SUBMITTED BY: SKINNER, RODNEY 0563 (AR11122417) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). ON 082411 AT APPROXIMATELY 1321 HOURS, I WAS CONDUCTING EXTRA PATROL ON SOUTH ARABIAN AVENUE IN FLORAL CITY, IN REFERENCE TO SEVERAL COMPLAINTS FOR THE PAST TWO WEEKS ABOUT SPEEDERS IN DERBY OAKS SUBDIVISION. WHILE TRAVELLING NORTH ON ARABIAN AVENUE I OBSERVED THE DEFENDANT, MR HERMAN BARCO, JR, PASS MY LOCATION TRAVELLING SOUTHBOUND DRIVING A WHITE CHEVROLET PICKUP BEARING FLORIDA TAG NUMBER 050-TMF. I HAVE HAD PRIOR ENCOUNTERS WITH MR BARCO AND HAVE KNOWLEDGE THAT MR BARCO CURRENTLY HAS A SUSPENDED NORTH CAROLINA DRIVER'S LICENSE. I RAN MR BARCO THROUGH NORTH CAROLINA NCIC/FCIC WHICH CONFIRMED THAT HIS NORTH CAROLINA DRIVER'S LICENSE WAS CURRENTLY SUSPENDED, INDEFINITELY. IN FACT, MR BARCO HAS NEVER HAD A FLORIDA DRIVER'S LICENSE. I INITIATED A TRAFFIC STOP USING ALL EMERGENCY LIGHTS AND MR BARCO PULLED INTO THE DRIVEWAY AT 9761 SOUTH ARABIAN AVENUE, WHICH WAS LATER LEARNED TO BE HIS BROTHER'S RESIDENCE. CONTACT WAS MADE WITH MR BARCO, WHO ADVISED HIS DRIVER'S LICENSE IS SUSPENDED INDEFINITELY FOR FAILURE TO PAY TRAFFIC FINES. MR BARCO ALSO STATED HE KNEW HE SHOULD NOT BE DRIVING, BUT ADVISED HE HAD NO OTHER WAY OF TRANSPORT. MR BARCO WAS PLACED UNDER ARREST AT 1326 HOURS AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR DRIVING ON A SUSPENDED LICENSE, KNOWINGLY. UPON ARRIVED, HE WAS TURNED OVER TO DETENTION STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION NUMBER 8609-FRY5, FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED, KNOWINGLY WITH A MANDATORY COURT DATE OF 090811 AT 1300 HOURS. MR BARCO'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. MR BARCO'S VEHICLE WAS LEFT IN HIS BROTHER'S DRIVEWAY PER HIS REQUEST.
