| Narrative: | The Brooksville Police Department Patrol Division reports that units were sent to the area of Cortez Blvd and Jasmine Rd in reference to a reckless drive failing to maintain his lane. A patrol unit found the vehicle and observed the vehicle failing to maintain a lane and fallowing to close to vehicles. A traffic stop was conducted and contact was made with James A. Kerr. Upon contact the officer could smell an odor of an alcoholic beverage on Kerr's breath. Kerr's eyes were blood shot and watery and his speech was slurred. Kerr was asked to step out of his vehicle and the officer noted that Kerr was unsteady on his feet and was losing his balance. The officer asked Kerr to perform some field sobriety test, which Kerr refused. Due to Kerr's driving actions and the officer's observation on the traffic stop Kerr was placed under arrest for driving under the influence. Kerr was transported to the Hernando County Jail where he refused to submit to a lawful test of his breath. It found that Kerr's driver's license had been suspended prior for him refusing to submit to a breath test and this was his second DUI arrest. Kerr was held at the jail under a $1500.00 total bond for DUI (seconded offense) and refusal to submit to a breath test after a prior D.L suspension for a refusal. |
