SUBMITTED BY: BRIGGS, RICHARD 0089 (AR10114374) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 041810, AT APPROXIMATELY 1859 HOURS, WHILE ON ROUTINE PATROL TRAVELING WESTBOUND ON HIGHWAY 44 IN THE LEFT LANE, AND CONDUCTING MOVING RADAR IN THE AREA OF SHAD TERRACE, I OBSERVED THE DEFENDANT TRAVELING EASTBOUND IN THE LEFT LANE AT WHAT APPEARED TO BE IN EXCESS OF THE POSTED SPEED LIMIT. AS THE OFFENDER VEHICLE APPROACHED MY VEHICLE, A CLEAR TONE FROM THE AUDIO DOPPLER OF THE RADAR SOUNDED REVEALING THAT THE DEFENDANT WAS IN EXCESS OF THE POSTED SPEED LIMIT WITH A SPEED OF 63 MILES PER HOUR IN A POSTED 55 MILES PER HOUR ZONE. AT THAT TIME, I TURNED MY PATROL VEHICLE AROUND AND ACTIVATED MY OVERHEAD LIGHTS AND SIRENS TO CONDUCT A TRAFFIC STOP. THE DEFENDANT THEN CAME TO A STOP IN THE AREA OF EDEN GARDENS. AT THAT TIME, I MADE CONTACT WITH THE DEFENDANT AT HIS VEHICLE AND REQUESTED HIS DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE. THE DEFENDANT WAS NOT ABLE TO PROVIDE ME WITH HIS DRIVER'S LICENSE AND I AGAIN ASKED HIM FOR HIS DRIVER'S LICENSE. THE DEFENDANT THEN ADVISED ME that HE DID NOT HAVE A DRIVER'S LICENSE, AND that IT WAS SUSPENDED. AT THAT TIME I OBTAINED HIS NAME AND DATE OF BIRTH AND RETURNED TO MY PATROL VEHICLE TO CONDUCT A COMPUTER DRIVER'S LICENSE CHECK. THIS REVEALED THAT THE DEFENDANT'S DRIVER'S LICENSE HAD BEEN SUSPENDED INDEFINITELY AS OF 122005 FOR FAILURE TO PAY FINANCIAL OBLIGATIONS, SUSPENDED INDEFINITELY ON 053006 FOR FAILURE TO PAY FINANCIAL OBLIGATIONS, AND SUSPENDED INDEFINITELY TWO TIMES ON 040907 FOR FAILURE TO PAY FINANCIAL OBLIGATIONS. AFTER RECEIVING THIS information, I CONDUCTED A DRIVER'S LICENSE CHECK VIA DISPATCH, WHO THEN ADVISED THAT THE DEFENDANT'S LICENSE HAD BEEN SUSPENDED ACCORDING TO THE DATES LISTED ABOVE. AFTER RECEIVING THIS INFORMATION, I MADE CONTACT WITH THE DEFENDANT AT HIS VEHICLE AND HAD HIM STEP OUT. I THEN PLACED HIM UNDER ARREST FOR DRIVING WHILE LICENSE WAS SUSPENDED KNOWINGLY. PRIOR TO LEAVING THE SCENE, THE DEFENDANT REQUESTED THAT HIS VEHICLE BE TURNED OVER TO HIS GIRLFRIEND, JACKIE CARUSO. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION CENTER FOR BOOKING AND PROCESSING AND CHARGED WITH DRIVING WHILE LICENSE WAS SUSPENDED KNOWINGLY. HIS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION, 9254EVX (4) FOR VIOLATION OF TRAFFIC CONTROL DEVICE WHILE DRIVING 63/55, WITH A $166.00 FINE PAYABLE WITHIN 30 DAYS AT THE CITRUS COUNTY COURTHOUSE, ISSUED FLORIDA UNIFORM TRAFFIC CITATION, 9255EVX(5) FOR DRIVING WHILE LICENSE WAS SUSPENDED KNOWINGLY, WITH A MANDATORY COURT DATE OF 050610 AT 1300 HOURS AT THE CITRUS COUNTY COURT HOUSE. HE WAS ALSO ISSUED WARNING, 290167B, FOR NOT HAVING HIS HEADLIGHTS ON IN THE RAIN. *NOT-EXEMPT* |
