Probable cause affidavit: SUBMITTED BY: BEAGAN, THOMAS 0171 (AR08105965) did knowingly, willfully and feloniously be in the actual or constructive possession of a controlled substance, to-wit: SIX LORAZEPAM PILLS, .5 MILLIGRAMS, in violation of Florida Statutes 893.13(6)(a) . ON 102808, I WAS NOTIFIED BY DEPUTY RAMOS VIA TELEPHONE AND HE ADVISED ME THAT HE HAD JUST TAKEN A REPORT IN REFERENCE TO A THEFT OF A CREDIT CARD, AND THAT THE SUSPECT FREQUENTS THE INVERNESS PUBLIC LIBRARY OFF DRUID STREET, PER THE VICTIM WHO ALSO STATED HE WAS PROBABLY THERE AT THE PRESENT TIME. DEPUTY RAMOS PROVIDED ME WITH THE SUSPECT'S NAME OF JACINTH CONTI JUNIOR AND HIS DRIVER'S LICENSE NUMBER WHICH I THEN RESEARCHED THROUGH RECORDS MANAGEMENT SYSTEM AND "DAVID," WHICH REVEALED A PHOTO OF THE SUSPECT. I THEN RESPONDED TO THE INVERNESS PUBLIC LIBRARY IN AN ATTEMPT TO MAKE CONTACT WITH THE SUSPECT. UPON ARRIVAL AT 1421 HOURS, I OBSERVED TWO WHITE MALE SUBJECTS STANDING OUT FRONT OF THE LIBRARY WITH ONE SUBJECT WEARING BLUE PANTS AND A BROWN LEATHER JACKET FITTING THE DESCRIPTION GIVEN BY THE VICTIM. AS I APPROACHED THE FRONT OF THE LIBRARY, BOTH SUBJECTS STARTED TO WALK AWAY IN SEPARATE DIRECTIONS. I ROLLED DOWN MY WINDOW AND CALLED OUT THE NAME "JACINTH" TO THE SUBJECT WEARING THE BROWN LEATHER JACKET, REQUESTING TO SPEAK WITH HIM FOR A MOMENT. AT THAT TIME, THE MALE STOPPED AND TURNED AROUND TOWARDS ME AND STARTED WALKING TOWARDS MY PATROL VEHICLE, AT WHICH TIME, I COULD POSITIVELY IDENTIFY THE SUBJECT AS MR JACINTH CONTI JUNIOR. MR CONTI THEN ASKED ME WHAT WAS UP, AND I ADVISED HIM THAT ANOTHER DEPUTY HAD RECEIVED A REPORT FROM A CONTI FAMILY MEMBER ADVISING THAT THEIR CREDIT CARD HAD BEEN STOLEN FROM HIS (CONTI) RESIDENCE THIS MORNING, AT WHICH TIME, HE REACHED INTO THE RIGHT FRONT POCKET OF HIS JACKET AND PULLED OUT A SMALL BILLFOLD. AS MR CONTI WAS DOING THIS, HE STATED "YES, I TOOK IT FROM MY MOM." WHEN MR CONTI PULLED HIS BILLFOLD OUT OF HIS RIGHT FRONT POCKET, HE ALSO REMOVED A HARD PACK OF MARLBORO MENTHOL CIGARETTES. AS MR CONTI WAS REMOVING THE CREDIT CARD AND HIS DRIVER'S LICENSE FROM HIS BILLFOLD, I HELD MR CONTI'S BOX OF MARLBORO CIGARETTES. DUE TO THE FLIP TOP OF THE BOX NOT CLOSING PROPERLY, I OBSERVED THAT THERE WERE NO CIGARETTES INSIDE THE BOX; HOWEVER, I DID OBSERVE A PIECE OF ROLLED PLASTIC INSIDE THE BOX, AND I COULD PARTIALLY SEE SOME SMALL WHITE PILLS WRAPPED IN THE PLASTIC. MR CONTI THEN HANDED ME THE CREDIT CARD WHICH BELONGED TO HIS MOTHER, AND I ASKED HIM WHAT WAS IN THE PIECE OF ROLLED PLASTIC INSIDE THE CIGARETTE BOX, AND HE ADVISED ME THEY WERE "LORAZEPAMS, .5 MILLIGRAMS." I ASKED MR CONTI WHERE HE HAD OBTAINED THE LORAZEPAMS BECAUSE THEY WERE NOT IN A PROPER CONTAINER, AND HE STATED THAT HE TOOK THEM FROM HIS MOTHER AND THAT THERE WERE SIX OF THEM ROLLED UP INSIDE THE PLASTIC. MR CONTI DID PROVIDE A SWORN WRITTEN STATEMENT WHICH WILL BE TURNED INTO RECORDS). I THEN MADE CONTACT VIA TELEPHONE WITH MR CONTI'S MOTHER AND REQUESTED SHE RESPOND TO MY LOCATION. UPON HER ARRIVAL, SHE ADVISED SHE DID NOT WISH TO PROCEED WITH CRIMINAL CHARGES REFERENCE THE THEFT OF HER CREDIT CARD. I THEN RETURNED HER CREDIT CARD TO HER, AND I ADVISED HER THAT JACINTH WOULD BE ARRESTED FOR POSSESSION OF A CONTROLLED NARCOTIC. AFTER CONCLUDING MY INVESTIGATION, I PLACED JACINTH CONTI JUNIOR UNDER ARREST, HANDCUFFED HIM BEHIND HIS BACK (DOUBLE LOCKED), AND TRANSPORTED HIM TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. BOND SET AT $5,000.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
