Probable cause affidavit: SUBMITTED BY: RICCI, ANTHONY 0606 (AR 14-10209) (14-61927) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WAL-MART , TO WIT: THE DEFENDANT TOOK MERCHANDISE, UNWRAPPING PACKAGES, PLACING THEM ON HIS PERSON, PASSING ALL POINTS OF SALE AND CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF WAL-MART, TO-WIT: THE DEFENDANT CUT A MERCHANDISE ALARM OFF A PAIR OF HEADPHONES, DAMAGING THE ALARM, SAID DAMAGE BEING OF A VALUE OF $200.00 OR LESS, IN VIOLATION OF FLORIDA STATUTES 806.13(1)(A) AND 806.13(1)(B)1. DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 050514, AT 1945 HOURS, I ARRIVED AT 1936 NORTH LECANTO HIGHWAY, LECANTO, WAL-MART, IN REFERENCE TO RETAIL THEFT. UPON ARRIVAL, CONTACT WAS MADE WITH MR BRIAN ELAM, LOSS PREVENTION MANAGER, WHO ADVISED HE OBSERVED THE DEFENDANT ENTER THE STORE TAKING SEVERAL PIECES OF MERCHANDISE, UNWRAP THE PACKAGES, PLACING THEM ON HIS PERSON, AND ATTEMPT TO LEAVE THE STORE WITHOUT PAYING. ONCE CONFRONTED OUTSIDE THE STORE, HE ADVISED THE DEFENDANT ATTEMPTED TO LEAVE AND NOT COOPERATE, HOWEVER HE CONVINCED HIM TO BE ESCORTED TO THE LOSS PREVENTION OFFICE. MR ELAM RECOGNIZED THE DEFENDANT DUE TO THE FACT HE HAD SUSPICIONS THE DEFENDANT HAD STOLEN FROM THE STORE IN THE PAST. MR ELAM STATED ONCE HE OBSERVED THE DEFENDANT ENTER THE STORE, HE BEGAN FOLLOWING HIM. HE WITNESSED THE DEFENDANT TAKE A COUPLE OF BOXES OF SPORTS CARDS AND THEN HE PROCEEDED TO THE GARDEN CENTER WHERE HE BEGAN OPENING THE CARDS, TAKING THEM OUT OF THE PACKAGING, AND PLACING THEM IN HIS POCKETS. HE THEN FOLLOWED HIM INTO ELECTRONICS WHERE HE WITNESSED THE DEFENDANT TAKE A PAIR OF HEADPHONES AND A HARD DRIVE. THE DEFENDANT THEN WALKED TO THE PET SECTION AND SELECTED DOG TREATS, OPENED THEM, AND STARTED PLACING THEM IN HIS POCKETS. WHILE FOLLOWING HIM TO THE HOME DÉCOR SECTION, HE WITNESSED THE DEFENDANT CUT OFF THE MERCHANDISE ALARM FOR THE HEADPHONES. ONCE THE ALARM SOUNDED HE THEN HURRIEDLY HID THE MERCHANDISE BEHIND SOME COMFORTERS. MR ELAM THEN OBSERVED THE DEFENDANT GO TO THE FREEZER SECTION OF THE STORE WHERE HE SELECTED A BOX OF ICE CREAM, TAKING OFF THE PACKAGE AND BEGAN EATING ONE. HE THEN THREW THE REMAINDER OF THE BOX IN THE TRASH. MR ELAM THEN FOLLOWED THE DEFENDANT TO THE RESTROOM WHERE HE OBSERVED HIM ENTER A STALL. ONCE THERE HE HEARD WHAT SOUNDED LIKE THE DEFENDANT TAKING PACKAGING OFF OTHER PIECES OF MERCHANDISE THAT WAS IN HIS POCKETS. THE DEFENDANT THEN EXITED THE RESTROOM, WALKED PAST THE CASHIERS, AND ALL POINTS OF SALE, EXITED THE STORE, WHERE MR ELAM THEN MADE CONTACT WITH THE DEFENDANT, IDENTIFYING HIMSELF AS THE LOSS PREVENTION OFFICER. ONCE IN THE OFFICE, MR ELAM CONTACTED LAW ENFORCEMENT. PER THE COMPLAINANT THE DEFENDANT WAS ALREADY IN THE STORE DATA BASE FOR ANOTHER RETAIL THEFT VIOLATION AT THE HOMOSASSA STORE. A SEARCH OF THE DEFENDANT PREVIOUS CRIMINAL HISTORY REVEALED HE DID HAVE A PAST HISTORY OF THEFT. WHILE THE DEFENDANT WAS GIVING PERSONAL INFORMATION TO THE COMPLAINANT, HE APOLOGIZED FOR STEALING THE ITEMS. THE DEFENDANT WAS PLACED UNDER ARREST FOR RETAIL THEFT AND CRIMINAL MISCHIEF FOR DAMAGING THE MERCHANDISE ALARM. THE DEFENDANT POCKETS WERE EMPTIED TO WHICH CONTAINED BASEBALL CARDS, DOG TREATS, LIGHTERS THAT WERE TAKEN FROM THE STORE. ALSO IN HIS POCKETS WAS AN ORANGE PLASTIC CONTAINER WHICH CONTAINED A HALF GRAM OF MARIJUANA. THE DEFENDANT WAS ADVISED HE WOULD ALSO BE CHARGED WITH POSSESSION OF CANNABIS UNDER 20 GRAMS. THE DEFENDANT WAS HANDCUFFED, (DOUBLE LOCKED), BEHIND THEIR BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING THE DEFENDANT’S BOND WAS SET AT $500 FOR RETAIL THEFT, $250.00 FOR CRIMINAL MISCHIEF, AND $500.00 FOR POSSESSION OF CANNABIS FOR A TOTAL THE DEFENDANT’S BOND AMOUNT OF $1,250.00, PER THE BOND SCHEDULE. THE ORANGE CONTAINER AND CANNABIS WERE PACKAGED AND TURNED INTO EVIDENCE.
