Probable cause affidavit: | ON 5/30/15, I WAS ON WATER PATROL ALONG WITH FWC LIEUTENANT JOHN JONES ON KINGâS BAY IN CRYSTAL RIVER. I OBSERVED A PERSONAL WATERCRAFT OPERATING ON A FULL PLANE INSIDE A POSTED IDLE SPEED ZONE. LT. JONES INITIATED A VESSEL STOP AND I MADE CONTACT WITH THE OPERATOR, LATER IDENTIFIED BY HER FLORIDA DL AS HOLLY F. NORRIS, (D.O.B. 1/28/78- DEFENDANT). I INITIATED A BOATING SAFETY INSPECTION AND ASKED TO SEE A COPY OF THE VESSEL REGISTRATION. THE DEFENDANT RETRIEVED A SMALL PLASTIC CONTAINER WITH A LID HELD ON BY LATCHES, AND ATTEMPTED TO HAND IT TO HER PASSENGER, HAILEY E. PELL SEATED ON THE BACK OF THE WATERCRAFT. I REMINDED THE DEFENDANT TO PRODUCE A REGISTRATION. THE DEFENDANT HAD A DIFFICULT TIME STAYING FOCUSED AND FUMBLED TO GET THE CONTAINER OPEN. AFTER CLOSE TO 20 SECONDS OF TRYING, NORRIS WAS ABLE TO OPEN THE CONTAINER AND PRODUCE A VESSEL REGISTRATION. I OBSERVED THE DEFENDANTâS MOVEMENTS TO BE VERY SLOW AND DELIBERATE, AND HER EYES TO BE BLOODSHOT AND WATERY. HER RESPONSES TO QUESTIONS WERE SLOW OR SHE DID NOT RESPOND AT ALL. I DETECTED A STRONG ODOR OF ALCOHOLIC BEVERAGE COMING FROM THE DEFENDANT AND OBSERVED HER SPEECH TO BE SLOW AND SLURRED. BASED ON MY TRAINING AND EXPERIENCE, I SUSPECTED THE DEFENDANT WAS OPERATING A VESSEL WHILE IMPAIRED. DUE TO APPROACHING INCLEMENT WEATHER WE RELOCATED TO PETEâS PIER ABOUT 50 YARDS AWAY TO CONDUCT OUR INVESTIGATION. I INFORMED NORRIS OF MY SUSPICION AND ASKED HER IF SHE WOULD EXIT THE WATERCRAFT AND WALK OVER TO A COVERED DECK APPROXIMATELY 20 â AWAY TO GET OUT OF THE RAIN AND SO I COULD SPEAK WITH HER. THE DEFENDANT INDICATED SHE WOULD COMPLY. I ASSISTED NORRIS ONTO MY VESSEL, AND THEN ONTO THE DOCK. WHILE WALKING OVER TO THE COVERED AREA I OBSERVED THE DEFENDANT TO BE VERY UNSTEADY ON HER FEET. I BEGAN TO READ STANDARDIZED FIELD SOBRIETY PRE-TASK QUESTIONS AT WHICH TIME SHE INDICATED SHE WOULD NOT BE ANSWERING ANY MORE QUESTIONS OR PERFORMING ANY SOBRIETY EXERCISES. BASED ON MY PROBABLE CAUSE I INFORMED THE DEFENDANT SHE WAS UNDER ARREST FOR OPERATING A VESSEL WHILE IMPAIRED. THE DEFENDANT WAS PLACED IN HAND CUFFS AND ADVISED TO HAVE A SEAT ON A STABLE BENCH AT PETEâS PIER. I READ THE DEFENDANTâS IMPLIED CONSENT WARNING OUT LOUD TO THE DEFENDANT REQUESTING THAT SHE SUBMIT TO A LAWFUL TEST OF HER BREATH TO DETERMINE ITS ALCOHOL CONTENT AND ASKED HER IF SHE UNDERSTOOD. NORRIS NODDED HER HEAD IN THE AFFIRMATIVE, AND SAID SHE WOULD NOT SUBMIT TO A TEST OF HER BREATH. AT THAT TIME THE DEFENDANT WAS TURNED OVER TO A CITRUS COUNTY SHERIFFâS DEPUTY AND TRANSPORTED TO THE CITRUS COUNTY CITRUS COUNTY DETENTION FACILITY AND CHARGED WITH OPERATING A VESSEL WHILE NORMAL FACULTY IMPAIRED WITH A MANDATORY COURT APPEARANCE AT THE CITRUS COUNTY COURT HOUSE ON 061515, AT 0815 HOURS. THE DEFENDANT WAS ISSUED CITATION #V484570 FOR OPERATING VESSEL WHILE NORMAL FACULTIES IMPAIRED, AND V484569 FOR VIOLATING A MANATEE IDLE SPEED ONLY ZONE.
