| Probable cause affidavit: | SUBMITTED BY: HOLLOWAY, TODD 0463 (AR13-5457) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: 1226 NORTH MUNICH TERRACE IN LECANTO, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: GRAND THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(3)(B); DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: POOL PUMP OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). On 050113, I responded to 1216 NORTH Munich TERRACE in Lecanto in reference to a burglary and grand theft. Upon arrival I spoke to the VICTIM via TELEPHONE CALL. The VICTIM advised that on or around the 041713, unknown person(s) entered the gated property and removed the pool pump without his permission. The VICTIM further advised that he would like prosecute. The VICTIM ALSO advised that the replacement pump cost $434.59 plus labor, when he replaced it. On 050113, I obtained information connecting the defendant to the stolen pool pump. I also drove by the defendantâs RESIDENCE LOCATED AT 316 Poppy STREET in Inverness. I could see from the street next to the DEFENDANTâs RESIDENCE two pool pumps; one of which turned out to be the victims. contact was LATER made with the defendant. The defendant was advised that he was being placed under arrest for the burglary and grand theft of the pool pump. THe DEFENDANT was handcuffed (DOUBLE LOCKED). The defendant was read his Miranda Warning via aN agency PREPRINTED Miranda card. Upon questioning, the defendant immediately stated that the pump I saw IN his yard was the stolen pump. With the defendants permission, he was transported to his RESIDENCE where the pool pump was recovered. It should be noted that the defendant had not installed the pump AND THAT it was just sitting next to his pump. The defendant was then transported to the CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING. Once at the DETENTION FACILITY AND during the post Miranda digitally recorded interview, The defendant confessed to not only stealing the pool pump, but also TO stealing two air conditionING units from a RESIDENCE and business located in the Inverness area. THE DEFENDANTâS BOND WAS SET AT A TOTAL OF $7,000.00 PER THE BOND SCHEDULE. |
