SUBMITTED BY: DOYLE, CHAD 0438 (AR09109722) did unlawfully and knowingly obtain, use or endeavor to obtain or use the property of THE VICTIM to-wit: A FORD F-150 PICK UP TRUCK, by exercising control over said property with the intent to either temporarily or permanently deprive THE VICTIM of a right to the property or a benefit thereof, or did appropriate the property, to own use or the use of any person not entitled thereto, and knew or should have known that said property was stolen, in violation of Florida Statutes 812.014(1) and 812.014(2)(c); DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN REFERENCE TO DRIVING UNDER THE INFLUENCE (DUI), IN VIOLATION OF FLORIDA STATE STATUE 322.34(2)(A) ON 062709, I RESPONDED TO BACK DEPUTY TACKETT UP AT THE MERCANTILE BANK IN the CITY OF CRYSTAL RIVER. UPON MAKIN CONTACT WITH DEPUTY TACKETT, HE ADVISED THAT HE HAD THE DEFENDANT, MR JAMES BOYINGTON, STOPPED FOR RUNNING A RED LIGHT (APPROXIMATELY 15 MINUTES EARLIER, WE RECEIVED A CALL IN REFERENCE TO A RECKLESS DRIVER MATCHING THE DEFENDANT'S DESCRIPTION DRIVING NORTH FROM HOMOSASSA). DEPUTY TACKETT STATED THAT HE COULD SMELL A STRONG ODOR OF ALCOHOL EMANATING FROM the DEFENDANT'S PERSON, and THAT AFTER HE RAN THE DEFENDANT'S DRIVER'S LICENSE; HE DISCOVERED THAT THE DEFENDANT'S DRIVER'S LICENSE WAS REVOKED FOR SEVEN YEARS REFERENCE DRIVING UNDER THE INFLUENCE (DUI). THE DEFENDANT HAD SEVERAL REVOCATIONS IN HIS DRIVER'S LICENSE HISTORY, IN REFERENCE TO DUI. DEPUTY TACKETT WAS THEN PREPARING TWO FLORIDA UNIFORM TRAFFIC CITATIONS (UTC) FOR THE DEFENDANT, IN REFERENCE TO KNOWINGLY DRIVING WHILE LICENSE SUSPENDED OR REVOKED (DWLSR), AND WHILE IN THE POSSESSION OF AN OPEN CONTAINER. IT WAS DETERMINED AT this TIME THAT THE DEFENDANT WAS GOING TO BE PLACED UNDER ARREST FOR DWLSR, I THEN RETURNED TO MY PATROL VEHICLE TO PREPARE A VEHICLE STORAGE RECEIPT, AND UPON RUNNING THE TAG ON the VEHICLE, IT WAS DISCOVERED THAT THERE WAS A DELAYED ENTRY FROM the PASCO COUNTY SHERIFF'S OFFICE IN REFERENCE TO THE VEHICLE BEING STOLEN WITHIN THE LAST HOUR. AT THIS TIME, the DEFENDANT WAS TAKEN IN TO CUSTODY, HANDCUFFED (DOUBLE-LOCKED) BEHIND HIS BACK AND SECURED IN the REAR SEAT OF MY PATROL VEHICLE. IT WAS CONFIRMED THROUGH PASCO COUNTY that THE VEHICLE WAS STOLEN REFERENCE THEIR CASE NUMBER 09-37977. THE VEHICLE WAS THEN TOWED BY ADAM'S TOWING, AND THE DEFENDANT WAS THEN TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT'S BOND FOR BEING IN POSSESSION OF A STOLEN MOTOR VEHICLE WAS $2,000.00, AND OPERATING A MOTOR VEHICLE KNOWINGLY WHILE HIS DRIVER'S LICENSE WAS SUSPENDED OR REVOKED, IN REFERENCE TO DUI WAS $10,000.00; BOTH IN ACCORDANCE WITH THE BOND SCHEDULE. THE DEFENDANT WAS ALSO ISSUED A WRITTEN WARNING, NUMBER 255375B FOR RUNNING A RED LIGHT. HE WAS ISSUED UTC, NUMBER 2409-FIR FOR DWLS KNOWINGLY WITH A MANDATORY COURT APPEARANCE ON 071609 AT 1300 HOURS AT THE CITRUS COUNTY COURT HOUSE. HE WAS ALSO ISSUED UTC, NUMBER 2410-FIR FOR OPEN CONTAINER OF ALCOHOL, with A $151.00 FINE, PAYABLE WITHIN 30 DAYS TO THE CITRUS COUNTY CLERK OF THE COURT. *NOT-EXEMPT* |
