Probable cause affidavit: | SUBMITTED By: CAREY, SAMUEL 0753 (AR12-2617 CASE: 159202) did unlawfully traffic in or endeavor to traffic in property that THE DEFENDANT knew or should have known was stolen, to-wit: A PUSH LAWN MOWER AND FOUR WHEELER, the property of THE VICTIM, in violation of Florida Statute 812.019(1). ON 090512 I WAS DISPATCHED TO 9622 WEST SANDRA STREET IN CRYSTAL RIVER, IN REFERENCE TO THE THEFT OF A FOUR WHEELER AND LAWN MOWER WHICH HAD ALREADY OCCURRED. UPON ARRIVAL I MADE CONTACT WITH THE VICTIM, MS ELIZABETH TYSON. SHE ADVISED THAT AT APPROXIMATELY 0330 HOURS SHE HEARD SOMETHING OUTSIDE OF HER RESIDENCE WHICH SHE ASSUMED WERE RACCOONS GOING THROUGH HER GARBAGE. MS TYSON THEN TURNED ON THE EXTERIOR LIGHTS OF HER RESIDENCE AND LOOKED OUTSIDE, HOWEVER, SHE DID NOT OBSERVE ANYTHING. SHE STATED WHEN SHE WOKE UP SHE OBSERVED HER PUSH LAWN MOWER AND FOUR WHEELER TO BE MISSING. THE VICTIM DESCRIBED THE FOUR WHEELER AS A ZONGSHEN DESSERT WITH A TAN CAMOUFLAGE COLOR PATTERN AND COULD NOT PROVIDE A SERIAL NUMBER. SHE ALSO DESCRIBED THE LAWN MOWER AS A PUSH STYLE RED MOWER WITH A BROKEN PULL STRING AND COULD PROVIDE NO FURTHER INFORMATION. AT THAT TIME I PROVIDED THE VICTIM WITH AN AGENCY CASE CARD BEARING MY NAME AND THIS CASE NUMBER. I ADVISED HER TO CONTACT THIS AGENCY WITH ANY ADDITIONAL INFORMATION OR QUESTIONS REGARDING THIS CASE. I LATER RECEIVED A TELEPHONE CALL FROM THE VICTIM ADVISING THAT SHE FOUND HER FOUR WHEELER AND LAWN MOWER. SHE FURTHER STATED SHE HAD CONFRONTED THE DEFENDANT, MR JAMES DAVIS IV. AT THAT TIME I RESPONDED TO 9724 WEST SANDRA STREET IN CRYSTAL RIVER. UPON ARRIVAL I OBSERVED THE VICTIM STANDING IN THE ROADWAY WITH THE DEFENDANT SITTING ON THE GROUND CROSS LEGGED. THE VICTIM THEN POINTED TO THE SIDE OF THE DEFENDANTâS RESIDENCE WHERE YOU COULD CLEARLY SEE THE RED LAWN MOWER AND THE CAMOUFLAGE FOUR WHEELER FROM THE ROAD. I THEN ASKED THE DEFENDANT IF HE RESIDED AT THIS RESIDENCE AND HE STATED YES. THE DEFENDANT THEN PROCEEDED TO TELL ME HOW HE HAD ACQUIRED THE ABOVE LISTED PROPERTY AT WHICH TIME I TOLD HIM TO STOP. AT THAT TIME I RETRIEVED AN AGENCY ISSUED MIRANDA CARD FROM MY PATROL VEHICLE AND ADVISED THE DEFENDANT OF HIS RIGHTS. THE DEFENDANT STATED THAT HE UNDERSTOOD AND WISHED TO SPEAK WITH ME. I ASKED THE DEFENDANT HOW OLD HE WAS TO WHICH HE REPLIED 33. I THEN INQUIRED IF HE WAS ON ANY ILLEGAL NARCOTICS OR PRESCRIPTION MEDICATIONS WHERE HE ADVISED NO. I INQUIRED IF HE WAS OF CLEAR MIND WHERE HE STATED YES. I THEN ASKED THE DEFENDANT HOW HE CAME TO BE IN POSSESSION OF THE PROPERTY. HE ADVISED THAT HE HAD PURCHASED THE STOLEN FOUR WHEELER AND LAWN MOWER AT 0345 HOURS. THE DEFENDANT THEN STATED THAT HE PAID $350.00 FOR BOTH THE FOUR WHEELER AND THE LAWN MOWER AND ADVISED HE BOUGHT THE ITEMS FROM HIS NEXT DOOR NEIGHBOR AND POINTED TO THE RESIDENCE NEXT TO HIS. I OBSERVED THAT RESIDENCE TO BE VACANT WITH NO ONE LIVING IN THE RESIDENCE. AT THAT TIME THE VICTIM ADVISED THAT RESIDENCE HAD BEEN VACANT FOR OVER SIX MONTHS. THE DEFENDANT THEN STATED THAT HE HAD PURCHASED THE ITEMS FROM A BLACK MALE SUBJECT WITH BRAIDED SHOULDER LENGTH HAIR. HE STATED THAT THIS MALE WAS A CRACK HEAD DRUG DEALER WHO GOES BY THE NICKNAME OF âXBARâ. THE DEFENDANT WAS UNABLE TO PROVIDE ME WITH ANY INFORMATION REFERENCE TO XBAR. I ASKED HIM IF HE HAD PURCHASED ANY ADDITIONAL ITEMS FROM XBAR TO WHICH HE STATED HE HAD. HE THEN TOOK ME INSIDE HIS RESIDENCE AND SHOWED ME A PANASONIC LCD PROJECTOR BEARING SERIAL NUMBER SB5350387. I RAN THIS INFORMATION THROUGH TELETYPE TO SEE IF IT WAS STOLEN WHERE TELETYPE ADVISED THEY HAD NO RECORD OF IT. I THEN ASKED THE DEFENDANT IF HE KNEW THE LAWN MOWER AND FOUR WHEELER WERE STOLEN TO WHICH HE STATED NO. I THEN ASKED HIM IF HE SHOULD HAVE KNOWN THAT THE ITEMS WERE STOLEN WHERE HE RESPONDED YES. I ASKED HIM IF IT SEEMED NORMAL TO PURCHASE OBJECTS AT A REDUCED VALUE AT 0345 HOURS FROM A BLACK MALE DRUG DEALER WHERE HE THEN ADVISED THAT HE WOULD LIKE AN ATTORNEY. AT THAT TIME I PLACED THE DEFENDANT UNDER ARREST WHERE HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE. AT THAT TIME I REQUESTED THAT THE VICTIM COMPLETE AND SIGN A SWORN WRITTEN STATEMENT DETAILING HOW SHE FOUND THE FOUR WHEELER AND THE LAWN MOWER. I PHOTOGRAPHED THE STOLEN OBJECTS AND ADVISED THE VICTIM SHE COULD TAKE HER OBJECTS HOME. AT THAT TIME I TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE HIS BOND WAS SET AT $5,000.00 PER THE BOND SCHEDULE. |
