SUBMITTED BY: DUHART, MICHELE 0535 (AR07004553) did unlawfully take a person or the custody of the victim, certain property of value, to wit: SEVEN HUNDRED THIRTEEN DOLLARS IN united states currency, with the intent to temporarily or permanently deprive the victim of a right to the property of benefit thereof , and in the course thereof, utilized force, violence, assault or a put the said victim in fear, in violation of florida state statute 812.13(2)c ON 081707, I WAS disPatCHED TO A ROBBERY AT THE CITGO GAS STATION LOCATED AT 2313 WEST MAIN STREET IN INVERNESS. UPON ARRIVAL, I OBSERVED THE VICTIM who is AN EMPLOYEE OF THE CITGO gas station, UNLOCK THE STORE FRONT DOOR TO ALLOW THIS DEPUTY ACCESS. sHE ADVISED THAT THE DEFENDANT HAD ENTERED THE STORE ON 081707 AROUND 1830 HOURS AND ASKED HER IF SHE SOLD FOUR-PACKS OF BEER. THE VICTIM REPLIED NO. THE DEFENDANT AND THE VICTIM THEN ENGAGED IN A MUTUAL CONVERSATION ABOUT MUSIC AND EVERY-DAY PROBLEMS. THE DEFENDANT EXITED THE STORE AND RETURNED AGAIN AROUND 2245 HOURS, AT WHICH TIME HE AGAIN ENGAGED THE VICTIM IN CONVERSATION, ASKING HOW HER DAY WENT. tHE defendant ASKED THE VICTIM IF HE COULD BORROW FIVE DOLLARS, to WHICH THE VICTIM TOLD the defendant SHE HAD NO MONEY. HE THEN WALKED OUT OF THE STORE, RETURNINg IMMEDIATELY, REQUESTING FIVE DOLLARS FROM THE REGISTER. THE VICTIM REPLIED SHE COULD NOT DO THAT, TO WHICH THE DEFENDANT SAID OKAY AND EXITED THE STORE AGAIN. THE DEFENDANT IMMEDIATELY RETURNED TO THE STORE AND SAID TO THE VICTIM "OKAY, THEN GIVE ME ALL THE MONEY." AT THAT TIME, THE VICTIM ASKED THE DEFENDANT "Are you serious?" the defendant began to reach into his pocket and the victim, fearing for her safety and fearing the defendant could possibly have a firearm or other weapon, opened the register and removed the cash from the register. the victim grabbed the twenty dollar bills and the ten dollar bills in one hand and was attempting to grab the five dollar bills and the one dollars bills when the defendant snatched the twenty's and tens from the victim's hand. the defendant then exited the store. the victim observed the defendant travel west on main street. when he cleared the citgo parking lot, the victim secured the exterior door and turned off the outside lights. the defendant was located and detained by deputy mcewen, at which time lieutenant (lt) vick transported the victim to deputy mcewen's location where the victim positively identified the defendant as the person who had just robbed her. the defendant was arrested, handcuffed (double locked) behind his back and secured in the rear seat of deputy mcewen's patrol vehicle. detective atchison responded to our location. he read the defendant his miranda warnings via card, to which the defendant said he understood his rights and would speak with deputies. the defendant only admitted to being in the citgo store and having a conversation with the victim. the defendant was transported to the citrus county detention facility for further processing. upon arrival, the defendant was charged with strong-arm robbery with bond set at $10,000.00, per the bond schedule. *NOT-EXEMPT* |
