SUBMITTED BY: WHIRLE, BRETT 1305 (15-61870) (AR15-14935) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: MERCHANDISE OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTE 812.014(2)(C)(1). ON 051115, AT APPROXIMATELY 1602 HOURS, I WAS DISPATCHED TO THE WALMART LOCATED AT 6885 SOUTH SUNCOAST BOULEVARD, IN HOMOSASSA, IN REFERENCE TO TWO SHOP LIFTERS IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT/LOSS PREVENTION OFFICER, MS ARELYS LEON, WHO ADVISED ME THAT SHE AND HER STAFF AT WALMART HAD BEEN CLOSELY WATCHING THE TWO DEFENDANTS, MR RICHARD FLETCHER II AND MS JACQUELINE FROEHLY, THINKING THEY WERE POSSIBLY ATTEMPTING TO STEAL THE ITEMS IN THEIR TWO CARTS. SHE ADVISED ME THAT THEY FOLLOWED THEM OUT PAST THE REGISTERS AND CONFRONTED THEM AFTER THEY HAD WALKED OUT OF THE STORE, PASSING ALL POINTS OF SALE WITH TWO CARTS FULL OF MISCELLANEOUS ITEMS WITHOUT ANY ATTEMPT TO PAY FOR THESE ITEMS. MS LEON ADVISED THEY THEN ESCORTED THE DEFENDANTS TO THE LOSS PREVENTION OFFICE AT THE FRONT OF THE STORE, CONTACTED LAW ENFORCEMENT AND AWAITED OUR ARRIVAL. I READ THE DEFENDANTS THEIR MIRANDA WARNING VIA AGENCY PREPRINTED CARD. THE DEFENDANTS ADVISED THAT THEY UNDERSTOOD THEIR RIGHTS AND STATED THAT THEY WOULD SPEAK WITH ME AT THIS TIME. WHILE SPEAKING WITH BOTH DEFENDANTS, I ASKED THEM IF THEY HAD TAKEN THESE ITEMS WITH THE INTENT TO NOT PAY FOR THEM OR BRING THEM BACK, TO WHICH THEY ADVISED YES THEY TOOK THESE ITEMS AS THEY WERE HOMELESS AND HAD NO INTENTION OF PAYING FOR THEM OR BRINGING THEM BACK. THE DEFENDANTS WERE PLACED UNDER ARREST, HANDCUFFED, BEHIND THEIR BACKS, (DOUBLE LOCKED), SEAT BELTED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTS' BOND WAS SET AT $2,000.00 EACH, PER THE BOND SCHEDULE. THE COMPLAINANT ADVISED ME THAT A COPY OF THE SURVEILLANCE FOOTAGE WOULD BE AVAILABLE ON 051215, WHICH I ADVISED HER WOULD BE PICKED UP AT A LATER DATE. I WAS ALSO PROVIDED A RECEIPT LISTING THE ITEMS TAKEN WHICH WILL BE TUNED IN TO RECORDS WITH THE CASE NUMBER WRITTEN ON TO. |
