Probable cause affidavit: SUBMITTED BY: SANCHEZ MICHAEL 1242 (AR14-11795) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: THE DEFENDANT TRAILER FULL OF MISCELLANEOUS TOOLS WITHOUT THE VICTIM'S PERMISSION OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: $2,000.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). did unlawfully and knowingly obtain, use or endeavor to obtain or use the property of MR RAYMOND SCHMIDT to-wit: A WHITE ENCLOSED TRAILER APPROXIMATELY TEN FEET LONG, by exercising control over said property with the intent to either temporarily or permanently deprive MR RAYMOND SCHMIDT of a right to the property or a benefit thereof, or did appropriate the property to HIS own use or the use of any person not entitled thereto, and knew or should have known that said property was stolen, in violation of Florida Statutes 812.014(1) and 812.014(2)(c)(6). ON 082914, AT APPROXIMATELY 2042 HOURS, DISPATCH ADVISED THAT A THEFT HAD JUST OCCURRED AT 3199 EAST BUFFALO LANE IN HERNANDO. DISPATCH ADVISED THAT THE VICTIM'S TRAILER WAS TAKEN FROM HIS YARD AND WAS LAST SEEN HEADED NORTH ON CARL G ROSE HIGHWAY. AT THAT TIME, I POSITIONED MY PATROL VEHICLE AT NORTH CARL G ROSE HIGHWAY AND EAST WITHLACOOCHEE TRAIL. DISPATCH THEN ADVISED THAT THE TRAILER WAS WHITE IN COLOR AND APPROXIMATELY TEN FEET LONG WITH A NEW JERSEY LICENSE PLATE ON IT. THEY ALSO ADVISED THAT THE TRAILER WAS BEING PULLED BY A WHITE SUBURBAN TYPE VEHICLE. A FEW MOMENTS LATER, I SAW A VEHICLE PULLING A TRAILER MATCHING THE DESCRIPTION PULL INTO THE KANGAROO GAS STATION AT THE INTERSECTION THAT I WAS SITTING AT. AS I POSITIONED MY PATROL VEHICLE BEHIND THE VEHICLE AND TRAILER, I SAW THE TRAILER HAD A NEW JERSEY LICENSE PLATE TGW17K. I CONDUCTED A TRAFFIC STOP ON THAT VEHICLE IN THE PARKING LOT, WHERE I HAD THE DRIVER EXIT THE VEHICLE. AT THAT TIME, THE DRIVER WAS DETAINED, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SEARCHED. I THEN WAITED ON A BACK UP DEPUTY TO ARRIVE ON SCENE, WHERE AT THAT TIME WE CLEARED THE VEHICLE TO MAKE SURE THERE WAS NO ONE ELSE PRESENT INSIDE. ONCE THE VEHICLE WAS CLEARED THE DEFENDANT WAS REMOVED FROM THE REAR OF MY PATROL VEHICLE, WHERE HE WAS IDENTIFIED AS MR HORTON TEEPLE III. THE DEFENDANT WAS THEN READ HIS MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD. WHEN I ASKED THE DEFENDANT WHAT HE WAS DOING WITH THE TRAILER, HE ADVISED THAT IT WAS HIS FRIEND RAY’S TRAILER AND HE WAS TOWING IT UP TO THE GAS STATION TO GET GAS. THE DEFENDANT ADVISED THAT HIS FRIEND RAY KNEW THAT HE HAD IT because THEY WERE GOING TO BE STARTING A BUSINESS TOGETHER. WHEN I ASKED THE DEFENDANT WHY HE HAD THE TRAILER TO GET GAS AT THAT TIME OF NIGHT IN THE RAIN, HE ADVISED THAT HE HAD A NEW TRANSMISSION IN HIS VEHICLE AND WANTED TO TOW THE TRAILER TO TRY IT OUT. THE DEFENDANT CONTINUED TO ADVISE THAT HE WAS AT HIS FRIEND’S RAY’S RESIDENCE, WHERE HE HAD JUST LEFT AND RAY KNEW THAT HE HAD THE TRAILER. CONTACT WAS THEN MADE with THE VICTIM, MR RAYMOND SCHMIDT, WHERE HE RESPONDED TO THE SCENE OF THE TRAFFIC STOP. THE VICTIM IDENTIFIED THE TRAILER AS HIS AND ADVISED THAT THE TRAILER ITSELF WAS WORTH APPROXIMATELY $3,000.00 WITH MISCELLANEOUS TOOLS INSIDE WORTH APPROXIMATELY $2,000.00. AS I SPOKE WITH THE VICTIM, HE ADVISED THAT THE DEFENDANT WAS PREVIOUSLY AT HIS RESIDENCE BECAUSE THEY WERE FRIENDS. THE VICTIM ADVISED THAT THE DEFENDANT LEFT HIS RESIDENCE, WHERE A SHORT TIME LATER THE VICTIM'S ROOMMATE, WHO WAS IDENTIFIED AS WITNESS, MR CARL HARPER, RETURNED HOME FROM RUNNING AN ERRAND. THE WITNESS ADVISED HIS ROOMMATE THAT HE JUST SAW THE DEFENDANT TOWING HIS TRAILER DOWN THE ROAD. AT THAT TIME, THE VICTIM CONTACTED THE SHERIFF’S OFFICE TO REPORT IT STOLEN. THE VICTIM ADVISED THAT HE NEVER GAVE THE DEFENDANT PERMISSION TO TAKE THE TRAILER NOR WAS HE EVER GOING INTO A BUSINESS WITH HIM. AT THAT TIME, THE VICTIM ADVISED THAT HE DID WISH TO PRESS CHARGES ON THE DEFENDANT. NEXT, I SPOKE WITH THE WITNESS, MR CARL HARPER, WHO ADVISED THAT HE WAS RETURNING TO HIS RESIDENCE AND HE SAW THE DEFENDANT’S VEHICLE LEAVING THE AREA OF HIS RESIDENCE AND HE WAS TOWING HIS ROOMMATE’S TRAILER BEHIND IT. WHEN THE WITNESS MADE IT BACK TO THE RESIDENCE HE WAS ABLE TO CONFIRM that IT WAS HIS ROOMMATE’S TRAILER, DUE TO IT BEING GONE. HE ADVISED AT THAT TIME HIS ROOMMATE CALLED 911 TO REPORT HIS TRAILER STOLEN. AGAIN, I MADE CONTACT WITH THE DEFENDANT, WHERE I AGAIN ASKED HIM IF HE WAS SURE THE VICTIM GAVE HIM PERMISSION TO USE THE TRAILER AND HE ADVISED THAT THE VICTIM DID NOT. THE DEFENDANT THEN STATED THAT HE WAS JUST TOWING IT TO THE GAS STATION TO GET GAS AND WAS GOING TO BRING IT RIGHT BACK. AT THAT TIME, THE DEFENDANT WAS ADVISED THAT HE WAS BEING PLACED UNDER ARREST, WHERE HE WAS SEATED IN THE REAR OF MY PATROL VEHICLE. THE VICTIM WAS ABLE TO TAKE BACK POSSESSION OF HIS TRAILER. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING, WHERE HIS BOND WAS SET AT $2,000.00 FOR THE AUTO THEFT CHARGE AND $2,000.00, FOR THE GRAND THEFT CHARGE, FOR A TOTAL BOND AMOUNT OF $4,000.00, PER THE BOND SCHEDULE.
