| Probable cause affidavit: | Enter, or attempt to enter, an occupied dwelling with the intent to commit another offense therein; to wit: On 12/07/14, the victims reported to the Citrus County Sheriffâs Office that the defenant attmpted to break into their residence. There are two windows, approximately 12âx12â, to the right of the front door. Two witnesses observed him push on the upper window, causin gth ewindow pane to fall into the living room. They identified the defendant by his first name and physical description. The residence is in a small community known as Hilltop Village. On 12/11/14, I made contact with the two witnesses. They were seperately shown a photo pack containing a photo of the defendant. They seperately identified the defandant as the person they saw pushing on the window. 0n 12/11/14, I made contact with the defendant and his daughter in the parking lot of the Winn-Dixie on Main St. He denied the allegations, stating he has been staying at a house on South St and has not been in Hilltop Village. His daughter verified that he has not left the South St residence for days. On 12/23/14, I made contact with the homeowner where the defendant had been staying. He stated he has taken the defendant to and picked up the defendant from Hilltop Village several times over the preceeding few weeks. He also stated friends of the defendant, who live in Hilltop Village, have taken him to or brought him back from HillTop Village. On 01/07/17, I located the defendant on Mercury St in Hilltop Village. He stated the owner of the property is conspiring against him because he cut down a tree for her 18 months ago and her roof was damaged during the removal of the tree. The defendant was arrested, double-locked handcuffed and transported to the County Jail without incident, where he was held in lieu of $15,000 bond per the schedule. |
