Probable cause affidavit: PARSONS, TRAVIS 0358 (AR 15-14266) (15-34625) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B); AND DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 031615, A LAWFUL SEARCH WARRANT WAS EXECUTED AT 1820 EAST EVELYN STREET, HERNANDO. UPON ARRIVAL, DEPUTY SMITH (0292) MADE CONTACT WITH THE RESIDENTS TO INCLUDE, MR LARRY RODDENBERRY, MS BENITA HARDER, MS BENITA BUNDY, AND MR JADIN HALE. THE WARRANT WAS READ TO THE RESIDENTS AND A THROUGH SEARCH OF THE RESIDENCE WAS CONDUCTED. WHILE THE SEARCH OF THE RESIDENCE WAS OCCURRING, DEPUTY SMITH INTERVIEWED THE DEFENDANTS. AN INTERVIEW WAS CONDUCTED WITH DEFENDANT RODDENBERRY. HE WAS READ MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. DEPUTY SMITH ASKED HIM IF HE WISHED TO SPEAK WITH HIM AT THIS TIME, TO WHICH HE ADVISED THAT HE DID. DEFENDANT RODDENBERRY WAS VERY STRAIGHT FORWARD AND HONEST THROUGHOUT THIS INTERVIEW. HE ADVISED WE WOULD FIND THE FOLLOWING ITEMS IN HIS ROOM; A SMALL PLASTIC BAGGIE CONTAINING METHAMPHETAMINE, STRAWS, AND SYRINGES. HE FURTHER ADVISED HE USES THE SYRINGES FOR INSULIN BUT HE ALSO USES THEM TO SHOOT METHAMPHETAMINE. DURING THE INTERVIEW, HE TOOK DEPUTY SMITH IN TO THE ROOM AND POINTED THESE ITEMS OUT. AN INTERVIEW WAS CONDUCTED WITH DEFENDANT HARDER. SHE WAS READ MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF SHE UNDERSTOOD HER RIGHTS, TO WHICH SHE REPLIED THAT SHE DID. DEPUTY SMITH THEN ASKED HER IF SHE WISHED TO SPEAK WITH HIM AT THIS TIME, TO WHICH SHE ADVISED THAT SHE DID. SHE ADVISED THAT SHE AND MR RODDENBERRY WERE NOT SELLING, JUST USING. SHE ADVISED THERE WOULD BE MARIJUANA ON HER HEADBOARD IN HER AND RODDENBERRY'S ROOM, ALONG WITH HER MARIJUANA PIPE. WHEN ASKED WHEN SHE LAST USED METHAMPHETAMINE, SHE ADVISED SHE SHOT UP YESTERDAY. SHE ADVISED THE METHAMPHETAMINE CAME FROM A BAGGIE, BUT SHE WAS NOT SURE HOW MUCH METHAMPHETAMINE WAS LEFT IN IT. AN INTERVIEW WAS CONDUCTED WITH DEFENDANT BUNDY. SHE WAS READ MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF SHE UNDERSTOOD HER RIGHTS, TO WHICH SHE REPLIED THAT SHE DID. DEPUTY SMITH THEN ASKED HER IF SHE WISHED TO SPEAK WITH HIM AT THIS TIME, TO WHICH SHE ADVISED THAT SHE DID. SHE STATED THE ONLY THING ILLEGAL THAT WE WOULD FIND IN HER BEDROOM WAS MARIJUANA AND MARIJUANA PIPES. SHE ADVISED THAT SHE AND HER BOYFRIEND/MR HALE, ONLY SMOKE WEED. AN INTERVIEW WAS CONDUCTED WITH DEFENDANT HALE. HE WAS READ MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. DEPUTY SMITH ASKED HIM IF HE WISHED TO SPEAK WITH HIM AT THIS TIME, TO WHICH HE ADVISED THAT HE DID. HE ALSO CONFIRMED WHAT MS BUNDY ADVISED; THE ONLY THING WE WOULD FIND IN THEIR BEDROOM WERE PIPES AND MARIJUANA. UPON MAKING CONTACT WITH TACTICAL IMPACT UNIT MEMBERS WHO CONDUCTED THE SEARCH, IN DEFENDANT RODDENBERRY AND DEFENDANT HARDER'S ROOM, WE LOCATED THE METHAMPHETAMINE, STRAWS USED TO SNORT METHAMPHETAMINE, SYRINGES, AND EMPTY BAGS. THE MARIJUANA AND MARIJUANA PIPE THAT DEFENDANT HARDER ADMITTED TO, WERE ALSO LOCATED. IN THE REAR BEDROOM, WHERE DEFENDANT BUNDY AND DEFENDANT HALE WERE STAYING, WE LOCATED A WOOD BOX WHICH CONTAINED MARIJUANA AND MARIJUANA PIPES. IN THE BOTTOM OF THE BOX, WE ALSO LOCATED A METHAMPHETAMINE SMOKING BOAT, PILL, AND CUT STRAWS USED TO SNORT METHAMPHETAMINE. ALL DEFENDANTS WERE PLACED UNDER ARREST. THE DEFENDANTS WERE HANDCUFFED (DOUBLE LOCKED) BEHIND THEIR BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT. THE DEFENDANT WAS RELEASED ON HIS OWN RECOGNIZANCE AND RELEASED AT THE SCENE.
