SUBMITTED BY: BONURA, MATTHEW 0334 (AR07004271) WARD, JOHN 0603 THE DEFENDANT DID UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. AT APPROXIMATELY 1500 HOURS ON 080307, DISPATCH ADVISED ME IN REFERENCE TO A DISTURBANCE ON THE CORNER OF STONEBROOK STREET AND MICHIGAN. ON THE WAY TO STONEBROOK STREET, I WAS FLAGGED DOWN BY THE COMPLAINANT, STATING THE DEFENDANT WAS DOWN IN THE MIDDLE OF THE ROAD. AS I APPROACHED THE DEFENDANT, I OBSERVED THE DEFENDANT SCREAMING AND YELLING OBSCENITIES IN THE MIDDLE OF THE STREET, AND ALSO SLAPPING AT VEHICLES PASSING BY, CAUSING A DANGER TO HIMSELF AND THE MOTORISTS ON THE ROAD. THE MOTORIST HAD TO DEVIATE FROM THEIR NORMAL DRIVING PATH TO AVOID HITTING HIM. AS I APPROACHED THE DEFENDANT, I ORDERED THE DEFENDANT SEVERAL TIMES TO LEAVE THE MIDDLE OF THE ROAD. UPON THE DEFENDANT LEAVING THE ROAD, HE WAS VERY BELLIGERENT, WAVING HIS ARMS IN THE AIR, AND CUSSING AT THE PASSING MOTORISTS. AT THAT TIME, I WAS TRYING TO FIND OUT WHY HE WAS STANDING IN THE MIDDLE OF THE ROAD. THE DEFENDANT STARTED YELLING AT ME, STATING "YOU FUCKING KNOW." WHILE THE DEFENDANT WAS DOING THIS, I DETECTED A STRONG ODOR OF ALCOHOL COMING FROM THE DEFENDANT'S BREATH AND PERSON. THE DEFENDANT'S SPEECH WAS VERY SLURRED. AT THAT TIME, I HAD THE DEFENDANT TURN AROUND AND I CONDUCTED A PAT DOWN ON HIM. AT THAT TIME, I PLACED THE DEFENDANT IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK. I THEN SECURED HIM IN THE REAR SEAT OF THE PATROL VEHICLE. THERE WERE THREE INDIVIDUAL WITNESSES, AND ALL THREE WROTE SWORN WRITTEN STATEMENTS, ONE OF WHICH WAS THE DEFENDANT'S DAUGHTER, WHO WAS 11 YEARS OLD, AND WAS VERY EMOTIONAL UPSET AND FRIGHTENED OF HER FATHER AND OF THE WAY HE WAS ACTING. UPON THE REQUEST OF THE DEFENDANT'S DAUGHTER, I CONTACTED HER MOTHER. UPON THE MOTHER'S ARRIVAL, THE DAUGHTER WAS RELEASED TO HER. UPON COMPLETION OF THE STATEMENTS, I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, WHILE WAITING FOR THE SALLIE PORT GATES TO OPEN, THE DEFENDANT SLIPPED HIS HANDCUFFS FROM BEHIND HIS BACK TO THE FRONT. AT THAT TIME, THE DEFENDANT STATED TO ME HE WAS GOING TO "BEAT MY ASS AND KILL ANYONE AND ANYONE WHO TRIED TO TOUCH HIM AT THE JAIL FACILITY." AT THAT TIME, I REQUESTED ASSISTANCE OF THE JAIL STAFF. I INFORMED THE JAIL STAFF THAT THE DEFENDANT WAS VERY HOSTILE. AT THAT TIME I ALLOWED THE JAIL STAFF TO TAKE CONTROL OF THE DEFENDANT. THE DEFENDANT THEN RESISTED THE JAIL STAFF, CAUSING THEM TO DEPLOY THEIR CHEMICAL AGENTS ON THE DEFENDANT. THE DEFENDANT WAS THEN ABLE TO BE REMOVED FROM THE PATROL VEHICLE WITHOUT ANY FURTHER INCIDENT. THE DEFENDANT WAS THEN CHARGED WITH ONE COUNT OF DISORDERLY INTOXICATION AND WAS GIVEN A BOND OF $150.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
