SUBMITTED BY: CUTLIP, JOSHUA 0721 (12-36676) (AR96) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: ROLLING PAPERS AND A METAL TOBACCO SMOKING PIPE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). DID UNLAWFULLY AND KNOWINGLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 022412 AT APPROXIMATELY 1601 HOURS, I RESPONDED TO WEST MAIN STREET AND SOUTH BOULEVARD AS BACK UP FOR DEPUTY L CANFIELD AND DEPUTY POLLARD, WHO WERE INVOLVED IN A TRAFFIC STOP. UPON ARRIVAL, I OBSERVED DEPUTY CANFIELD AND DEPUTY POLLARD INVOLVED IN A PHYSICAL CONFRONTATION IN THE EASTBOUND LANE OF MAIN STREET NEAR THE INTERSECTION OF SOUTH BOULEVARD. I RENDERED ASSISTANCE AS DEPUTY CANFIELD AND DEPUTY POLLARD RESTRAINED THE SUSPECT ON THE PAVEMENT. I WAS THEN ABLE TO HANDCUFF THE SUBJECT BEHIND HIS BACK WITH USE OF MINIMAL FORCE WHERE THE SUSPECT DID NOT SUSTAIN ANY INJURIES DUE TO BEING HANDCUFFED. THE DEFENDANT WAS PLACED UNDER ARREST BY DEPUTY L CANFIELD, HANDCUFFED, BEHIND HIS BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF DEPUTY POLLARDâS PATROL VEHICLE. THE OTHER OCCUPANTS OF THE VEHICLE WERE REMOVED FROM THE VEHICLE AND SEARCHED FOR ANY ILLEGAL CONTRABAND OR WEAPONS, WHICH YIELDED NEGATIVE RESULTS AT THAT TIME. K-9 DEPUTY BEHNEN ARRIVED ON SCENE WITH K-9 JERRY LEE AND CONDUCTED AN EXTERIOR SNIFF OF THE VEHICLE. DEPUTY BEHNEN ADVISED THAT K-9 JERRY LEE HAD POSITIVELY ALERTED ON THE VEHICLEâS PASSENGER FRONT SIDE. UPON THIS DISCOVERY, DEPUTY BEHNEN ALONG WITH DETECTIVE CONLEY, WHO WAS ALSO ON SCENE, LOCATED IN THE FRONT PASSENGER SEAT OF THE VEHICLE THE DEFENDANTâS TURQUOISE BLUE PURSE WHICH WAS OPEN AND VISIBLE TO PLAIN SITE. DEPUTY BEHNEN LOCATED IN THE DEFENDANTâS PURSE A CLEAR PLASTIC BAGGIE CONTAINING A GREEN LEAFY SUBSTANCE, A METAL TOBACCO SMOKING PIPE AND ROLLING PAPERS. DEPUTY BEHNEN ADVISED THIS DEPUTY THAT THE GREEN LEAFY SUBSTANCE WAS MARIJUANA DUE TO HIS TRAINING AND EXPERIENCE. DEPUTY BEHNEN AND DETECTIVE CONLEY THEN SHOWED ME EXACTLY WHERE THE CONTRABAND AND DRUG PARAPHERNALIA WAS LOCATED. THAT IS WHEN I TOOK THE PURSE OUT OF THE VEHICLE WHICH STILL CONTAINED THE CANNABIS AND DRUG PARAPHERNALIA AND SECURED IT IN THE TRUNK OF MY PATROL VEHICLE. IT IS TO BE NOTED THAT THE METAL TOBACCO SMOKING PIPE HAD A STRONG ODOR OF BURN MARIJUANA WHERE DEPUTY BEHNEN CONFIRMED IT TO BE MARIJUANA DUE TO HIS TRAINING AND EXPERIENCE. THE CANNABIS WAS LATER WEIGHED ON A CERTIFIED SCALE AT THE CITRUS COUNTY DETENTION FACILITY WHICH YIELDED AN APPROXIMATELY WEIGHT OF 2 GRAMS. THE DEFENDANT, MS HEIDI WARDELL, WAS PLACED UNDER ARREST FOR POSSESSION OF DRUG PARAPHERNALIA AND CANNABIS, HANDCUFFED, BEHIND HER BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. I THEN READ THE DEFENDANT MIRANDA VIA PREPRINTED AGENCY CARD AND ASKED IF SHE UNDERSTOOD HER RIGHTS AND IF SHE WISHED TO SPEAK WITH ME, TO WHICH SHE ADVISED THAT YES SHE UNDERSTOOD HER RIGHTS AND WOULD SPEAK WITH ME AT THIS TIME. POST MIRANDA, THE DEFENDANT ADMITTED TO HAVING MARIJUANA IN HER POSSESSION AND THAT BOTH THE METAL PIPE AND THE ROLLING PAPERS WERE USED FOR SMOKING MARIJUANA. THE CANNABIS AND DRUG PARAPHERNALIA WERE PACKAGED SEPARATELY AND WILL LATER BE TURNED IN TO EVIDENCE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE THE BOND WAS SET AT A TOTAL OF $1,000.00, PER THE BOND SCHEDULE. |
