SUBMITTED BY: CRANE, RYAN N223 (FWC) (AR15-14568) DID DRIVE OR WAS IN THE ACTUAL PHYSICAL CONTROL OF A VESSEL WHILE UNDER THE INFLUENCE OF ALCOHOLIC BEVERAGES, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATUTE 327.35(1)(A). DID, BEING A PERSON UNDER THE AGE OF TWENTY-ONE YEARS, UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION AN ALCOHOLIC BEVERAGE, IN VIOLATION OF FLORIDA STATE STATUTE 562.111. ON APRIL 11, 2015 AT APPROXIMATELY 1730 HRS, I, OFC. RYAN CRANE, OF THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION (FWC) WAS ON WATER PATROL IN THE AREA OF COON GAP IN SALT RIVER CONDUCTING MANATEE SPEED ZONE ENFORCEMENT. THE CONDITIONS WERE CALM AND THIS WAS A SLOW SPEED AREA. I OBSERVED A WHITE FLATS BOAT (FL6559LC, WHITE 15 FT MAVERICK) OPERATING AT A HIGH RATE OF SPEED BEYOND THE MANATEE SPEED ZONE SIGN IN COON GAP. THE VESSEL WAS OPERATING IN A CARELESS MANNER AND APPROACHED A JET SKI AT A HIGH RATE SPEED AND TURNED AT THE LAST MINUTE TO AVOID STRIKING THE PERSONAL WATERCRAFT. AT THIS POINT I INITIATED A TRAFFIC STOP FOR THE MANATEE SPEED ZONE VIOLATION, CARELESS OPERATION, AND TO CONDUCT A BOATING SAFETY INSPECTION. I ASKED THE CAPTAIN OF THE VESSEL (JACKSON HUGHES SONNIER, DOB 5/4/96, FL DL # S-560-428-96-164-0) IF HE WAS AWARE THAT HE VIOLATED THE MANATEE SLOW SPEED ZONE. SONNIER SAID HE WAS AWARE OF THE ZONE BUT HE WAS JUST MESSING WITH HIS FRIENDS. SONNIER WAS REPLYING WITH SLURRED SPEECH. I ASKED HIM IF HIS FRIENDS WERE ON THE JET SKI AND HE SAID YES. I ASKED HIM WHY HE WAS OPERATING HIS VESSEL IN AN UNSAFE MANNER AND HE SAID HE WAS JUST HAVING FUN. AT THIS POINT I ASKED SONNIER IF HE WOULD PRODUCE HIS LIFE JACKETS, FIRE EXTINGUISHER, SOUND PRODUCING DEVICE, AND HIS VESSEL REGISTRATION. SONNIER WALKED TO THE FRONT OF THE VESSEL IN A UNSTEADY MANNER AND RETRIEVED TWO LIFE JACKETS. I ASKED FOR THE OTHER ITEMS I SPECIFIED AND HE COULD NOT REMEMBER. AT THIS POINT HE GAVE ME HIS FISHING LICENSE WHICH I DID NOT REQUEST. I ASKED HIM AGAIN FOR HIS VESSEL REGISTRATION AND HE COULD NOT FIND IT. SONNIER CONTINUED TO DISPLAY SLURRED SPEECH AND UNSTEADY MOVEMENTS. I ASKED HIM AGAIN FOR A SOUND PRODUCING DEVICE AND HE SAID HE DID NOT KNOW WHAT THAT WAS. I ASKED HIM FOR A WHISTLE AND HE DID NOT HAVE ONE. I ALSO ASKED HIM FOR HIS FIRE EXTINGUISHER AND HE SAID HE DID NOT HAVE ONE OF THOSE EITHER. I ASKED HIM IF HE HAD CAUGHT ANY FISH AND HE SAID NO THEY DID NOT. I ASKED TO LOOK IN THE TWO COOLERS AND HE LIFTED THEM OPEN AND THE FRONT COOLER CONTAINED APPROXIMATELY 12-15 BUSCH BEERS ON ICE. I ASKED TO LOOK IN A GARBAGE BAG ON THE DECK OF THE VESSEL AND HE OPENED IT IN THERE WAS DOZENS OF EMPTY BEER CANS AND A FEW EMPTY CARDBOARD 12 PACK HOLDERS. AT THIS TIME BASED ON MY EXPERIENCE AND TRAINING I BELIEVED SONNIER WAS OPERATING HIS VESSEL WHILE IMPAIRED. I REQUESTED IF HE WOULD CONSENT TO DO FIELD SOBRIETY TASKS IN ORDER TO DETERMINE IF HE COULD SAFELY OPERATE HIS VESSEL. I