| Probable cause affidavit: | SUBMITTED BY: CROSNOE, ROBERT 0234 (AR14-13189) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WAL MART, TO WIT: A PACK OF REFILL SHAVING RAZORS , SAID PROPERTY BEING OF A VALUE OF $39.19, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(a). ON 121714 AT APPROXIMATELY 1700 HOURS, I WAS DISPATCHED TO WAL MART SUPERCENTER, LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY, IN INVERNESS, IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED AND THE SUSPECT WAS IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH LOSS PREVENTION OFFICER, MR JOSEPH COMPOSTELLA, WHO PROVIDED ME WITH A WRITTEN STATEMENT AND A DVD RECORDING OF THE THEFT. MR COMPOSTELLA STATED THAT HE OBSERVED THE DEFENDANT, MR JAMES GUNNELS, ENTER THE STORE AND START ACTING IN A SUSPICIOUS MANNER. MR COMPOSTELLA STARTED SURVEILLANCE ON MR GUNNELS, WHERE HE OBSERVED HIM SELECT SOME RAZOR REFILLS, PROCEED TO THE SPORTING GOOD SECTION OF THE STORE, AND CONCEAL THE RAZORS IN HIS POCKET. MR GUNNELS THEN PROCEEDED TO THE FRONT CHECK OUT AREA AND WENT TO THE RETURN DEPARTMENT, WHERE HE REMOVED THE RAZORS FROM HIS POCKET AND GOT A REFUND FOR $39.19. THE REFUND WAS PLACED ON A WAL MART GIFT CARD. MR GUNNELS THEN REENTERED THE STORE, WHERE HE PURCHASED FOOD FROM THE DELI, A TWELVE PACK OF BEER, ONE POWERADE, AND ONE PACK OF CIGARETTES, TO WHICH HE USED THE WAL MART GIFT CARD TO PAY FOR THE ITEMS. MR COMPOSTELLA WAS ABLE TO DETAIN MR GUNNELS AS HE EXITED THE STORE. MR GUNNELS WAS VERY COOPERATIVE WITH THE LOSS PREVENTION STAFF AND ME. I PROVIDED WAL MART WITH A CASE NUMBER. AT THAT TIME, I TRANSPORTED MR GUNNELS TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING, WHERE HIS BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. ALL PAPERWORK WAS LATER TURNED IN TO RECORDS. |
