Probable cause affidavit: | SUBMITTED BY: HOLLOWAY, WILLIAM 0463 (AR15-14871) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, THE WAL-MART STORE LOCATED AT 1936 NORTH LECANTO HIGHWAY IN LECANTO, FLORIDA, TO WIT: TWO (2) BOTTLES OF CHLORINE, THREE (3) TUBES OF CAULKING AND A DOORMAT, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY STOLEN WAS VALUED AT $100.00 OR LESS, THUS THE OFFENDER COMMITS PETIT THEFT OF THE FIRST DEGREE, AND IS IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(A). ON 050515, I RESPONDED TO THE WAL-MART STORE LOCATED AT THE ABOVE LISTED LOCATION, IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED. UPON ARRIVAL, I MADE CONTACT WITH THE LOSS PREVENTION OFFICER/COMPLAINANT, MR JAMES ROWE. HE ADVISED ME THAT AN UNKNOWN WHITE MALE WAS OBSERVED VIA CLOSED CIRCUIT VIDEO TELEVISION AS HE REMOVED APPROXIMATELY $36.55 WORTH OF CHLORINE, CAULKING AND A DOORMAT FROM THE STORE. THE COMPLAINANT FURTHER ADVISED THAT HE FOLLOWED THE SUSPECT OUT INTO THE PARKING LOT WHERE HE WAS ABLE TO OBTAIN THE SUSPECTâS FLORIDA TAG NUMBER OF, BMWH37, OFF OF HIS 2005 TOYOTA VEHICLE. ON 050615, I MADE CONTACT WITH THE DEFENDANT AT HIS RESIDENCE AND EXPLAINED THE REASON WHY I WAS THERE. THE SUSPECT, IDENTIFIED AS MR JACOB MILLER, INITIALLY DENIED THE ALLEGATIONS. I THEN PROVIDED THE SUSPECT WITH A PHOTOGRAPH SHOWING HIM LEAVING THE WAL-MART STORE WITH THE STOLEN MERCHANDISE. THE SUSPECT STATED THAT HE MUST HAVE FORGOTTEN TO PAY FOR SAID ITEMS. THE DEFENDANT WAS ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR ONE COUNT OF RETAIL PETIT THEFT (VALUE LESS THAN $100.00). AT THAT TIME, THE DEFENDANT ADVISED ME THAT SOME OF THE MERCHANDISE HE HAD TAKEN WAS IN THE BACK SEAT OF HIS VEHICLE AND ASKED ME TO RETRIEVE IT. I THEN RETRIEVED TWO (2) BOTTLES OF CHLORINE AND THREE (3) TUBES OF CAULKING FROM THE DEFENDANTâS VEHICLE. SAID ITEMS WILL BE RETURNED TO THE LECANTO WAL-MART STORE. THE DEFENDANT WAS READ HIS MIRANDA WARNINGS VIA PRE-PRINTED AGENCY CARD AND SEATED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. ONCE AT THE DETENTION FACILITY, A POST MIRANDA DIGITALLY RECORDED INTERVIEW WAS CONDUCTED WHERE THE DEFENDANT ADMITTED TO STEALING THE LISTED ITEMS FROM THE LECANTO WAL-MART STORE. THE DEFENDANT WAS THEN TURNED OVER TO DETENTION STAFF WHERE HIS BOND WAS SET AT $500.00 PER THE ABOVE LISTED CHARGE. |