ASKED SONNIER TO BE SEATED ON THE FRONT OF MY VESSEL AND ASKED HIM IF HE WAS IN A COMFORTABLE, STABLE, SEATED POSITION, TO WHICH HE REPLIED âYESâ. I ASKED HIM TO REMOVE HIS SUNGLASSES AND HE DISPLAYED GLASSY, BLOODSHOT EYES. AT THIS PONT I CONDUCTED THE FOLLOWING AFLOAT FIELD SOBRIETY TASKS. THE TASKS WERE BOTH READ ALOUD AND DEMONSTRATED FOR SONNIER. I DOCUMENTED THE FOLLOWING INDICATORS OF IMPAIRMENT. HORIZONTAL GAZE NYSTAGMUS- SUBJECT COMPLAINED OF THE WIND IN HIS EYES SO I STOOD WITH THE WIND AT MY BACK TO PROVIDE WITH RELIEF FROM THE WIND. LACK OF SMOOTH PURSUIT IN BOTH RIGHT AND LEFT EYE DISTINCT AND SUSTAINED NYSTAGMUS AT MAX DEVIATION IN BOTH RIGHT AND LEFT EYE. SUBJECT MOVED HIS HEAD ONCE CONTRARY TO DIRECTIONS. FINGER TO NOSE- PUT HANDS HANDS DOWN TWICE DURING INSTRUCTIONS OPENED EYES DURING TASK HESITATED DURING THE FIRST AND FIFTH TIME I ASKED HIM TO PLACE HIS HAND ON NOSE ALL SIX TIMES DID NOT USE FINGERTIP DID NOT BRING DOWN ON SECOND TASK PALM PAT- CHPPED PAT ON TWO OCCASIONS DID NOT INCREASE SPEED SLOW, STEADY DELIBERATE PACE DURING TASK CONTRARY TO DIRECTIONS. AT THIS POINT I INFORMED SONNIER THAT WE WOULD BE PROCEEDING TO TWIN RIVERS MARINA TO COMPLETE ON SHORE FIELD SOBRIETY TASKS. I HANDED SONNIER A LIFE JACKET WHICH HE WAS UNABLE TO BUCKLE HIMSELF. I NOTIFIED DISPATCH THAT WE WOULD PROCEED TO TWIN RIVERS. WHILE ASHORE I FOUND A FLAT, LEVEL AREA OF CONCRETE WHERE SONNIER COULD SAFELY PERFORM THE FOLLOWING TASKS. WALK AND TURN USES ARMS TO BALANCE ON STEPS 9 AND THEN ON 1 AND 8 ON HIS RETURN. ONE LEG STAND SWAYS WHILE BALANCING USED ARM TO BALANCE ONE TIME PUT FOOT DOWN TWO TIMES ENDED TASK WITHOUT BEING DIRECTED, LOST BALANCE, AND SAID âOH SHITâ, AND DID NOT CONTINUE WITH TASK. AT THIS POINT AT APPROXIMATELY 1814HRS, BASED ON MY PROBABLE CAUSE, I ADVISED SONNIER HE WAS UNDER ARREST FOR OPERATING A VESSEL WHILE IMPAIRED. SONNIER WAS HANDCUFFED (DOUBLE LOCKED) AND OFC. VAN NESS (FWC) TRANSPORTED SONNIER TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL TO CITRUS COUNTY DETENTION FACILITY SONNIER WAS READ HIS IMPLIED CONSENT REQUESTING HIM TO SUBMIT TO AN APPROVED TEST OF HIS BREATH TO DETERMINE HIS BREATH ALCOHOL CONTENT. SONNIER REFUSED TO SUBMIT TO THE APPROVED TEST OF HIS BREATH. AT THIS TIME SONNIER WAS ISSUED THE FOLLOWING CITATIONS WITH A COURT DATE TO BE ASSIGNED BY THE COURT. CITATION (V368674) FOR OPERATING A VESSEL UNDER THE INFLUENCE OF ALCOHOLIC BEVERAGES, ANY CHEMICAL SUBSTANCE SET FORTH IN S. 877.111, OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893, WHEN AFFECTED TO THE EXTENT THAT THE PERSONâS NORMAL FACULTIES ARE IMPAIRED, 327.35(1) (A) CITATION (V368675) FOR CARELESS OPERATION OF A VESSEL IN VIOLATION 327.33(2) CITATION (232362C) FOR UNDERAGE POSSESSION OF ALCOHOL IN VIOLATION OF STATE STATUTE 562.111 WARNING (W720714) FOR VIOLATION OF MANATEE SPEED ZONE, NO FIRE EXTINGUISHER, NO SOUND PRODUCING DEVICE, AND NO VESSEL REGISTRATION ON BOARD.
