DID ADVISE ME THAT HE WAS EXTREMELY SCARED BECAUSE THE DRIVER WAS DRIVING CRAZY. A WRITTEN STATEMENT WAS OBTAINED FROM THE PASSENGER. THE DEFENDANT WAS ISSUED FOUR CITATIONS FOR RUNNING A STOP SIGN AT DIFFERENT INTERSECTIONS, ISSUED ONE CITATION FOR DISREGARDING A TRAFFIC CONTROL DEVICE FOR SPEEDING, THREE CITATIONS FOR PASSING IN NO PASSING ZONE, ONE CITATION FOR FLEEING AND ELUDING AND FOR ONE RECKLESS DRIVING. THE DEFENDANT'S VEHICLE WAS TOWED BY KNIGHTLY AUTO PER THE ROTATION WRECKER. THE DEFENDANT WAS THEN TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL AT THE DETENTION CENTER DEPUTY DOYLE DID READ HIM MIRANDA AND IMPLIED CONSENT. HE STATED THAT HE WOULD NOT TAKE THE BREATHALYZER. I ADVISED THE JAIL STAFF THAT I WANTED HIM TO DO A FIELD SOBRIETY ON CAMERAS EVEN THOUGH HE ADVISED HE WAS GOING TO REFUSE. APPROXIMATELY AN HOUR WENT BY I WENT TO THE JAIL AND ASKED IF THE DEFENDANT WAS DONE IN THE INTOXILIZER ROOM I WAS ADVISED THAT NOBODY KNEW THAT THEY WERE SUPPOSED TO BE DOING A DUI ON THE DEFENDANT THAT THE DAY SHIFT PERSON DID NOT TELL THEM. THE DEFENDANT WAS THEN BROUGHT INTO THE INTOXILIZER ROOM. HE REFUSED TO SUBMIT TO THE BREATHALYZER BUT HE DID AGREE TO THE FIELD SOBRIETY exercise. NOTE: THE DEFENDANT CONTINUALLY STATED THAT I ARRESTED HIM BECAUSE HE WAS HISPANIC AND THAT IT WAS A RACE THING HE STATED TO THIS DEPUTY AND THE JAIL STAFF THAT HE DID NOT DO ANYTHING WRONG IT IS JUST because HE IS A HISPANIC MALE THAT HE WENT TO JAIL. *NOT-EXEMPT* |
