Probable cause affidavit: SUBMITTED BY: GREATREX, ROBERT 0287 (AR09106992) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. ON 010209 AT APPROXIMATELY 1300 HOURS, I WAS ADVISED BY DISPATCH THAT A PRIVATE CITIZEN HAD OBSERVED AN OLDER WHITE MALE IN the PARKING LOT OF ROC'S 491 BAR AND GRILL IN BEVERLY HILLS. THE COMPLAINANT STATED THAT THE WHITE MALE WAS STUMBLING ACROSS THE PARKING LOT AS IF HE HAD BEEN DRINKING HEAVILY. THE MALE THEN LEFT THE AREA DRIVING STATION WAGON SILVER IN COLOR. THE COMPLAINANT FURTHER REPORTED that SHE FOLLOWED THE STATION WAGON NORTHBOUND FROM ROC'S BAR. the COMPLAINANT ADVISED DISPATCH THAT THE STATION WAGON HAD MADE A RIGHT-HAND TURN INTO THE PARKING LOT AT THE VILLAGE INN RESTAURANT WHERE HE PARKED HIS VEHICLE. UPON MY ARRIVAL ON SCENE, I DID SEE WHERE THE STATION WAGON WAS PARKED IN A PARKING SPACE. AS I APPROACHED THE VEHICLE, I IDENTIFIED THE VEHICLE'S TAG NUMBER AS B91-3PI. AS I MADE CONTACT WITH THE WHITE MALE DRIVER, THE KEYS WERE IN the IGNITION WITH THE ENGINE RUNNING and THE VEHICLE WAS STILL IN DRIVE. THE WHITE MALE DRIVER APPEARED TO BE PASSED OUT DUE TO HIS HEAD WAS FACING DOWN. AS I AWOKE THE DRIVER AND OPENED THE DRIVER'S SIDE DOOR, I NOTICED A STRONG ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM HIS PERSON. I WAS ALSO ABLE TO OBSERVE SEVERAL MILLER LITE BEER CANS IN THE PASSENGERS SIDE FLOORBOARD OF THE VEHICLE. THE DRIVER WAS ASKED FOR HIS IDENTIFICATION, TO WHICH HE WAS NOT ABLE TO FIND. THE DRIVER OF VEHICLE WAS OBSERVED TO HAVE VERY SLURRED SPEECH, BLOODSHOT EYES AND APPEARED VERY DISORIENTED. SINCE the DRIVER WAS NOT ABLE TO LOCATE ANY IDENTIFICATION, I THEN RETURNED TO MY PATROL VEHICLE WHERE I RAN THE LICENSE PLATE. A COMPUTER CHECK REVEALED THE NAME JAMES CANNON. HE WAS THEN RAN IN D.A.V.I.D. SYSTEM AND AT THAT TIME I WAS ABLE TO IDENTIFY HIM FROM A D.A.V.I.D. PHOTO AND HIS NAME WAS JAMES DAVID CANNON (DEFENDANT). I THEN RETURNED TO THE DRIVER'S SIDE OF THE VEHICLE AND ADVISED MR CANNON TO STEP OUT OF VEHICLE, TO WHICH HE COMPLIED. MR CANNON WAS OBSERVED TO BE VERY UNSTEADY ON HIS FEET AND NOT ABLE TO STAND IN ONE SPOT WITHOUT FALLING. I ASSISTED MR CANNON TO THE FRONT OF MY PATROL VEHICLE AND LEANED HIM UP AGAINST CAR TO PREVENT HIM FROM FALLING. AT THAT TIME, I ATTEMPTED TO SEARCH FOR MR CANNON'S DRIVER'S LICENSE AND WAS ALSO UNABLE TO LOCATE HIS LICENSE. HE ADVISED HE HAD BEEN DRINKING ALL LAST NIGHT BUT HE Had NOT BEEN DRINKING THIS MORNING, EXCEPT FOR LAST NIGHT. HE THEN STATED HE HAD BEEN DRINKING AT ROC'S BAR TODAY. IT SHOULD BE NOTED, WHILE SPEAKING WITH MR CANNON I NOTICED AN SMALL ABRASION APPROXIMATELY ONE QUARTER INCH IN LENGTH ON HIS FOREHEAD JUST ABOVE HIS LEFT EYE AND HE WAS NOT ABLE TO EXPLAIN WHAT HAPPENED. I THEN ADVISED MR CANNON THAT I WAS GOING TO HAVE HIM PERFORM SOME FIELD SOBRIETY TASKS, AT WHICH TIME, MR CANNON STATED HE WOULD NOT BE ABLE TO PERFORM THEM and REFUSED. MR CANNON WAS ADVISED HE WOULD BE PLACED UNDER ARREST FOR DRIVING UNDER INFLUENCE (DUI). HE WAS THEN READ IMPLIED CONSENT, TO WHICH HE ADVISED HE would CONSENT TO A BREATHALYZER TEST. DUE TO MY OBSERVATION OF HIS BEHAVIOR AND THE STRONG ODOR OF AN ALCOHOLIC BEVERAGE ON THIS PERSON AND THE ALCOHOL THAT WAS OBSERVED INSIDE THE DEFENDANT'S VEHICLE, THE DEFENDANT WAS PLACED UNDER ARREST. HE WAS HANDCUFFED DOUBLE LOCKED BEHIND HIS BACK AND SECURED IN the REAR SEAT OF MY PATROL VEHICLE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. PRIOR TO LEAVING THE SCENE THE DEFENDANT'S VEHICLE WAS SECURED AND LEFT AT SCENE. ONCE AT THE DETENTION FACILITY, THE DEFENDANT WAS TAKEN TO the INTOXLYZER ROOM WHERE JAIL EMPLOYEES READ THE DEFENDANT'S MIRANDA WARNING AND ATTEMPTED TO HAVE HIM PERFORM THE TEST, WHICH HE WAS NOT ABLE TO DO, DUE TO his INTOXICATED STATE. THE JAIL EMPLOYEE COMPLETED A REFUSAL FORM FOR THE DEFENDANT. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. MR CANNON WAS ISSUED TRAFFIC CITATION NUMBER 9515-EVX FOR FAILURE TO EXHIBIT DRIVERS LICENSE UPON COMMAND AND FLORIDA UNIFORM TRAFFIC CITATION NUMBER 030918-W, WITH MANDATORY COURT DATE SET AT 012209 AT 1300 HOURS AT the CITRUS COUNTY COURTHOUSE. THE REFUSAL PAPERWORK WILL BE TURNED INTO RECORDS. *NOT-EXEMPT*
