Probable cause affidavit: | SUBMITTED BY: HOLLOWAY, WILLIAM 0463 (AR15-14708) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF VICTIM, WAL-MART, TO WIT: ONE CAST FISHING NET VALUED AT $41.77, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 812.014(3)(A). ON 042315, I RESPONDED TO the INVERNESS WAL-MART LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY, IN REF TO A SHOPLIFTER IN CUSTODY. UPON ARRIVAL, LOSS PREVENTION AGENT JOE COMPOSTELLA ADVISED HE OBSERVED THE defendant, MS JACLYN NOVICK, SELECT A CAST FISH NET VALUED AT $41.77 AND EXIT the STORE WITHOUT ATTEMPTING TO PAY FOR IT. MR COMPOSTELLA ADVISED HE MADE CONTACT WITH THE defendant, ESCORTED HER BACK TO the LOSS PREVENTION OFFICE, AND THEN CONTACTED THIS AGENCY. MR COMPOSTELLA PROVIDED A COPY OF THE VIDES SURVEILLANCE AND ALSO A RECEIPT, WHICH WAS LATER TURNED IN TO EVIDENCE. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) IN THE FRONT and TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. ONCE AT THE JAIL, A POST MIRANDA DIGITALLY RECORDED INTERVIEW WAS CONDUCTED WHERE THE DEFENDANT ADMITTED TO THE THEFT. THE defendant STATED SHE ONLY DID IT BECAUSE SHE NEEDED MONEY TO SUPPORT HER CHILD. DUE TO the DEFENDANT NOT HAVING A PRIOR CRIMINAL RECORD, the defendant WAS RELEASED ON HER OWN RECOGNIZANCE. |
