Probable cause affidavit: |
UNLAWFULLY ENTER OR REMAIN IN A CERTAIN DWELLING WITH THE INTENT TO COMMIT ANOTHER OFFENSE, NAMELY THEFT, THEREIN; AND DID UNLAWFULLY ENTER OR REMAIN IN NINE CERTAIN CONVEYANCES WITH THE INTENT TO COMMIT ANOTHER OFFENSE, NAMELY THEFT, THEREIN; TO WIT: ON 120308, AT APPR 0300 HRS, DEP CASEY PHILIPS WAS DISPATCHED TO THE AREA OF CANTERBURY LAKES IN REFERENCE TO A SUSPICIOUS VEHICLE AND PEOPLE WALKING AROUND. HE LOCATED THE VEHICLE AND MADE CONTACT WITH THE THREE OCCUPANTS WHO PROVIDED THEIR INFORMATION. THROUGH THE WINDOWS OF THE MINI-VAN, DEP PHILIPS WAS ABLE TO SEE SEVERAL 12 PACKS OF BEER. ALL THREE OCCUPANTS WERE UNDER THE AGE OF 21. ALL WERE ARRESTED FOR POSSESSION OF ALCOHOL BY PERSON UNDER 21 YOA. SEARCH INCIDENT TO ARREST REVEALED SEVERAL ITEMS THAT WERE BELIEVED TO BE STOLEN, SUCH AS TWO WALLETS THAT BELONGED TO RESIDENTS OF CANTERBURY ESTATES. I WAS CONTACTED TO RESPOND AS ON-CALL DETECTIVE. UPON ARRIVAL , I WAS BRIEFED AND MADE CONTACT WITH THE DEFENDANTS, INDIVIDUALLY. EACH WAS READ MIRANDA AND EACH GAVE A STATEMENT. EACH ADMITTED TO STEALING ITEMS FROM SEVERAL VEHICLES. CASE 08120139: THE VICTIM REPORTED THE THEFT OF A GPS UNIT FROM HIS TRUCK, THE GPS UNIT WAS LOCATED IN THE DEFENDANTS' VAN AND THEY ADMITTED TO THE BURGLARY. CASE 08120140: THE VICTIM REPORTED THE THEFT OF HIS WALLET, CHECK BOOK AND MEDICATION FROM HIS VEHICLE, THE WALLET AND MEDICATION WERE LOCATED IN THE DEFENDANTS' VEHICLE AND THEY ADMITTED TO THE BURGLARY. CASE 08120142: ADDITIONAL ITMES WERE LOCATED IN THE VAN WHICH CONTAINED VICTIM INFORMATION AND THE VICTIMS WERE CONTACTED AND RESPONDED TO THE SCENE. VICTIM 1 STATED THAT SEVERAL ITEMS HAD BEEN REMOVED FROM HIS TRUCK, WHICH WAS LOCATED IN HIS GARAGE, INCLUDING ONE OF HIS CHECKS, BEER, SODA, CHIPS AND OTHER ITEMS. THE DEFENDANTS ADMITTED TO ENTERING THE GARAGE AND BURGLARIZING THE TRUCK, AS WELL AS, ENTERING A SECOND VEHICLE IN THE FRONT YARD. VICTIM 2 STATED TWO VEHICLES IN HIS DRIVEWAY WERE ENTERED AND PROPERTY, SUCH AS JEWELRY, WALLET W/ CONTENTS, ETC, REMOVED. THE DEFENDANTS ADMITTED TO THESE BURGLARIES. VICTIM 3 STATED HER VEHICLE AND ITEMS, SUCH AS HER WALLET, PAYCHECK, ETC WERE STOLEN. THE DEFENDANTS ADMITTED TO THIS BURGLARY. DEP DALE JOHNSON MEDE CONTACT WITH TWO VICTIMS IN THE AREA OF CLARK AND LILAC IN INVERNESS. THEY WERE ABLE TO IDENTIFY SOME OF THE PROPERTY AS THEIRS. THE DEFENDANTS ADMITTED TO STEALING ITEMS FROM CARS IN THAT AREA. THE DEFENDANTS WERE TRANSPORTED TO THE COUNTY JAIL WHERE THEY WERE HELD IN LIEU OF $50,000 BOND. *NOT-EXEMPT* |
