SUBMITTED By: MULLINS, MARVIN 0493 (AR11121094) DID UNLAWFULLY AND INTENTIONALLY THREATEN BY WORD OR ACT TO DO VIOLENCE TO THE PERSON OF THE VICTIM, COUPLED WITH AN APPARENT ABILITY TO CARRY OUT SAID THREAT, AND UTILIZED A DEADLY WEAPON, TO WIT: A TEN TO TWELVE INCH FILLET KNIFE, AND DID AN ACT OR ACTS WHICH CREATED A WELL-FOUNDED FEAR IN THE VICTIM THAT SUCH VIOLENCE WAS IMMINENT, IN VIOLATION OF FLORIDA STATE STATUTE 784.021(1)(B). ON 060511 AT APPROXIMATELY 0500 HOURS, I WAS DISPATCHED TO CITRUS MEMORIAL HOSPITAL TO RELIEVE DEPUTY CUTLIP. UPON ARRIVAL, DEPUTY CUTLIP ADVISED HE WAS INVESTIGATING A PHYSICAL ALTERCATION THAT occurred AT MUTUAL MINDS OFF OF 581 IN INVERNESS AND THE DEFENDANT, MR JAMES DANIEL CARTER, WAS BEING SEEN BY HOSPITAL STAFF. DEPUTY CUTLIP ADVISED THAT WHILE AT MUTUAL MINDS THE DEFENDANT WAS EXTREMELY INTOXICATED AND BECAME INVOLVED IN A VERBAL ALTERCATION WITH THE VICTIM, MR THEODORE SHARPE. DURING THE ALTERCATION THE DEFENDANT GRABBED A TEN TO TWELVE INCH FILLET KNIFE OUT OF HIS TACKLE BOX AND STATED, "I AM GOING TO SLIT YOUR THROAT AND KILL EVERYONE ELSE OUT HERE." DEPUTY CUTLIP ADVISED THAT AT THAT TIME, VICTIM SHARPE WAS ABLE TO separate HIMSELF FROM THE DEFENDANT BECAUSE HE WAS IN FEAR FOR HIS LIFE. DEPUTY CUTLIP RECEIVED SEVERAL SWORN WRITTEN STATEMENTS WHICH CORROBORATED THE VICTIM'S STATEMENT. AT APPROXIMATELY 0550 HOURS, I WAS ADVISED THAT THE DEFENDANT WAS BEING MEDICALLY DISCHARGED. AT THAT TIME, I ADVISED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST FOR AGGRAVATED ASSAULT WITH A DEADLY WEAPON AND I PLACED HIM IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK AND WALKED HIM TO MY PATROL VEHICLE. I THEN PLACED HIM IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED HIM TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE HIS BOND WAS SET AT $5,000.00 PER THE BOND SCHEDULE. DEFENDANT CARTER WAS ORIGINALLY TAKEN TO THE HOSPITAL because HE FELL DOWN A CLIFF AT MUTUAL MINDS, HOWEVER, THROUGH THE INVESTIGATION BY DEPUTY CUTLIP IT WAS DETERMINED THAT HE FELL BECAUSE HE WAS EXTREMELY INTOXICATED.
