SUBMITTED BY: MALLOY, JOSHUA FHP354 (AR15-14480) DID VIOLATE STATUTE NUMBER 893.13(6)(a), WHICH STATES A person may not be in actual or constructive possession of a controlled Substance unless such controlled substance was lawfully obtained from a practitioner or pursuant to a valid prescription or order of a practitioner while acting in the course of his or her professional practice or to be in actual or constructive possession of a controlled substance except as otherwise authorized by this chapter. A person who violates this provision commits a felony of the third degree, AND DID VIOLATE STATUTE NUMBER 893.147(1), WHICH STATES Use, possession, manufacture, delivery, transportation, advertisement, or retail sale of drug paraphernalia. (1) USE OR POSSESSION OF DRUG PARAPHERNALIA.âIt is unlawful for any person to use, or to possess with intent to use, drug paraphernalia: (a) To plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, or conceal a controlled substance On 040515, at APPROXIMATELY 0813 HOURS, while conducting traffic enforcement in Citrus County on U S HIGHWAY 9, north OF WEST Chassahowitzka StREET, I observed a Black Dodge Neon (FL-BWPZ18) traveling south in the Outside lane of US-19 at a high rate of speed. I estimated that vehicle speed to be 96 mILES PER HOUR (Mph) in a posted 60 mph SPEED zone. I then activated my stalker dual radar (S/N-040853) and received target speed readout of 97 mph with an audio doppler tone consistent with that speed. The audio doppler ceased as the vehicle passed by my driverâs side window. I activated my emergency equipment and observed the black Dodge turn west on WEST CHASSAHOWITZKA StREET and travel west in the eastbound lane. The Black Dodge stopped in the eAstbound lane of WEST Chassahowitzka StREET. at that point, I approached the driverâs side window, askED the driver for HER driverâs license, and advised the reason for the stop. The driver was identified by Florida drivers license as MS Brittany Lynn Close (FL/C420072919110). she appeared to be very nervous. Ms Close would not make eye contact, she was taking very deep breathes, and her pulse was visible in her neck. During the course of the traffic stop, Ms Close started sweating and started to fan herself. SHE ADVISED SHE AND the front seat passenger were having a verbal dispute while she was driving and she planned on dropping him off at his house. The front seat passenger had his seat in a reclined position and continued to stare straight ahead as I spoke to Ms Close. I could smell a strong odor of marijuana coming from inside the vehicle. I asked thE passenger FOR his name and he immediately offered me his driverâs license. The passenger was identified by Florida driverâs license as MR Jacob Brian Robinson (FL/R152422860850). I returned to my FHP unit, requested a criminal history by FHP dispatch and asked for an additional unit to respond as backup. The criminal history revealed an extensive history, which included possession of a controlled substance and drug paraphernalia. Upon speaking with Ms Close and Mr Robinson, and based ON the verbal / visual indicators, being overly nervous, the statement that Ms Close advised that she smoked, and the strong odor OF marijuana coming from inside the vehicle, I conducted a search of the vehicle. Upon conducting a search of the vehicle, I located a blue and black backpack on the rear floorboard behind the driverâs seat within arms reach and readily accessible to Ms Close and Mr Robinson. inside the backpack were men's clothing, as well as what appeared to be a yellow Women's bathing suit top and a small women's tank top. Underneath was a white trash bag. Inside the white trash back was four separately packaged zip lock style bags containing a green leafy substance that field tested positive to be marijuana. Ms Close and Mr Robinson were placed under arrest at 0850 HOURS and transported to the Citrus County jail FOR BOOKING AND PROCESSING. THE DEFENDANTâS WERE CHARGED WITH ONE COUNT POSSESSION OF A CONTROLLED SUBSTANCE, MARIJUANA OVER 20 GRAMS, AND ONE COUNT POSSESSION OF DRUG PARAPHERNALIA.
