Probable cause affidavit: SUBMITTED BY: MCLAUGHLIN, ALLISON 0507 (AR09107560) DID HAVING BEEN CONVICTED OF A FELONY, UNLAWFULLY OWN OR HAVE IN HIS CARE, CUSTODY, POSSESSION OR CONTROL, A CERTAIN FIREARM, TO WIT: .22 CALIBER MARLIN FIR ARMS RIFLE, IN VIOLATION OF FLORIDA STATUTE 790.23; in his or her possession 10 or more similar false, altered, forged, or counterfeit notes, bills of credit, bank bills, checks, drafts, or notes, such as are mentioned in any of the preceding sections of this chapter, payable to the bearer thereof or to the order of any person, knowing the same to be false, altered, forged, or counterfeit, with intent to utter and pass the same as true, and thereby to injure or defraud any person, did knowingly, willfully and feloniously be in the actual or constructive possession of a controlled substance, to-wit: COCAINE AND ALPRAZOLAM, in violation of Florida Statutes 893.13(6)(B) and 893.03(C)(D) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: , IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2)(a). ON 020609, MEMBERS OF THE CITRUS COUNTY SHERIFF'S OFFICE TACTICAL IMPACT UNIT EXECUTED A LAWFUL SEARCH WARRANT of a travel trailer AT THE DISTINCT ADDRESS OF 6617 wEST skink lane, in crystal river, in cITRUS COUNTY, FLORIDA. THE SEARCH WARRANT HAD BEEN PREVIOUSLY REVIEWED AND GRANTED BY THE HONORABLE MARK YERMAN, COUNTY JUDGE IN AND FOR CITRUS COUNTY, FLORIDA. prior to the execution of the search warrant at approximately 1500 hours, this deputy had observed the defendant to be driving north on north donovan avenue, in a black in color mustang possibly driving towards the direction of the travel trailer. it should be noted that this deputy had prior knowledge that the defendant did not have a valid drivers license and had received a court order. AT APPROXIMATELY 1515 HOURS, THE CITRUS COUNTY SHERIFF'S OFFICE SHERIFF'S EMERGENCY RESPONSE TEAM (S.E.R.T.) ASSISTED THIS deputy AND OTHER MEMBERS OF THE TACTICAL IMPACT UNIT in SERVing SAID WARRANT AT 6617 west skink lane. LOCATED in the bedroom, on the bed of THE travel trailer, on said property, WAS THE DEFENDANT, MR. james yacy jenkins, jr., WHO WAS HANDCUFFED (DOUBLE-LOCKED) BEHIND HIS BACK. THE DEFENDANT WAS READ THE SEARCH WARRANT AS WELL AS HIS MIRANDA WARNINGS VIA PRE-PRINTED AGENCY CARD, to which THE DEFENDANT acknowledged that he UNDERSTOOD HIS RIGHTS by NODDING his head. however, THE DEFENDANT did not make any further statements and remained silent. While conducting a search of the bedroom of the travel trailer where the defendant was located, a 22 CALIBER Marlin FIR ARMS rifle was immediately located to the east of the bed on the floor of the trailer. it should be noted that prior to the execution of this search warranT, it was discovered that the defendant haD received a felony conviction with a dated disposition on 111286, for aggrAvated battery and probation violations. This deputy received a verbal confirmation from the state office of clemency that the defendant is a convicted felon and has not been restored the rights to possess a firearm. while conducting a further search of the bedroom of the travel trailer, a safe was located to the immediate west of the bed. This safe was secured to the floor of the travel trailer and was locked. Upon conducting a search of the contents of the bed, a set of keys was located. In conducting a further search of the interior of the defendant's travel trailer, another safe was located in an addition that was built on to the travel trailer. this safe was also locked. it should be noted that the set of keys that were located on the bed, from which the defendant was located, opened both safes that were located in the travel trailer. it should also be noted that the keys also contain the key to the ignition of the vehicle that the defendant was observed driving prior to the execution of the search warrant. while examining the contents of the safe which was located in the addition to the travel trailer, detective blair discovered currency that was folded and placed oN the bottom shelf of the safe. while conducting a further examination of the currency it was disCovered that multiple bills contained the same serial number. In addition it was observed that the color of the bills WAS not CONSISTENT to that of real CURRENCY. it should be noted that no additional types of currency was located in the contents of the safe. IN CONDUCTING A RECORDS MANAGEMENT CHECK, THIS DEPUTY LOCATED AN OPEN FRAUD CASE IN REFERENCE TO A TWENTY DOLLAR BILL WHICH HAD THE SAME SERIAL NUMBER AS ONE OF THE COUNTERFEIT TWENTY DOLLAR BILLS THAT WAS LOCATED IN SAID SAFE. it should ALSO be noted that upon conducting a search of the safe that was located in the bedroom, a receipt from the department of motor vehicles was located bearing the defendant's name on said receipt. in addition to the COUNTERFEIT currency, a yellow in color pill bottle was located with the name of the prescribed owner ripped off of the bottle, leaving the name of the contents of the bottle on the label. this label indicated that the contents, being two white in color oblong pills bearing an imprint of gg 256, were that of .25 mILLIgRAM (MG) alprazolam. SEVERAL OTHER ITEMS OF PARAPHERNALIA WERE LOCATED in THE travel trailer. examples of such paraphernalia were two cut straws which contained a white in color substance. a field test of the white powder substance yielded a positive reaction for the presence of cocaine. all items were collected and later turned into the citrus county sheriff's office evidence locker. while conducting an exteriOr search of the travel trailer, an advil bottle was located under the window of the bedroom of the travel trailer. in examining the contents of the advil bottle, an off white in color substance was located. The substance was field tested and did yield a positive reaction for the presence of cocaine. it should be noted that upon conducting a further examination of the bedroom window, which is in arms reach of the bed from which the defendant was located, it appeared that the bottle was dropped through a torn screen and a window which was ajar. THE DEFENDANT WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR possession of a firearm by a convicted felony, POSSESSION OF forged bills, possession of cocaine, possession of a controlled substance, possession of DRUG PARAPHERNALIA and did receive a florida uniform traffic citation for driving while license suspended revoked, 2nd conviction, bearing citation number 5740-fgw WITH A COURT DATE OF 022609 AT 1300 HOURS. THE DEFENDANT WAS SECURED IN THE REAR SEAT OF A PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT'S BOND WAS SET AT A TOTAL OF $23,000, PER THE BOND SCHEDULE. *NOT-EXEMPT*
